The driver, Tommy Joe Smith of Bakersfield was driving the truck, a Chevrolet flatbed loaded with seed potatoes, going south on the Tehachapi - Willow Springs Road near the intersection of Oak Creek, when either from a black-out, or mechanical failure the truck went out of control. It left the highway and toppled over and over, coming to rest in Oak Creek. The driver was killed and his remains were taken to Bakersfield. A stepbrother took charge of the damaged vehicle which was towed to a local garage. The accident occurred on Friday, May 15, at about 6:15 p.m. 21 May 1959
