Beaty deceased, who was a private in Captain [ ? ] company D, 2nd Regiment of East Tenn Vol; that my maiden name was Zilpha Holbert; that I was lawfully married to said deceased at my father's house in the County of Fentress, State of Tennessee by John Huddleston; that I have by said marriage the following children, whose ages and date of birth are correctly set forth to wit: James G. Beaty, born August 26, 1856 Margaret A. Beaty, born August 26, 1858 Isaac S. Beaty, born June 20, 1860 Malinda J. Beaty, born March 3, 1862 That I have made repeated and diligent efforts to procure a copy of the record of my marriage, but have been unable to do so, because of the destruction of the records of the clerk's office during the State war, that I cannot obtain the affidavit of the party who performed the marriage ceremony because he has been deceased for many years, that the ages of her children was given wrong in her original application if not given as above that my said husband died on the _____ day of February A.D. 1862, that I lived with deceased from the date of my marriage up to the date of his death, and that I file herewith the best evidence of my marriage that I can obtain. And also at the same time personally appeared Nathaniel Holbert and Joel Holbert, to me known as respectable, credible persons, who, being by me duly sworn, do severally say, that they have known the claimant, Zilpha Beaty and her deceased husband, for twenty years; * and that they were present and saw claimant and said deceased, married as above stated by claimant; that deceased always treated and acknowledged claimant as his lawful wife; that they lived and cohabited together as such, and were so received in society, and were so regarded by their acquaintances; that they never heard of the fact of their marriage disputed; that their general reputation in the neighborhood was that of husband and wife; that they have often heard deceased in his lifetime speak of claimant as his wife. That the statement of claimant concerning her children, (the issue of said marriage) they know to be correct; that they are satisfied that claimant has made diligent efforts to procure record evidence of her marriage, and has been unable so to do for the reason stated by her. Further, they state that they are in no way interested, directly or indirectly, in the prosecution of any claim, nor in the benefits which the claimant may derive from any claim in which this affidavit may be used in any manner whatever. DEATH: Surgeon General reports him as having died Feb 17th, 1862, on the march from Somerset, KY to Flat Lick, KY at McHerge Mills of measles. MARRIAGE: John G. Beaty and Zilpha Holbert were married Oct. 7th, 1855, by John Huddleston, a Justice of the Peace, proved by credible eye witnesses.
