In 1853, Joseph was living in DeKalb Co., Alabama and aged 37 and states that he was a Corporal under Captain Ellis in a Regiment commanded by Augustus Stokes in the Cherokee removal in 1838. COPIED Excerpts: William Dabney is the guardian of Zilpha Beaty, wife of George Beaty and daughter of Abeazor or Aby Beaty who is 17 years old. State of Tennessee, Fentress County. I certify that I live about one mile and a half from George Beaty & his wife Zilphy that I have known them ever since they were small children that said Zelphy was the daughter of Aley Beaty who was a soldier in the war of 1812. I further certify that I have been intimately acquainted with Aley Beaty for thirty years before his death, that he died in Fentress County Tennessee about six or so years ago?? nine miles from me. That his wife Viney(?) Beaty deceased on Stone(?) River about 14 years ago. That he never married after the death of said Viney. That I well know all his children that they was all over twenty years of age on the 28th day of September 1850 except Zilphy Beaty who married George Beaty & she is now just turned into her 17th year of age. I married her & said George last may was a year ago. Given under my hand this 6th day of August 1853. Joshua Owen Justice of the Peace. State of Kentucky Clinton County On this 5th day of Oct. 1853, personally appeared before me J. C. Southerland, J. P>, in and for the county & State aforesaid W. J. Dabney a resident citizen of the town of Albany in Clinton County, Kentucky, who is the guardian of Zilpha Beaty, wife of George Beaty, she being under the age of sixteen years on the 28th Sept. 1850. Said Dabney being a man of good character his statements being entitled to full credit and after being duly sworn for that purpose on his oath makes the following declaration in order to obtain bounty land for the services of Aby alias Eliazer Beaty, deceased. Declarant states that said Beaty was a soldier in the war of 1812 as he is informed and believes for the term of six months. From Rutherford County, Tennessee under Capt. Robert Carson as he understands, and was honorably discharged for said tour of duty. And afterwards moved to Fentress County Tennessee and lived there many years and died in said county some five or six years ago. That he left no widow that his last wife died previous to his leaving that part of Tennessee from which he went into service-that said Beaty was twice married -That he left some children by his first wife who are all over the age of 21 years as declarant understands & believes-That Zilpha Beaty his ward is the only child of said Beaty's last wife and only child who was under the age of 16 years on the 28 Sept. 1850. That said Zilpha Beaty lives in Fentress County Tennessee adjoining Clinton County Kentucky. That said Zilpha & her husband George Beaty have authorized and requested him to apply for said claim on her behalf.. State of Kentucky, Clinton County, on this the 26th day of September 1853 personally appeared before me John Noland a Justice of the Peace in and for the said county & State aforesaid Allen Beaty a resident citizen of the County of Fentress and State of Tennessee adjoining Clinton County, Kentucky..makes the following affidavit to wit that his Uncle Aley or Eleazor Beaty as he witnesses has always understood served a six months tour in the service of the United States in the war of 1812 from Rutherford County, Tennessee.& moved to Fentress County Tennessee and there died about 5 or 6 years past that his wife died before him that he left no widow but left several children all of whom were over the age of 16 years at the 28th of September 1853 except Zelphy Beaty now the wife of one George Beaty. Witness states that said soldier died in about 3 miles of affiants but the exact time he has now forgotten, that his said uncle lived he thinks in a part of Rutherford that is now included in Cannon County. USA, 1790; COPIED {L2?, sounds like the father of Alexander and Andrew was "Billy Beaty"?} State of Kentucky, Clinton County On this the 7th day of December 1857 personally appeared before me Abner Beaty, a Justice of the Peace in and for the county aforesaid Eleanor Meek widow of James Meek aged --- years she lives 2 miles from me. She is a pensioner(??) and entitled to full credit and being first duly sworn by me on her oath states that she helped to fix clothes for Alexander Beaty when he went as a volunteer Company some time about 1794 or there abouts. That she lived at the house of Billy Beaty in Sullivan County Tennessee at the time said Alexander volunteered & had from a small child, and continued to live there until she, affiant, was married. That she was present at the time said Catherine Beaty and Alexander was married that her name was Catherine Travis, that they was married by Crockett, as she now thinks affiant is a pensioner(??) that she lives in sight of said Catherine and has for about 40 years that Alexander has been dead about 6 years that he Beaty was gone in service for three months that she was raised with said Beaty & has lived within sight as before stated sworn to and subscribed this 7th day of December 1857 before me. Elenor Meek (her mark) State of Kentucky, Clinton County On this the 7th day of December 1857 personally appeared before me Abner Beaty, a Justice of the Peace in and for the county aforesaid Catherine Beaty widow of Alexander Beaty deceased. She is my mother and said Alexander was my father. She is entitled to full credit and being first duly sworn by me on her oath makes the following Declaration To wit: that her name before she was married was Catherine Travis that she was married to said Beaty when she was in the 21st year of her age that she was married by __- that she is now 77 years of age that he said husband was a soldier in the war of 1794. That she and her said husband moved from Sullivan County East Tennessee to where she now lives & where she & her said husband lived up to the day of his death which took place about 6 or 7 years last March 1857. She states that her said husband was a volunteer under Captain Andrew Beaty for three months before she & him was married. She states that her said husband lived in Sullivan County Tennessee at the time he volunteered & served out his tour of duty and was honorably discharged. She states that Captain Andy Beaty under who her said husband served for many years lived in sight of declarant in Clinton County, Kentucky..(there is more that is a repeat of Eleanor Meek's testimony) Joseph Harris of Clinton County, Kentucky states "said Eleanor was raised by the father of said Alexander Beaty." Mil., 1793; COPIED Some Excerpts: On Jan. 21, 1851 Alexander Beaty, aged 81 years, a resident of Clinton County, Kentucky states "he was a private in the company commanded by Captain Andrew Beaty in the regiment commanded by Colonel John Scott of Mountain men, in the war between the United States and the Cherokee Indians in the year 1794." His discharge papers were burnt when his house was burnt in 1806. April 9, 1853 Eleanor Meek says "she was living at the house of Alexander Beaty in Sullivan County Tennessee when he went as a soldier against the Indians, a volunteer for the time of three months; as she now thinks under his brother Captain Andy Beaty that she helped to fix him off and remained there with his father and mother until his term of service was out and returned home and continued to live there for some years after that, she then married to James Meek and lived some years on said Beaty's farm. That said Beaty then married Catherine Travis at the house of said Alexander Beaty where his father then lived that she & her said husband James Meek was at the wedding that as well as she remembered now Squire Crockett married them." April 9, 1853, Fentress County Tennessee, Catherine Beaty, 73 years old, "living on the edge of Kentucky" states "she was married in Sullivan County, East Tennessee by Squire Andy Crockett 51 years and six months in the month of May that she and her said husband moved from Sullivan County to Cumberland County by where they lived together to the time of his death which took place on the 3rd day of March 1851 in Clinton County."
