Greetings, I am forwarding this message to my group called "Cemetery Resources." I hope you will take the time to learn about the problems the people in Indiana are having with "portable" cemeteries. Their state laws are enabling development to play checkers with their cemeteries by allowing them to move cemeteries almost at will. Please take the time to review the petition Lois Mauk has included. I will be having the members of our commission sign the petition and am planning a personal letter to the Indiana representative indicated on the petition. For those who don't know, California's laws provide that when cemeteries are relocated there must be an effort to notify any potential next of kin, either through personal correspondence or by publishing notice in the newspaper. Apparently Indiana does not. Many of the pioneers who rest in California's historic cemeteries are natives of Indiana. Just as we are trying to protect their final resting places, some good people in Indiana are trying to do the same for our pioneer's ancestors in their state. I encourage you all to collect signatures on a copy of this petition and let the representatives in Indiana know that the eyes and "monitors" of California are watching. This nation's historic cemeteries are jeopardized daily. Yesterday on CNN you may have seen the story of the historic cemetery that is being asked to relocated so they may extend the runway at O'Hare airport in Chicago. It's time to take a stand and tell our respective government officials that there is a reason they are called Final Resting Places. Thank you in advance for considering this request. Penal Code Sec. 504.3 was enacted, but merely took former Health and Safety Code Sec. 8101 and moved it to the Penal Code. The law has remained unchanged between the two. The main point that really needs to be driven home is that the damage to these IRREPLACEABLE historic monuments is that once the damage exceeds $2,500 (I believe), the crime becomes a penalty. You might want to check with the local sheriff as to this amount or if it is being investigated as a felony. Part of our problem in California as regards cemetery desecration (and that's what this is - vandalism be damned), is that the courts are unwilling to mete out the appropriate punishment. "It's a childish prank" we've heard. "Kids will be kids." Well, those childish "kids" are committing felonious acts and getting a slap on the wrist. Before too long, if this is allowed to continued unabated, uninvestigated, unprosecuted and unpunished, is that it will continue until the integrity of every historic cemetery in this state has become a victim. Thank you for your article. Please help put the word out that Californian's are sick of this. Most people say "cluck cluck, too bad" until it happens to them. THEN they want to see change. This is a crime that has the potential to effect everyone, since most of us do have family in one cemetery or another. Dear All, Today a wonderful man passed from us. John Bettencourt has spearheaded and led the effort to preserve the old Sacramento City Cemetery as part of a committee under the Sacramento County Historical Society. John has led tours, designed fund raising events and was a part of the effort to convince the City of Sacramento to erect fencing to inhibit vandalism. John loved the tour work at the cemetery and gave tours to school children and others over the years. He and the Old City Cemetery Committee have worked wonders with the cemetery. Their tours have been very well received and John was a large portion of the response received. I will miss him greatly and hope that all people who share our desires to preserve and protect our historic cemeteries and the heritage they represent will say a prayer with me tonight for John. Ironically, in their effort to "cut corners" the city saved itself money and supposedly the current developer is going to have to bear the burden for these relocations. Had the city done the job properly in the first place we wouldn't be watching excavators in old cemeteries only stopping when or if the next body is "seen." History does, indeed, repeat itself... Hello, I recently ran into the problem of locating information from the Stockton State Hospital Records. I contacted the California State Archives, which appears to have the records. I was told they were confidential patient records and could not be viewed by the public. The information I was seeking was relative to a man who died at the hospital. I was attempting to verify if he was buried at the hospital cemetery or if he was sent home for burial and now lies in an unmarked grave. I could not find this information out. I ultimately asked if the Archivist would support legislation enabling researchers to have access to these records after a specific, statutorial period of time, such as that which the federal census utilizes. He did not seem to oppose this idea but related he thought the legislators might have a difficult time with all the requests for more protections on privacy. Do we have enough support out there to push for legislation allowing access after 70 years, for instance? Hello, The Bill number is correct as AB 1368. I urge anyone interested in seeking preservation of our state's earliest cemeteries to review the bill's language and contact Assemblyman Anthony Pescetti and your own legislative representatives about this bill. It is a bill designed to review conditions and problems and to attempt to assist those who may be trying to preserve and restore these places of rest. Governor Davis vetoed this same language last year and his office again has advised he continues to oppose it. Yet it passed nearly unanimously in both houses last year. I do not believe Davis' vetoe reflected the desire of the people. We need to tell him so.
