    3. WILL OF WILLIAM BRISBAN, written 24 Oct 1836, proven 28 Dec 1836 [Copied from a photocopy of the original given to me by Muriel Brisbin Morrison] In the Name of God Amen. I William Brisben of Hempfield Township Westmoreland County. __ being rather weak in body but of sound and ____ ____ memory Do make this my last will & Testament. First of all I commit my soul into the hands of my Creator who gave it and my body to the Earth, to be intered in the burial ground of W. Dick's Church at the descretion of my executors herein after named. And as to the Worldly Estate with which it hath pleased God bless me - I dispose of it as follows - 1st - To my beloved wife Jennet should she survive me I will bequeath the oldest of the two mares - her choice of the two cows - six sheep, One Bedstead Bed ___ing, and any part of the Household Kitchen furniture she may choose, and all the money I may have on hand at my decease to be disposed of by her as she may think best. 2.. To my daughter Jane McDowell, wife of John McDowell, I will & bequeath fifty dollars - and direct my Executor to give up to said John McDowell a Note Dated 12 March 1819 for $50. which I paid for him & ____ the note from John Kuhns which with former advancements to them shall be in f___ of any interest or claim they may have in my real or personal estate. 3. To my Grand Daughter Sarah Wasson, daughter of my son James, Decd - I give & bequeath five dollars. 4. To my daughter Rebecca Blackburn wife of Jospeh Blackburn I give & bequeath the sum of One hundred Dollars as her full share & interest in my whole Estate. 5. To my Daughter Peggy Loughery, wife of John Loughery, I give & bequeath the sum of Ten dollars - and to her Son William Laughery and to the heirs of his body begotton for__ in fee simple I will & bequeath Ten Acres of land to be taken off the South end of that part of my farm Surveyed and laid off by Joesph Stoksly intended for John McDowell a number of years ago and containing 100 acres & 25 perches - the said Ten Acres will adjoin Harry Heanor. To be laid off the said 100 acres ___ ____ a ___ by my Executor herein after named. My said Daughter Peggy to live on it if she may think proper during her natural life. 6. To my daughter Jennet: wife of Robert Mitchell, I give and bequeath the sum of one hundred dollars as her just interest & share in my whole Estate. 7. To my Son William Brisbine and to his heirs & assigns forever in fee simple. I give and bequeath Ninety Acres & 25 perches of land off the East side of my farm adjoining Long & Fulton being the ___ of the 100 acres & 25 perches mentioned in the 5th bequest above ) as his just share & interest in my whole Estate. 8. To my Son John Brisbine and to his heirs and assigns forever in fee Simple. I give and bequeath One hundred and fifty acres of the land I now possess in the Town __ & County afornamed adjoining Jacob Donovan, Adam Horn, Tobias Shoemaker, & Adam Long - and the said John Brisban is to pay the foregoing Legacees ___ ___ to within one year after my decease and also to furnish his Mother, should she survive me with a comfortable room, Fire, & provisions during her natural life. 9th To my Grand Son William, son of John and to his heirs and assigns forever in fee Simple. I will and d___ all the rest ___ of my land whereon I now live supposed to be between 30 & 40 acres - I also give him a young three year old mare, and a new saddle & bridle to be paid for out of proceeds of the sale by ___ of any of my moveable property, and I also give him my Rifle, gun powder horn & shot pouch. 10. It is my will & desire that any personal property that may be on hand at my decease, & not taken by my wife, be sold at public vendue - and the proceeds of sale applied to the payment of my funeral expenses & just debts - and the balance, if any, to be my son John's to enable him to pay off the foregoing legasees. 11. It is also my will and desire, _ __ the Coal Pit now opened on my farm by the f____ ___ will be in my son Johns part. That my son William and my son in law John Laughery as long as they respectively occupy the portions of land d___ to them have the privilige of digging ___ any coal from said pit, they may want for their own home use, but for no other purpose. 12. And lastly I nominate and appoint my son John Brisban & James B Ohon Exeecuators of this my last will & Testament and hereby I revoke and annull all former wills or bequests. In Witness whereof I have hereunto set my hand and Seal this twenty fourth day of October - in the year of our Lord one thousand eight hundred thirty-six. It is my desire that the lines of the portions of land ___ to my son Wm & my Grnad Son Wm Laughery be laid off under the direction of my Executors above named - by a straight line from Adam Longs land to Philip Saness[?] line.
