Revenue Stamp $0.50 canceled Know all men by these presents that I the undersigned John Burch of the County of Platte in the State of Missouri for and in consideration of the sum of Seventy five Dollars to me in hand paid by Benjamin Jones of the County of Platte in the State of Missouri have granted bargained and sold and by these presents do grant bargain and sell unto the said Benjamin Jones his heirs and assigns the following described real Estate situate in the County of Platte in the Stae of Missouri; that is to say: Lot Number (311) three hundred and eleven in Block Number (23) Twenty Three in the City of Weston known and described as such on the plat of said City to have and to hold the real estate herein conveyed with all the rights, privileges and appertainances thereto belonging or in anywise appertaining unto said Benjamin Jones his heirs and assigns forever wpon this express condition Wheras the said John Burch on the 19th day of March A.D. 1870 made and executed and delivered to the said Benjamin Jones his certain Note described as follows to -wit: $75.00 Weston Mo March 19th 1870. Twelve months after date I promise to pay Benjamin Jones oor order Seventy five Dollars for value received with 10 percent interest per annum thereon from date and if the interest thereon be not promptly paid annually or when due the same shall when due be added to and become a part of the principal and bear interest at the same rate. Yocum Now if the said John Burch his executor or administrator shall pay the sum of money specified in said Note and all the interest that may be due thereon, according to the tenor and effect thereof, then this deed shall be void. But if the said Note shall not be well and truly paid when the same become due and payable according to the tenor and effect thereof, then this deed shall remain in force: and the said Benjamin Jones or his legal representative may proceed to sell the property herein before described, or any part thereof at public vendue to the highest bidder at the Court House door in the City of Weston County of Platte and State of Missouri first giving Thirty days public notice of the time terms and place of said sale and of the property to be sold by Publication in Some Newspaper published in Platte County and upon such sale and the payment of the purchase money shall execute and deliver a Deed in fee simple of the property sold to the purchaser or purchasers thereof; and any statement - of fact - or recital by the said Benjamin Jones or his legal representative in such conveyance in relation to the advertisement, sale receipt of the purchase money, or execution of such conveyance shall be received as prima facie evidence of the truth thereof and the said Benjamin Jones or his legal representative shall with the proceeds ot the sale aforesaid pay first, the expenses of this trust and next whatever may be in arrears and unpaid on said Note whether of principal or interest and the balance if any shall be paid over to the said John Burch or his legal representative.
