Hello, Thanks to everyone who has emailed Assemblymember Bill Campbell since I first sent out my email about this Bill. I received an email message from Assemblymember Campbell asking that I call his office. They are drafting amendment language that will provide that the bill will be prospective and will only apply to persons who die after January 1, 2001 and who made no provision for the disposition or future use of the family plots purchased in the deceased's name. The plot will then devise to the heirs of the deceased for their further use or disposition. The historic family plots will not be affected and cannot devise to any other party than the original plot purchasers. Thanks again to everyone who wrote. Greetings, Assemblymember Bill Campbell introduced AB 322 that will provide that family cemetery plots if not specifically bequeathed by the deceased plot owner, will pass to heirs according to the state's laws governing Intestate Succession. The intent of the bill is to allow heirs access to the use and enjoyment of the plots (provided, I would hope, there is room to be interred). UNFORTUNATELY, what this Bill also provides is that the "heirs" then have the right to sell, bequeath or otherwise dispose of the remaining grave plots in the family plots. Previous to this, California Health and Safety Code has provided that family plots are inalienable and that no one not authorized by the "plot owner" to be buried there, may legally be interred. The present law is consistent with the earlier feelings of people that they have a place set aside for the use and burial (together) of their family members. The reason that families in the old cemeteries enclosed their plots with concrete or granite coping was to protect "their" burial space. AB 322 may have the effect of disposing of those now-deceased person's right to what they intended originally. If you agree that family plots should be forever held for use by a family and that non-related parties should not be allowed to invade those burial spaces, please contact Assemblymember Bill Campbell in OPPOSITION of AB 322. He traveled from Bainbridge Twnshp., Berrien Cty., Michigan to California in about 1850. He had the 'gold rush' fever and traveled with several other men, unfortunately he died there a year later (1851). I believe he would have been in El Dorado county since that was the center of the gold rush. Can anyone help me locate burial or death records of that time period? I would like to know if anyone can copy or obtain copies of the newspaper accounts of the accident and what newspapers were in existence in 1945 and covered El Dorado County, CA. Our goal is for the preservation, protection and restoration of our county's historic cemeteries. This is to advise you that Assemblymember Anthony Pescetti has introduced Assembly Bill 1368 (AB 1368) to establish the California Historic Cemetery Commission. California has had a dismal history when it comes to its treatment of cemeteries. From the earliest years of statehood, cemeteries were being relocated to accomodate mining activities. In the 1950's, we saw a movement of cemeteries to accomodate dams and reservoirs. In the latter part of the 20th Century, we began to see them uprooted for highways and residential developments. At this rate, the historic cemeteries of the communities founded by our ancestors, similar to some of the now-gone towns and villages, will fade from the face of our historic landscape. My maternal grandmother's father had a sister, Julia Amelia CANNON. She was born on 28 Apr 1862 in Iowa City IA. Her family previously had been in IL. Julia Amelia died in Oakland CA on 31 Jul 1946. She's buried in Carson City NV (Lone Mountain Cemetery-Family Plot). On 14 Feb 1885 when Julia Amelia was 22, she married Wilson (Wils) (Wilse) BROUGHER, parents unknown, in Belmont, Nye county, NV. Info I have is Wilson was born on 7 Jul 1854 in Adams County, PA. He died in Oakland CA on 15 May 1922. He was a major force in the development of the mining industry around Tonapah NV. He later moved to Carson City NV and then to Oakland. If you're interested in more, I can provide CANNON materials but not much on Wils prior to his arrival in NV. There's some discussion of him on the Nye county, NV rootsweb page. Julia Amelia and Wilson had the following children: Ida Estelle (1886-1966) Irene A (1889-1912) Nellie (Nell) B (1896-1963) William Henry (1898-1953) I also have some contacts located in CA if you've got a connection. Apparently Wils' legacy lives on during yearly celebrations in Tonapah.
