    1. [CAN-BC] Post 1901 Census - update on legal action
    2. Gordon A. Watts
    3. Greetings All. It appears that I have been remiss in not updating all regarding what is happening with our legal action to obtain a 'writ of mandamus' to force Statistics Canada to transfer control of the 1906 Special Census of the Western Provinces (Alberta, Saskatchewan and Manitoba) over to the National Archivist. While I have provided information regarding this in my last couple of columns for the Global Gazette, I have neglected to post it to the lists. Because of requests to do so, I provide that update to the lists now. The situation to date is as follows: On 8 February 2002, our lawyer in Calgary, Lois Sparling, processed an 'Application for a Judicial Review' with the Federal Court. Lois, and the other lawyers assisting her, felt that an Application for a Judicial Review would be a faster method of achieving our goal than the court action originally contemplated. The defendants served with this Application were Dr. Ivan Fellegi - Chief Statistician of Canada; George Radwanski - Privacy Commissioner; Ian Wilson - National Archivist; John Reid - Information Commissioner; and the Attorney General of Canada. All of the defendants have filed Notices of Appearance. While this Application named Ian Wilson and John Reid as defendants, it is known that both of them have supported public access to Historic Census Records. The Attorney General is named as a defendant in any actions against the Government or any of it's departments. The Application names eleven plaintiffs from various places in Canada. Those plaintiffs have all sworn Affidavits stating their reasons for seeking access to the 1906 Census records. and those Affidavits were presented during the last week of February 2002. The next thing to happen is for the defendants to submit their Affidavits. Lois advises that the Privacy Commissioner and the Information Commissioner each have their own lawyers while the Attorney General of Canada, the Chief Statistician and the National Archivist are all being represented by the Department of Justice. It is not known at this time how long this procedure will take, but we hope to have results in a matter of months, rather than the possible years that the alternate court action could have taken. While this Application refers only to the 1906 Census, it is expected that it will set the precedent for obtaining access to at least the 1911 and 1916 Census, and likely all subsequent Census as well. The reason only the 1906 Census is mentioned is that it is the only one that has passed the 92 year period after which it should have been released (in 1998). As I understand it, a writ of mandamus is good only for something that has already happened (or not happened) and cannot be used for future violations. It should be noted that this is a parallel action to our collection of signatures on petitions, and writing to our elected and appointed representative to seek support for access to these most important records. Petitions and letters are especially important at this time when Bill C-312 is expected to be debated in the House of Commons in early April, and Bill S-12 is currently receiving Third Reading in the Senate. All are encouraged to write their own MPs and Senator's if they have not already indicated their support for access. The Scoreboards on the Post 1901 Census Project Website (at the URL following my signature) are pretty well up to date with known positions of MPs and Senators. Please check the positions shown for your representatives, and if you have correspondence from them that shows a position for them different from that shown, forward that correspondence to me so that the Scoreboard might be updated. Happy Hunting. Gordon A. 3. Hello, I just joined this list a few days ago and have noticed that some people do look ups. I would like to get copies of b/m/d information I have found on the B.C. Archives website. Is there someone willing to do this and what is it, exactly, that will be photocopied, what is the cost? Please excuse my ignorance, just learning. Also please tell me what SKS stands for. Thanks for helping me. Lesley Anderson

    3. To all: Now the Olympics are over and I am "almost" pleased with Canadian results -- however, there is a next time -- looking forward to my gr.granddaughter being one of the skating team! Now, we must work! Recently, the Globe and Mail provided us with the URL of an online survey, only available until March 1, 2002. It is being conducted by the National Archives of Canada and what we would like to have available from the Archives. Click on the URL and complete -- your name and address is not requested, only part of postal code::- http://accessible.archives.ca This survey was but one item in an impressive supplement section of the Globe and Mail newpaper of Saturday 16 February 2002. This supplement contains much information about the National Archives of Canada and plans in the works for a "Canadian Genealogy Centre". Perhaps one of the most interesting lines in this supplement was in an article titled "Digitization: A Transformation for the National Archive". This line stated "To meet the insatiable national and international demand for genealogical infromation, the returns from the 1901 Canadian Census will soon be available online, free of charge." This is indeed welcome news. Welcome also is the news that online access to these records will be free of charge, unlike the online access for the records of England, Wales, and Scotland, and the commercial enterprizes offering digitized returns in the United States. Please complete your questionnaire -- even if you have done so before. Two articles are available and will forward if one contacts me privately. Muriel M. 3. Hi Stella, Thanks- you always have such good ideas! Marlinna said she'd look it up, thanks. And Blair checked the website. And Ines volunteered to check it on her holidays! ( I got a request from the RAOGK, even though I don't list obit lookups as my volunteer contribution. I wasn't feeling too organized, so I just sent off a message to see if anyone could find it for him.) I should have known the people on the list would help out in many different ways! :-) I can't tell you how many times I've heard from people who say this is a great bunch of people! Thanks! RAOGK sent a disturbing message today, saying that they suspect that some professional researchers are getting the RAOGK volunteers to look up information and then turning around and charging their clients for it.! I'm sure this is a very rare thing and will try not to let it make me suspicious. I feel a Desiderata quote coming on! :-) "Exercise caution in your business affairs, for the world is full of trickery. But let this not blind you to what virtue there is; many persons strive for high ideals, and everywhere life is full of heroism ." 3. Hi All I'm searching for information about a cousin of mine, once removed, whom I believe was teaching in Mission in the early 1940s. She was reported as living in Mission at the time of her father's death in Regina in 1941. The person I seek is Margaret Helen Vanderburgh. I knew Margaret back in the 30s but lost touch with her thereafter. At that time she was teaching in Sault. Ste. Marie, ON. Somewhere along the way, I also stumbled upon info that indicated she may have taught in Abbotsford. She was born in 1909, probably in Indian Head, SK to where her father emigrated from Ontario and where he and Margaret's mother are buried. I can find no record of a marriage or death. When I knew her, she was unmarried and in her 20s. I can see her face in front of me as I type. Is there any list user in the Fraser Valley, who might have a look at Mission and Abbotsford school archives...perhaps even other Fraser Valley districts. I know I'm dart boarding. Does anybody know of accessible archives of BC teachers through the years and that's indexed? I welcome all suggestions or assistance. Thanks all Ron Davies Surrey, BC

CSM is an army rank - Company Sergeant Major, which was a senior non-commissioned rank. I'm not sure of the rules for being included in the CWGC record, maybe it is restricted to those who died as result of direct enemy action. He may have died in peacetime.
