It may, therefore, be proper to subdivide the question and consider, 1-The situation of those who, previous to the 11th February, 1777, adhered to the King of Great Britain. 2-The situation of those who, after that time, took the oath of allegiance, or joined the British, and have been attainted of high treason. 3-Of those who, after the 11th February, 1777, took the oath of allegiance to, or joined the British armies, and were NOT attainted of treason. 1.--With respect to those who, previous to Feb. 11th, 1777, made their election, and adhered to the British, I conceive there can be no doubt, they became British subjects, and could not afterwards become citizens of Pennsylvania, but by complying with the forms, etc., prescribed it the Acts for the naturalization of foreigners. This priciple seems to be settled by the case of the Commonwealth against Chapman, determined in the Supreme Court of Pennsylvania, in April, 1781. 2.--With regard to those who, after February, 1777, joined the British, and were attainted of treason, where the attainder has not been reversed or a pardon procured, they cannot be considered as restored to the rights of citizenship. The treaty of peace did not operate as a reversal of the attainder nor as a pardon, but only protects the persons from further prosecution or punishment. 3.--As to the third class, who, after the 11th. February, 1777, took the oath of allegiance to the King of Great Britain, or joined the British armies, and were not attainted, they cannot be considered as expatriated; though such acts might be deemed overt acts of treason, they must still be considered as citizens, and entitled to the rights of citizenship. Till attainder, their rights were not forfeited. The test laws have now no operation on the question, unless to show the sense of the Legislature in support of the above principle. By the eleventh section of the Act of 5th December, 1778, it is enacted that those who had taken the oath or affirmation of allegiance to the State, and afterwards to the King of Great Britain, should be incapable of election, etc., until they should take the oath therein prescribed by the Act of 13th March, 1789, all the test laws were repealed, and the oath of allegiance, etc., rendered unnecessary. So that those who took an oath of allegiance to the King of Great Britain, joined his banner, or committed any other treasonable act, are not disfranchised unless attainted. J. B.     3. My BUTCHER family lived for over 200 hundred years in the Wonersh, Shamley Green, Bramley area of Surrey England and just headed over the border into Sussex about 1700. But, there has been several BUTCHER families that have trailed upto Putney, Hackney, Wandsworth areas. Does this connect to anyone? They are William, Thomas & Alfred BUTCHER all children of John and Mary BUTCHER. Now, John and Mary pose another problem. John was born in 1795 in Wonersh, the illeg son of James BUTCHER & Sarah WOOLGAR. They married in 1801 and had another son in 1802, my problem is this, I can not find John & Mary's marriage. I have checked under the names of BUTCHER & WOOLGAR, and come up with zilch. According to the 1851 Census Mary was born in Artington, and low and behold I found a marriage of a Mary Stevens (born Artington) and John Woolgar in nearby Hascombe, I was hopeful, Hascombe had family connections back in the 1700s, But alas, this is NOT my family as they were having offspring in Hascombe at the same time as my line were producing in Wonersh. I can establish that John lived his life as a BUTCHER, and he did inherit from his father, although substancially less than his younger brother. Does anyone have the answer? Also, about the surname "Huffty" (see "Benjamin Huffty and Charles Huffty" in the first paragraph above). This is the surname of John Boutcher's daughter Mary's husband John Husty. It is a continuation of a project begun in Volume LIII (1993) and continued in Volume LIV (1994) of the Old York Road Historical Society Bulletin. It represents an attempt to fill the gap left by the destruction by fire in 1921 of the Federal Census for 1890. The rolls present a census of men between the ages of twenty-one and forty-five eligible for military service if the need for them were to arise. The rolls are preserved in the archives of the Montgomery County Historical Society in Norristown. The handwriting of the county registrar for the year 1890 is particularly difficult to decipher. Accordingly this list has been compared with the rolls for 1889 and 1891 to transcribe as accurately as possible the names and vital statistics for the men. Unfortunately, some indecipherable names appear only in 1890 and thus cannot be emended. These names are indicated by (?) directly after the name. The registrar also failed to record ages, professions, and marital status for some of the men. Where possible, this information has been abstracted from the two supplementary rolls and is indicated by inclusion in brackets < >. The registrar regularly lists the men with the first two initials or an abbreviated first name. Where these names can be identified by the listings in other years, this is indicated by parentheses within the name. The listing of trades and marital status in the three lists is remarkably consistent. However, the ages vary greatly from year to year especially as the candidate nears age forty-five. Variant