FYI 09:09 PM ET 12/29/99 Ore. Adoption Records Access Upheld By CHARLES E. BEGGS= Associated Press Writer= SALEM, Ore. (AP) _ An Oregon appeals court on Wednesday unanimously upheld the nation's first voter-passed law giving adopted people access to their birth records, and the state began processing their applications. A three-judge panel of the state Court of Appeals said Wednesday that mothers who put their children up for adoption have no constitutional guarantee of privacy, despite promises they received that their identities would be protected. Opponents of the law had argued that it would subject birth mothers to harassment by children they gave up years ago, and they asked the appeals court to reconsider its ruling. They could also appeal to the Oregon Supreme Court. The appeals court also lifted an injunction barring the state Health Division from releasing birth documents. As of Wednesday, 1,468 Oregonians had applied to obtain their birth certificates, and the first certificates could be mailed out by the end of next week, said Edward Johnson, registrar for vital records at the state Health Division. If another injunction is granted, the process would stop in place, he said. ``This is wonderful news for all of the people out there who have had one wall after another put in front of them all their lives,'' said Helen Hill, an adoptee. The National Council for Adoption said the ruling is a betrayal of birth mothers who gave up their children for adoption with the understanding they would remain anonymous. ``The state of Oregon is saying to all of the people who were promised privacy in the past, `We were lying to you,''' said Bill Pierce, spokesman for the Washington, D.C.-based group. The law passed with 57 percent of the vote in November 1998 but never took effect because of a lawsuit by several anonymous birth mothers. A trial judge upheld the law in July, but the order preventing release of records remained in effect during the appeal. ``At no time in Oregon's history have the adoption laws required the consent of, or even notice to, a birth mother on the opening of adoption records or sealed birth certificates,'' the appeals court said in an opinion written by Judge Paul De Muniz. The case has been watched by adoption advocates nationally. In September, the Tennessee Supreme Court upheld a 1996 state law giving adoptees access to their records. Just three other states _ Alaska, Kansas and Delaware _ have opened adoption records. The Oregon law allows adoptees 21 or older to obtain their original birth certificates, which often contain birth parents' names. A 33-year-old woman who does not want to be contacted by the daughter she gave up for adoption seven years ago lamented Wednesday's ruling. ``It's open season on birth mothers. Oregon is saying, `Go find your birth mother. Go hunt her down,''' said the woman, who spoke on condition of anonymity and was not part of the lawsuit. ``If somebody were to show up at the door, and one of my other children were confronted with this, it would be traumatic.'' But Hill said birth mothers are still in control. ``If she gets a phone call or a letter, she can still say, `I don't want to see you,''' Hill said. Added Barry Price, a 55-year-old retired machinist: ``Part of my background is missing. I need to fill in the blanks. I'm not looking for another family. I just want to know who I am.'' To date my database is closing in on 13,000 descendants of Charles Bredlove and Mary Parr. I should reach this goal after I input the newest generations of Elizabeth Breedlove and John Wilkerson. This Elizabeth, born c1750, is the earliest Breedlove female that I have traced all the way up to date with present day Wilkerson's living in Texas. 13,000 was the goal I am aimed for to be included on the CD to be published, so now I am slowly getting all of the sources in the right format so they will be included. Had hoped to add some of the unconnected lines into the known line and that hasn't happened, though I have found evidence of the Thomas Breedlove of Ross Co., Ohio in Virginia in 1810. With my hard drive crash earlier this year and the loss of my email sent folder last week, and my memory starting to slip, I may not have replied to some messages over the past few months. If I owe anyone a reply, please let me know, and give me some hint as to the subject matter. My household has been in turmoil since July and now I have a new litter of boxer pups with another litter due in 4 weeks. Have been out of work for three years now and my savings are getting low so I must find a job after the 1st of the year and I will not be able to work at this genealogy 10-15 hours a day like I have been. Jobs in my field are extremely low right now but have started to pick up with the rise in the price of oil. Had one offer to go to Alaska which I am debating since I can clear enough in the first 3 month assignment to live on for over a year. Will be off to Colorado Springs for Christmas with all of my family so here's wishing all of you a Merry Christmas and a Happy New Year. Please, no replies as I won't be back on line again until I get back, though I may check the internet up in Colorado when I set up some more freewwweb accounts for my family there. Best Wishes, Tom King

The Charlotte County VA, 1790 Census also has a John Breedlove identified. John Has 8 members in his family. I assume John, his wife and six children. In addition there are 8 Afro-Americans noted. Most likely John was related to James. Any one have a clue? The census records do not show John as residing in Charlotte County in 1782, 83, nor in 1785 (could have been missed). Does any one else have a record of John being in the Charlotte County VA area after 1790 or can we begin to look in NC and GA? Also do we know the names of John's wife and children? I have to admit this is very interesting and wish to thank each and every one of you fore the spirited exchange. John Sims
