Superior Court, Modoc County, California In the Matter of the Estate of Wilhelmina STREIG Decree of Final Distribution Filed December 4 1941 No. 1534 F. E. BUSH, executor of the last Will and Testament of Wilhelmina STREIG, deceased, having rendered and filed herein a full account and report of his administration of said estate, and said account and petition this day coming on regularly to be heard and proof having been made to the satisfaction of the Court that the Clerk had given notice of the settlement of said account and the hearing of said petition in the manner and for the time required by law, the Court now finds: That Wilhelmina STREIG died in the County of Modoc, State of California, on or about the 13th day of February, 1941, leaving a Will bearing date the first day of June, 1928; that after proceedings regularly had and taken to that end the aforesaid Will was on the first day of April, 1941, admitted to probate in the above entitled Court as the last Will and Testament of decedent, and petitioner was appointed executor of said estate of said decedent and he thereupon qualified as such executor and ever since has been and now is the duly qualified executor of the last Will and Testament of said decedent; that on the 17th day of April, 1941, the said executor published for the first time a notice to creditors of said decedent to present their claims within six months thereafter; that said notice was published in all respects in the manner and for the period required by law. That petitioner has duly made and returned herein a true and correct inventory and appraisement of the estate of said decedent which has come to his possession or knowledge. That all debts of said decedent which have been presented and allowed have been paid; that all expenses of administration thus far incurred have been fully paid. That all property taxes which are due and payable have been fully paid and there is no inheritance tax due from said estate, or due from the legatees or devisees, as appears from the certificate to that effect on file herein. That said account is in all respects true and correct and that it is supported by proper vouchers; that the residue of money in the hands of the executor at the time of filing said account was $836.59; that the estimated expenses of closing the estate will amount to about $3.00; that since the rendition of said account there has been expended by said executor, the sum of $16.33 as and for State and County taxes. That more than six months have elapsed since the date of first publication of the notice to creditors; and that the estate is ready for distribution and now in condition to be close. That the whole of said estate was separate property of said decedent. That under the terms of the last Will and Testament of Wilhelmina STREIG, Sam STREIG is entitled to the following property for his use during his lifetime and upon his death Carl Samuel STREIG the only issue of the said Sam STREIG is entitled to the fee simple title to the said following described property, to wit: All those certain pieces, parcels and lots of land situate, lying and being in the Town of Lake City, County of Modoc, State of California, described as follows, to wit: Unblocked Lots 1a, 2 and 3 in the NW1/4 of NW1/4 of Section (36) Township (44) North Range (15) East, M.D.M. Water rights and ditches. That under the terms of the said last WILL and Testament of Wilhelmina STREIG, deceased, the following named persons are entitled to all the rest, remainder and balance of the estate of said decedent, share and share alike, to wit: Name:; Relationship:; Address: Fred STREIG, Son, Rt. 1, Box 136 San Juan Bautista, San Bernardino County [Should be San Benito County], California Sam STREIG, Son, Box 63, Lake City, Calif. Minnie STREIG POLANDER, Daughter, Fallon, Nevada Albert Ray STREIG, Grandson, c/o Mrs. Fred STREIG, Route 1 Box 136 San Juan Bautista, San Benito County, California It is therefore ordered, adjudged and decreed that the final amount of said executor, including his statement of expenses and disbursements since the rendition of said account and his estimate of closing the estate be and the same is hereby finally settled, allowed and approved. It is further ordered, adjudged and decreed that the residue of said estate hereinafter particularly described be and the same is hereby distributed as follows: To Sam STREIG for his use during his lifetime and upon his death to his only son, Carl Samuel STREIG, in fee: All those certain pieces, parcels and lots of land situate, lying and being in the Town of Lake City, County of Modoc, State of California, described as follows, to wit: Unblocked Lots 1a, 2 and 3 in the NW1/4 of NW1/4 of Section (36) Township (44) North Range (15) East, M.D.M. Water rights and ditches. That all of the rest, remainder and balance of said estate of said decedent to the following names persons, share and share alike, to wit: Fred STREIG, Sam STREIG, Minnie STREIG POLANDER, and Albert Ray STREIG Together with all property not now known or discovered or which may be hereafter known or discovered, or acquired belonging to said decedent at the time of her death, or to which she was then entitled, or in which she then had any interest, or which belonged or may belong to or be subsequently acquired by said estate, or to which it is now, or at any time hereafter, be entitled, or in which it may have an interest. Judge of the Superior Court. ******* In the Name of God, Amen I, Wilhelmina STREIG of Lake City, County of Modoc, State of California, being of sound and disposing mind and memory, and not acting under duress, menace, fraud, or the under influence of any person whomsoever, do make, publish, and declare this to be my last WILL AND TESTAMENT in manner following, that is to say: First That all my just debts be paid and that the expense of my last illness and funeral be paid and that a suitable monument be erected at my grave. SECONDLY, I give and bequeath to my son Sam STREIG for his use during his lifetime my home place in Lake City, California, the same being the place purchased by me from one Mrs. Mary GARRETT. At the death of my said son Sam STREIG and if he have issue, said place shall go to such issue, share and share alike if there be more than one child. If the said Sam STREIG have no issue then, at his death said property shall go to all of my grandchildren then living, share and share alike. My said son Sam STREIG is now about 47 years of age. THIRDLY, I give to the following named four persons all of the balance of my estate if which I may be possessed at the time of my death, of whatsoever kind, share and share alike, that is to say One fourth of all the balance of my estate to each of the following persons: My son Fred STREIG aged about 58 years, My Son Sam STREIG aged about 47 years (being the same Sam STREIG mentioned SECONDLY herein) My Daughter Minnie STREIG POLANDER, aged about 45 years and My Grandson-Albert ROY STREIG, aged about 13 years-(The said Albert ROY STREIG is the son of my deceased son Albert STREIG) Lastly: I hereby nominate and appoint F. E. BUSH, of Cedarville, Modoc County, California the executor of this my last will and testament, and hereby direct that he serve as such Executor without bonds and hereby revoke all former wills by me made.
