James Burke (Burk) of Burke's Garden Does anyone have proof that the daughter-in-law named in the will of James Burke written November 4, 1752, Surrey Country, NC, was Mary Kendrick? Was her husband John Burke, son of James? Or, is she Mary Eliot Burke, wife of Captain Ben Burke, who was involved with the Tories in South Carolina and was killed at the shallow ford of the Yadkin? (Dorman, VA. v20 pg. 44) #2. Mary Burke John Kendrick, Sr. died ca. 1800-1801 intestate leaving Thomas Kendrick; John Kendrick, Jr.; John Burke and his wife Mary living in Barren Co. KY; William Allen and his wife Rachel; and, Elizabeth Kendrick, his (John Kendrick Sr.) wife and widow. (John Burke and Mary were still on the Tax List in Barren Co. KY in the 1840's.) The above information came from a lawfuit filed by William Allen and his wife Rachel v. Kendrick - o.s. 94; N. S. Bill, 2nd August 1805, Washington Co., VA, Library of VA Archives. >From the above information, I don't believe Mary Kendrick was the daughter-in-law of James Burke who wrote his will Nov. 4, 1782, Surrey Co. NC. #3. How I Descend from Mary Burke 1. I descend from the Mary mentioned in the Will of James Burke, Nov. 4, 1752, Surrey Co. NC, through her son Benjamin Burke. 2. Benjamin Burke died Sept. 23, 1828, in Wayne Co., KY. He is buried there in the Smith & Kidd Cemetery with his wife Elizabeth. She also died in Wayne Co. 3. Jonathon Burke was born August 28, 1797, Tazwell Co., VA. He died August 14, 1875, Scott County, TN. He married Nancy Cooper on March 31, 1820, in Wayne Co. KY. 4. John Granville Burke was born May 1828 in KY. He died sometime between the first of May and June 15, 1900, in Wayne Co. KY. He is buried in the Burke Cemetery in Wayne Co. KY. In 1862, he married Ann Blevins who was born in 1844 in Wayne Co. KY and died in 1933 in McCreary Co. KY. Ann is buried in the Boyatt Cemetery in Stearns, KY. 5. Henry H. Burke was born in May 6, 1881 in Wayne Co. KY and died May 5, 1949, in Pulaski Co. KY. He married Mima Ball on January 2, 1902 in Wayne Co. KY at the home of Mima's parents, John and Polly Ann Foust Ball. Mima Ball was born November 1881 in Wayne Co. KY and died October 28, 1956 in Boyle Co. KY. 6. Elmer D. Burke was born October 19, 1905, in Wayne Co. KY and died April 28, 1969 in Scott Co. TN. He married Tressa King on August 13, 1927 in Scott County, TN at the home of Tressa's parents, William O. and Nancy Thomas King. Tressa King was born on April 21, 1907 and died October 27, 1993. Elmer and Tressa are buried in the Boyatt Cemetery in Stearns, KY. 7. Elmer and Tressa King Burke are my parents.