ages from the 1889 record are given in parentheses if they seem significant. African-American citizens are indicated in the vocabulary of the day as "Colored." Source: Bulletin of Historical Society of Montgomery County, Vol. 3, page, 295-96 Chapter: "Colonial Land Tenure in Hatboro and Vicinity" [Note: Hatboro is an adjacent portion of Upper Moreland township.] About 25 acres of the Carrington purchase, at the corner of Pioneer and Davidsville roads, were apparently sold to one Daniel thompson soon after Riderpoke obtained possession (Montgomery Deed 7, 79), but his remaining land was kept intact until his death. It was then divided (Philadelphia Wills) S, 347) among his three daughters and their husbands: John and Rosannah Harner were given the home place, now estimated as 66 acres, and a 14-acre field at the north corner of BYBERRY and DAVISVILLE roads; John and Sophia Rhoads received the balance of the Garrison and Carrington tracts; while Henry and Elizabeth Bickley inherited the 57 acres formerly belonging to Randolph Morgan. The Harners sold their land to Richard Kimble in 1806 (Montgomery Deeds 24, 505), but the other families held their properties until after 1830. When the RICHARD MARPLE estate was broken up in 1756-7, the Court gave 22 acres to the oldest son Richard, 15 acres to a daughter SUSANNAH, wiffe of SAMUEL BUTCHER, another 15 acres to a younger son Northrup, and the remaining 8 1/2 acres, with the family residence, tod the youngest son DAVID. All of RICHARD's and Northrup's land and 5 1/2 acres of David's were were sold almost immediately to their neighbor Moses Vancourt, while SUSANNAH's 15 acres were bought by another neighbor, JOhn Jones. When Vancourt left the neighborhood, a year or two later, he sold 13 3/4 acres to Jones and the remainder to John Crosleyt (Pennsylvania Deeds I 6, 524 X 4, 17). The three acres remaining in young DAVID MARPLE's possession formed a long, narrow strip on the east side of York Road, including the former Peter Lycan cabin and lot and adjoining land lying on both sides dof the present EAST MORELAND AVENUE. In December 1757, MARPLE conveyed this property to Abraham Bond (Pennsylvania Deeds I 16, 184), a chairmaker, who operated a small chair-factory on the premises until his death in 1775. During his ownership, he replaced the log cabin with a substantial stone residence, which stood at the southeast corner of YORK ROAD and MORELAND AVENUE until recent years. After Bond's death, the property was sold to William Miller of Philadlephia (Pennsylvania I 16, 189), and by Miller's estate to Jacob Tomkins in 1779 (Montgomery Deeds 10, 309)." A map on page 268 shows the names of streets. Vertically, Byberry Road [1720] strretches from the south to the center of the intersection of York Road [1711] on the west side and Warminister Road [1761] on the east side. Byberry Road itself is on the Manor Line all the way to the end of the north in Hatboro (next to Horsham). DAVID MARPLE owned two patents, one on Manor Line [1741] and on Moreland Road [1758]. Pennypack Creek divides BYBERRY ROAD and YORK ROAD. On the west side of the Pennyopack Creek were the homes of ISAAC WALTON [1715] , JACOB WALTON [1763] JEREMIAH WALTON [1715], THOMAS WALTON [1763]. On the east side of the Creek was the home of Mary Keach ["ca. 1689"], Margaret Loofburrow [1740], John Crosley [1740], Thomas Lloyd [1738]. In the northeast intersection of York Road and BYBERRY ROAD on Warminister Road was the third home of DAVID MARPLE [1734]. JOHN BOUTCHER used to live somewhere on Byberry Road between Warminister Road (in the north) and Davidsville Road (in the south) on the east side of the Pennypack Creek in 1690s-1707. The Benjamin Boutcher family was married into the Walton family in Bucks County near the border of the Manor of Moreland Line in Montgomery County. Jean

Between the Pine Road and Byberry, Joseph Mitchell, Jonathan Comly, Richard Maple, Derrick Hewson, William Roberts, Albertson Walton, William Tilyer, Henry Comly, Nicholas Moore, Jr., and John Blackford."     2. [Note: Samuel Moore's father was a physician named Dr. Nicholas More, Esq. from London, England. I do not know whether he was connected to one of the most famous The surname was originally spelled as MORE. [I am not ascertained as to whether Dr. Nicholas More was connected with Sir Thomas More (1478-1535), a most famous humanist and writer ("Utopia") who was beheaded by King Henry VIII. His surname More evolved to Moore in Pennsylvania. The spelling for Manor of Moreland, Moretown, and Moreland Twp, which were named for Dr. More, also evolved to Manor of mOOreland, mOOretown, and mOOreland twp as the surname. The location of Manor of Moreland is in Montgomery County which is in the northeast corner of both Philadelphia County and Bucks County in Pennsylvania. Regards, Jean Boutcher

    2. Descendants of the Huguenot Simon Boucher of Claverack, New York. (He came to the Dutch Colony in 1658 from France.) The index of the book reads, "Boucher (see Baustscher, Poucher)". Both baptismal and marriage records showing four variants of spelling for Boucher were written by pastors and transcribed by Arthur C. M. Kelly [1970]. I suspect that the pastor or transcriber inadvertently wrote "P" because in my analysis, he also wrote "PLASS" for the original spelling: BLASS which was the surname of Philip Blass (you will see it below).