Did John Page and Elizabeth have any children together? If so, Can anyone tell me who they were? I have a PAGE line, and the names Sina , Elizabeth, John, are brother and sisters in my PAGE family. I know these people are not them, However I'm refering to naming paterns and they very well may be descendants. Suzie Breedlove

After John Page died before 1788, Elizabeth married 3rd William Sammon/s. I only noted the Sammon marriage in my message to reflect those named in the lawsuit. > Sina was apparently married to a John Wilkerson by 1773. Sina was still single when mentioned in Robert's will and the 1788 deed, or she would have been named as Sina Page or Wilkinson and not as Breedlove. Have been tracing some of Elizabeth's Breedlove Wilkerson descendants here in Texas lately. Tom King
Tom, reference your, "This just enumerates the only known children of James Breedlove (who I believe is the son of James & Lucrecy Breedlove) whose wife was Kindness." I would appreciate your proof or justification for James and Kindness being the parents of Elizabeth, Sina, and Kindness in Lunenburg Co, VA. >From 1751 to 1791, I find no James and Kindness mentioned together. I do find James and Mary mentioned together at least five times in legal records. Of most interest is Lunenburg Co, VA Deed Book 3, p.364: FULL QUOTE: Sep 1, 1773 from James Breedlove of the Parish of Cornwall & C, to John Wilkerson of same, for the natural love which he has for the said John Wilkerson (who has married one of the daughters of the said James Breedlove) and also 5 shillings, a certain tract of land in C bounded by Rivers. Signed - James (B his mark) Breadlove. Wit - John Sammon, William Sammon, John Pettus. Mary, the wife of James Breedlove, relinquished her right of dower. Recorded Nov 1, 1773. UNQUOTE ALSO, from Lunenburg Co Deeds, On Oct 9, 1788 Wm Stembridge of Charlotte Co to John Rivers for 100 acres bounded by John Rivers, John Page, deceased, Joshua Johnson, Peter Ward, Siney Breedlove, John Wilkinson, deceased. Sina was apparently married to a John Wilkerson by 1773. James Breedlove sold land to Sine Breedlove of Charlotte Co, Va on Apr 11, 1787, implying John was deceased. Sina Breedlove married Stephen Shelton on Jun 06, 1792. I think this changes things a bit. Bill Breedlove
I think we need to congratulate and thank Marilyn Owen for her recent work at the Salt Lake City Family History Center. Hope Perry Breedlove on Page 16 of his book referenced a "Charlotte County Court Order Package #10, p.111 of 1715." Marilyn was succesful in finding a "Court Order Book 10, p.111," BUT DATED 1795 This is a "find" as far as I am concerned, and I think this becomes a very important document for several reasons. ONE. This appears to be correcting an error of Hope's reference to the date of "1715", although Hope does refer to a "Charlotte Co, VA 1795 Court Record" further down on Page 16 of his book. . (Charlotte Co, VA was formed from Lunenburg Co, VA in 1764) TWO. Hope continues his discussion of "Kindness (Breedlove?) Shorter", the Kindness confusion in general, and a possible connection to a James Breedlove (wife Mary) on pp 16-17. Marilyn's document dated Nov 03, 1795 mentions TWO Kindnesses in the same legal action. Kindness Breedlove, deceased and Kindness (Breedlove) Stembridge, one of the plaintiffs. THREE. The James Breedlove, deceased, apparently died about 1791 after which date he does not show up in tax records. A 1797 land record also refers to him along with his children and mentions him as deceased. Robert Breedlove died in 1792. The filling against the estate of Robert Breedlove by James Shorter, "son and heir of Kindness Breedlove", and by Elizabeth (Breedlove) Sammons, Sina (Breedlove) Shelton, and Kindness (Breedlove) Stembridge, daughters of James (wife Mary) Breedlove, deceased, is a strong suggestion that Kindness (Breedlove) Shorter, James, and Robert were siblings. FOUR. Other documents link Robert Breedlove and Kindness Shorter. They are both witness to a John Smithson will dated Apr 06, 1760 in Lunenburg Co, VA Will Bk 1, p.336. Lunenburg Co, Va Order Bk 3, p. 189 names Kindness Breedlove, "relict of John Shorter." Order Bk 2 1/2-B. p. 194 names James Shorter, "orphan of John Shorter". James and Robert Breedlove are associated in Lunenburg Co records 1751-1791. Robert refers to Sina as his "niece Sine Breedlove" in his will of Dec 22, 1791. I think this is powerfull stuff. This just enumerates the only known children of James Breedlove (who I believe is the son of James & Lucrecy Breedlove) whose wife was Kindness. She had been previously married to John Shorter who died in 1758 in Lunenburg Co., VA, with one son James Shorter by that marriage. James and Kindness had the three daughters, Elizabeth who married William Sammons, Sina who married Stephen Shelton, and Kindness who married William Stembridge. Why the action against Robert Breedlove's estate is unknown but this Robert is assumed to be the son of James and Lucrecy Breedlove, and therefore a brother of James who married Kindness. This then would be the heirs of one brother suing the estate of another brother. Thomas and John Pettus (from another of my lines) were said to be excellent litigators so there must have been good cause that their motion for dismissal was denied and the action set for full hearing on the merits.
