After due consideration and consultation our lawyer, Lois Sparling, has decided to appeal the Federal Court decision denying our application for either a declaration of law that the National Archivist already has care and control of the 1911 Census records or directing the Chief Statistician to release care and control of the 1911 Census to the National Archivist. The appeal will be to the Federal Court of Appeal. At the present time funding from earlier contributions is sufficient to get things started. Should further funding be required in the future we will advise how you may assist at that time. This morning I spoke with Dan O'Donnell, investigator in the Office of the Information Commissioner. The wheels of government grind slowly and it would appear that there is nothing different in this as regards our complaints against Statistics Canada. Once again there has been some delays, although Mr. O'Donnell assured me today that things are now in the final administrative stages. He has received Statistics Canada's response to the Information Commissioner's correspondence with them and in fact was working on our file when I called. Unfortunately Mr. O'Donnell was unable to advise me either what the Information Commissioner's position is or how Statistics Canada has responded. Mr. O'Donnell now expects that our letters of response from the Information Commissioner should be forthcoming before the end of August. As usual he indicated that should there be any change in the status of our complaints he would contact me. While further delay is disappointing we are unable to do anything about it. Halifax Herald August 4, 2004 MacGILLIVRAY (Hurlburt), Marie Frances - Northview Drive, Antigonish, passed away peacefully August 2, 2004, in St. Martha's Regional Hospital, after a lengthy illness. Marie was born in Dorchester, Mass., the only daughter of Philip and Jean (McKinlay) Hurlburt, January 4, 1929. The family returned to Yarmouth three years later where Marie completed her elementary education at St. Ambrose Convent School. Later she went to Mount St. Vincent University, Halifax, to complete her studies for a B.A. degree in 1951. She married Jerry, a teacher, in 1952 and moved from Yarmouth to Antigonish in 1956. An excellent classical musician in both piano and voice, she brought a love of music to her family. She sang with a number of choral groups at university, Yarmouth and Antigonish. Marie leaves to mourn her loving husband, Gerald J.; daughters, Margaret, Antigonish; Kathy, Halifax; Maura, East Bay; Barbara (Philip) Dugandzic, Halifax; Sheila (Philip) Wright, Beaver Bank; also surviving are grandchildren, Adam Whalen, Mairi, Anton, Julia and Anna Dugandzic, Isaac, Liam and Christian Wright. She was predeceased by her first daughter, Joanne (Halifax). Liturgy of Christian Burial will be Friday at 2 p.m. in St. Ninian's Cathedral, Rev. Having been an interested reader (read 'lurker') on this site for some time, and having noticed the interest in those of the Clan Chisholm posted on this list, I thought that you may like to hear my comments re the Clan lands that they left behind, and the whole beauty of the country that is left there to view. Being of Cameron and MacDonald ancestry, I had never wandered into either Glen Affric nor Strathglass on my trips over to Scotland, but having read some of the postings by Hugh Niven of the clearances of that area and being in Inverness at the time it was only a short drive to go into these places and see the country for myself, so when an opportunity to be driven up Glen Affric, into Strathglass, to Struy was offered I readily accepted. Enter into the Glen Affric National Park and you see all that the brochures tell off, the most beautiful glen in Scotland, one of the largest remaining ancient Scots pinewood areas, the Capercaillie, black grouse, crested tit, crossbill, golden eagle, red-throated diver, and even the pine marten, but we didn't see them, they are for the walkers, we saw no wild life as we drove along the one narrow lane, with seldom used lay-bys as far as we could travel........what we saw there were the wildflowers, banks of heather, broom, native flowers with names unknown...... but most importantly, we saw the re-afforestation of the peaks, not the regimented Forestry plantings that are economically grown in some areas for commercial logging, but the natural (with possibly some assistance) re-growth of the native trees. For Glen Affric is free of all livestock, there are no sheep nor cattle to graze and damage the landscape, it can revert to it's wild natural state, and suddenly you have ! some idea of what the Scottish Highlands must have looked like when managed by our ancestors. To drive from Glen Affric into Strathglass only requires a turn of the wheel, but quite a change in scenery, this is a wide fertile strath, large ploughed areas not usually seen in the Highlands, soil the colour of nutmeg and obviously rich and productive, the river Glass has marker's along it's banks, noting the areas which can be fished "divided into six beats of 3 rods each, fly only, rotating daily." We did not find the place where the 13th Lord Lovat had built in 1838 for reputed descendants of Bonnie Prince Charles, the Sobieski brothers the house on Eilean Aigas - a 60-acre wooded island of idyllic beauty. But we did locate in the churchyard of St Mary's at Eskadale the grave where one of the brothers The Chevalier John Stuart Sobieski is buried February 22, 1872 and in a separate enclosed section, Thomas Alexander Fraser, 10th laird of Strichen, later 14th Lord Lovat, is buried, along with later generations of the Lovat family...... However it is the graves of the Chisholm clergy that dominate, similar yet dissimilar headstones they record just how many of the line served their beliefs and as the church records........ The latter part of the seventeenth century saw a member of the Chisholms of Knockfin family, founded by Colin, second son of the 17th Chief, become the first native priest of Strathglass since the Reformation. From then on, Strathglass was known as 'a nursery of priests', five bishops and at least 25 of its priests being directly or indirectly descended from Colin of Knockfin" Little wonder then at the name reoccurs on the tombstones. It is a very beautiful area, and the historic events which removed Scots from these lush fertile lands is too harsh to even think upon.... so a dram to the Chisholm descendants wherever they are.     3. Hi Folks, As you may remember from a year or so ago, "attbi.com" addresses were switched to "comcast.net". Comcast promised to forward the 'attbi.com' email until December 31, 2004. At this time, I would like to request you check your email address books for: <[email protected]> and if you find it, please DELETE it from your system. I am finding that many listers still write to me using that old address even though I know they have my new address. If your email program has the auto-fill function, it automatically fills in email addresses once you start typing the person's name. If you still have me listed with the attbi.com address, that is the email address that is going to fill in first and you may not even realize it as you're doing it! <g> So please check and delete it!! Comcast has offered the option to stop forwarding the old attbi.com email now and I am going to take them up on their offer (Hoping this move will stop most of my spam !!). ;-) Thanks for your help! On Tuesday 20 July 2003 Prime Minister Paul Martin announced the makeup of his new Cabinet. David Emerson (Vancouver Kingsway, BC) was appointed as the new Minister for Industry and Minister responsibe for Statistics Canada. As a newly elected Member of Parliament Mr. Emerson is unlikely to be aware of the battle we have been in for the past several years to regain the same unrestricted access to Census records after 1906 that we currently have for 240 years of records up to that time. Please take a little of your time to write him an email, or better yet a snail-mail letter, to congratulate him on his recent election and appointment as Minister of Industry. At the same time inform him of our efforts to regain the public access to Historic Census records that has been withheld (believed illegally) by the Chief Statistician of Canada. Inform him that the Access to Information and Privacy Acts (and Regulations) make specific provision for 'personal information' collected through Census or Survey to be made available to 'any person or body' for purposes of research 92 years after collection. Ask him to immediately direct the Chief Statistician of Canada to return care and control of records of the 1911 National Census of Canada to Ian E. Wilson -- National Librarian and Archivist -- for subsequent public access in accordance with the ATI and Privacy Acts. Ask him to immediately direct the Chief Statistician to obey the Laws of Canada. Advise him that the conditions and restrictions of the now defunct Bill S-13, in particular the so-called 'informed consent' clause for future Censuses, are totally unacceptable to the genealogical and historic communities that seek to regain the public access currently provided for in existing legislation. Advise him that any Bill containing conditions and restrictions similar to those in Bill S-13 would be similarly unacceptable. Advise him that we do not believe any legislative change is necessary to regain the public access we seek. Existing legislation currently provides for that access. If he feels otherwise such access could be further clarified by the addition of a single clause -- similar to the following -- to the Statistics Act: "Original schedules of Census or authentic copies thereof shall, not later than thirty (30) years following collection, be transferred to the care and control of the National Archivist for subsequent public access in accordance with provisions of the Access to Information and Privacy Acts, and Regulations attached thereto." Such a clause would ensure continued public access to Historic Census records in accordance with existing legislation, would not add unnecessary and undesirable conditions or restrictions to that access, and would not create the necessity for a further costly bureaucracy to manage or control unnecessary conditions and restrictions. Further, it would not create a legislative conflict by conferring powers to the Chief Statistician that currently reside only with the National Librarian and Archivist.
