After due consideration and consultation our lawyer, Lois Sparling, has decided to appeal the Federal Court decision denying our application for either a declaration of law that the National Archivist already has care and control of the 1911 Census records or directing the Chief Statistician to release care and control of the 1911 Census to the National Archivist. The appeal will be to the Federal Court of Appeal. At the present time funding from earlier contributions is sufficient to get things started. Should further funding be required in the future we will advise how you may assist at that time. This morning I spoke with Dan O'Donnell, investigator in the Office of the Information Commissioner. The wheels of government grind slowly and it would appear that there is nothing different in this as regards our complaints against Statistics Canada. Once again there has been some delays, although Mr. O'Donnell assured me today that things are now in the final administrative stages. He has received Statistics Canada's response to the Information Commissioner's correspondence with them and in fact was working on our file when I called. Unfortunately Mr. O'Donnell was unable to advise me either what the Information Commissioner's position is or how Statistics Canada has responded. Mr. O'Donnell now expects that our letters of response from the Information Commissioner should be forthcoming before the end of August. As usual he indicated that should there be any change in the status of our complaints he would contact me. While further delay is disappointing we are unable to do anything about it.
