Derek Tripp Flatford Mill Suffolk I believe a declarartion can be sought after 7 years, but there is no obligation to do so. Clearly, for a second marriage to be legal, a missing former spouse should have been declared dead but then if those around either didn't know or were happy to turn a blind eye, it may not have been done.
