State of North Carolina ) Court of Pleas Burke County, ) & Quarter Sessions 4th Monday of September A.D. 1823 To the worshipful the Justices of the court of Pleas and Quarter Sessions aforesaid -- The Petitions of Milly Higdon (Married to Nathan Austin), Henry Cagle , Betsy (Married to Peter Lowkenore, Johnathan Cagle , Catherine Cagle, Rebecca Cagle, Jacob Cagle shews to your worships that they are Possessed as Tenants in common of Certain Tracts of Land in the County, of Burke bounded as Follows to wit a Tract of one hundred fifty acres on Mill Creek Bounded as follows Beginning at a Pine on the East Side of Mill Creek A. Bairds Corner to the Line of A. Payne. M. J. Roane The Petition of the heirs of John Cagle was duly grated by court, as indicated in the followin notation which accompanied the above document: Petition of The Heirs of John Cagle Decd. Petition allowed 1823 Roane Attorney & wants a fee in this case The Minutes of the Sept. 1823 Session of the Court indicate that the requested surveyor and five freeholders were appinted as requested: these men were identified as follows (though it is not indicated whic of the six was the surveyor): James Allen Babel Sherrill Joseph Starns, Sr. Andrew Baird Abner Pain Harrison Turner A conparison of the 1823 document with the Daniel Payne document of 1815 reveals that four of the five tracts of land mentioned in the 1823 document were identical to the tracts mentioned in the Payne document. the land in question , as nearly as can be determined, lay in the southern part of what is now Alexander county, Milly, the first named heir of John Cagle , is listed in teh 1823 document as Milly Higdon, married to Nathan austin. the reason for this is unclear, unless Milly was a Step-daughter of John Cagle, and daughter of his wife Lucey by a previous marriage to a man named Higdon: or , to mention another posibilit, perhaps Milly had been married to a Higdon before her marriage to Nathan austin. Peter Lowkenore, who was married to Betsy Cagle , later appeared in the 1830 census of Lincoln County, NC. P. 183 as Peter Loughenore. To date, no further information has been found on Catharine and rebecca Cagle, John's daughters who were still unmarried as of 1823. Regarding Jacob Cagle the youngest child of the deceased John Cagle, it is known that he was born ca.1815, since he was apprenticed to a blacksmith in 1824, at the age of nine years . The record of his indenture is preserved from the July 1824 Cout Session from Burke County: Jacob Keagle now nine years of age, minor son of John Keagel, decd, bound to Henry Tritt until 21 years of age, to be taught to read , write and cypher to the rule of ___________, to be taught the rrade of a blacksmith, to recover with his freedom a good set of blacksmith tools, one store suit of clothes and home made shirt. It will be remembered that Henry Tritt was a witness to a land puchase by Leonard Cagle in Lincoln (Catawba) Co. in 1805, and the Balser Treat (or Tritt) was a nieghbor to Leonard Cagle in Lincoln Co. from 1805 to 1815. regardin the appearance of young Jacob Cagle in later records, he has not been positively identified as a head of houshold in any census listing. However, the possibility might be considered taht he was identical to Joacob Cagle, born ca.1815, who appeard as follows in the 1850 cenus of Pike Co., Missouri: Cagle, Jacob 35 b-NC Farmer /$600 p.202 Mary 42 Va Bennett, Aaron 17 Mo In School Love, James 11 " " " Spencer , Malinda 30 " " " John's oldest sons Henry Cagle and John Cagle (Johnathan) were also in the estate papers of Moses Bentley, who died in 1827. Henry Cagle appeard in the 1830 and 1840 censuses of burke Co. moved to Haywood County, in the 1840s, where he joined his brother John who had moved to Haywood in the 1830s Nancy Jane Tarzana, Ca.
