    3. Sue, I would consult the holding of the California Supreme Court in "In re Lifschutz, 467 P.2d 557, Cal. 1970. Under the rational of that and other holdings, I think you might find that the privilege of privacy belongs to the PATIENT, and not a physician, etc. I think you might also find that the right extinquishes with death. Under this reasoning, I don't see why the records would not be available. Please let me emphasize, this is a totally NON-legal opinion.
