Wilson -- National Librarian and Archivist -- for subsequent public access in accordance with the ATI and Privacy Acts. Ask him to immediately direct the Chief Statistician to obey the Laws of Canada. Advise him that the conditions and restrictions of the now defunct Bill S-13, in particular the so-called 'informed consent' clause for future Censuses, are totally unacceptable to the genealogical and historic communities that seek to regain the public access currently provided for in existing legislation. I have contacted Dan O'Donnell, investigator in the Office of the Information Commissioner that has been handling our complaints regarding StatCan's refusal to return care and control of the 1911 Census records to the National Archivist. He indicated that they have received the last of the responses to their inquiries and so the investigation into our complaints was in the final stages. He stated that he felt, but could not guarantee, that letters giving the response of the Information Commissioner to our complaints would likely be forthcoming within two or three weeks. Delays in receiving this response have been frustrating, however Information Commissioner John Reid has indicated that he wished to ensure that all the 'i's were dotted and the 't's were crossed in his investigation. Should his decision be to proceed to the courts on our behalf he did not wish his case to fail because something had been overlooked. We are optimistic that the decision regarding the 1911 Census will be similar to the one reached for the 1906 Census, and for the same reasons. In that instance Mr. Reid concluded that there was no reason for the records to be withheld from public access and he was prepared to proceed to the courts on our behalf. On the same day (24 January 2003) that his action was filed with the courts the 1906 Census was released and placed online. We will have to be patient for just a little longer. There are 106 new Members of Parliament out of a total of 308. There were 121 changes in riding names. Each addition or change to the Scoreboard requires multiple changes to be made to at least four files so for the last few days I have not strayed far from my computer. New Members of Parliament are indicated in the left column of the Scoreboard with a single asterisk (*). E-mail addresses for new MPs have been calculated based on a formula using their name and initials. These addresses are indicated in the right column of the Scoreboard with a double asterisk (**).They may not yet be activated. Changes to these addresses will be made as I become aware of them. Correspondence logs accessible by clicking on the MP's name in the left column of the Scoreboard are being updated but it will probably take the better part of the next several days to complete this. Dear lists, The hearing of our second Federal Court Application, Beatty v AG Canada et al was this morning in Calgary. Mertie Beaty and Rene Dussome were there to cheer me on. Patrick Bendin appeared as Counsel for the misguided ones. We presented argument for about 3 hours with a few questions from Mr. Justice Gibson. I would have preferred more questions and discussion with the judge since that would have given me some clues about what he was thinking and what he did and did not accept from my arguments. The decision was reserved. This means the judge will think about it all some more, perhaps do some research of his own and give us a written decision later. The late Bob Westbury was very much on our minds as we arrived at the Court. I have to correct Gordon Watts' suggestion that Bob was just playing devils advocate when he suggested civil disobedience. He meant every word of it. Access to our history was a matter of great importance to him. He was truly outraged with the attitude of the Chief Statistician and, more recently, with the deal the National Archivist apparently felt he had to make (Bill S-13). Fortunately, I forgot about everything except the argument to be presented once Court started. In Memorium Dr. Robert Clifton Westbury 1936 - 2004 It is with the most sincere regret that we have learned of the death of Dr. Robert Clifton Westbury on 4 June 2004. At the age of 68 Bob died peacefully at home after a lengthy battle with Cancer. Bob was an energetic and enthusiastic supporter of our campaign to regain public access to Historic Census records until his illness forced him to pass his torch to others. He was a driving force in promoting our first legal action that resulted in the release and placing online of the 1906 Census of the NorthWestern Provinces of Alberta, Saskatchewan and Manitoba. He pushed for our legal action when some others of us were less enthusiastic about taking that course. Were it his decision alone we would have proceeded with the legal action a full year earlier than we did. It is ironic that his passing took place within a few days of our second legal action being heard in Federal Court. We imagine his spirit sitting in the back of the room rooting for Lois Sparling in her dealings before the Court. His frequent postings to the Canada-Census-Campaign mail list before becoming ill promoted much lively discussion on the list. While some may have considered his postings provocative it is believed that Bob enjoyed playing the part of 'devil's advocate'. In this role he occasionally suggested the use of 'civil disobedience' to publicize our campaign. On my recent trip to Calgary Doug Joudrey and I paid a visit to Bob. His illness had made him very weak and it was difficult for him to speak. He was, however, alert and aware and knew who we were. He appreciated that we had come to see him. Robert Westbury is the second member of the Canada Census Committee to die without seeing the successful conclusion of our efforts. The first was Donald Nisbett. Both joined the Canada Census Committee at the time of its formation Both have made significant contributions to our campaign. When we are finally successful in regaining continued public access to all Historic Census records it will be due, in no small part, to the contributions they have made to that effort. We have tendered our condolences to Bob's immediate and extended family. Rest in Peace Bob -- You will be remembered.
