Dec'd On the Petition of John Hare, setting forth, that he was married to Mary daughter of Thomas Beatty Esq. Dec'd-that his wife died some years since, leaving children, viz. James, Eliza, Thomas Beatty, John Steel, Maria & Mary Hare. That said children are now entitled in right of their mother to a portion of the estate of said Thomas Beatty, esq., now dec'd, their grandfather. Therefore praying the court to appoint a guardian for John, Maria & Mary Hare who are under 14 years & the court appoint John Hare & order that he give security in $2000. [James, Eliza & Thomas Hare, all over the age of 14 are allowed to choose their own guardian and they choose John Hare.] Fayette County Orphans Court Book 3, page 275 Beatty, Thomas Esq. Dec'd On the Petition of John Beatty, setting forth that he is a minor son over the age of 14 years-that his father died some short time ago leaving a considerable real & personal estate-that he has no guardian. Therefore prays the court to be permitted to choose one. Petitioner chooses Adolph Everhart who is approved by the court & appointed guardian of the said John Beatty. Bond with security filed. Fayette County Orphans Court Book 3, page 283 Beatty, Thomas Esq. Dec'd On the Petition of George Beatty of Springhill Township in the county of Fayette, setting forth that his father, Thomas Beatty, Esq. died intestate some time in May last, leaving a widow, and nine children living, to wit, James-Eliza, intermarried with Jacob Dillinger-Margaret, intermarried with Albert Dillinger-- Thomas-Sarah, intermarried with Adolphus Eberhart-William, George, Nancy, intermarried with James Biffle & John and leaving also six grandchildren, the heirs & legal representatives of Mary, intermarried with John Hare & now deceased-to wit, James, Eliza, Thomas Beatty Hare & Maria & Mary [only 5 listed] And further stating that his said father died possessed of a considerable real estate consisting of a tract of land situate & lying in Springhill township aforesaid, adjoining lands of Michael Crow, William Morris & others, containing about two hundred and fifty acres-and therefore praying the court to award a writ of partition & valuation of the said tract of land, to part & divide the same to & amongst the heirs & legal representatives of the said Thomas Beatty Esq. deceased; if the same cannot be done, then to value & appraise the same according to law. Whereupon the court award an Inquest accordingly-- writ issued Sept. 28, 1840. December 11, 1840 Inquisition returned by the Sheriff & Inquisition confirmed & Rule upon the heirs to come in & choose &c. December 18th 1840, on motion of Mr. Flenniken the confirmation issues ?? until next Monday week-copy issued. And now to wit December 28th 1840 the court order that the inquisition be set aside & award a new inquest, writ of January 5, 1841. And now, March 29th 1841, the Sheriff returns his inquisition in pursuance of the writ last awarded-taken & indented at the house, late of Thomas Beatty, Esq., dec'd in Springhill Township, on the 10th day of February 1841 by the oaths & affirmation of Alex'r Brownfield, Daniel Stentz, Phileman W. Morgan, Jacob Gans, James M. Shepherd, Rich'd Brown, George Poundstone, Rich'd Poundstone, Isaac Phillips, Henry W. Core & Stephen Wood, twelve good & lawful men, citizens of said county & the vicinage, who being duly sworn & affirmed respectively to inquire whether or not certain lands of said deceased, described in a writ of the Orphans Court of said county, annexed. could be parted & divided to and among the widow and children of said deceased, without prejudice to & spoiling the whole, and further whether the said real estate will accommodate more than one, and, if so, how many of the children of said deceased, or, if such partition cannot be made, then to value the whole or several parts of said land-do say that said land cannot be parted & divided so as to accommodate all of said children & widow without prejudice to or spoiling the whole, but that the said land and appurtenances can be so parted and divided as to accommodate two of said children-such partition & division the said request have made and herewith return annexed, a plot or plots of said division, or purports that part marked No 1, containing one hundred & nineteen acres, one rood & fifteen perches, strict measure, they value at the sum of Three thousand six hundred and ninety nine dollars & 66 cents. And that part marked No. 2, containing one hundred and twenty eight acres, two roods & eighteen perches, strict measure, they value at the sum of Two thousand, nine hundred and fifty eight dollars and nine cents. And the court thereupon, confirm the said return and inquisition and grant a rule upon the heirs of said Thomas Beatty, Esq., Dec'd. to appear in court on the first Monday of June next to choose or refuse the said real estate at the valuation aforesaid. Copy of rule issued. And now, to wit, the 7th day of June 1841, George Beatty, assignee of James Beatty, eldest son & heir at law of Thomas Beatty, Esq., dec'd appears in Court & elects to take the first part No. one in the diagram. And it is considered & adjudged by the court here that the said George Beatty shall & may upon paying or having to be paid unto the other children & representatives of the said dec'd their equal & proportional parts of & in the valuation thereof within twelve months from the date, hold & enjoy the real estate of the said dec'd valued as aforesaid, to him, his heirs & assigns forever, as fully & ?? as his said father had held the same in his lifetime agreeably to the acts of general assembly in such case made & provided. And the said George Beatty offering to the court here William Morris & John L. Wood as securities for the payment of the shares & dividends, aforesaid, the court here do approve of & accept the said sureties. And the said George Beatty, William Morris & John L. Wood acknowledge themselves jointly & severally to owe the Commonwealth of Pennsylvania the sum of Six Thousand dollars, to be levied of their collective goods & chattels, lands & tenements upon the condition that if the said George Beatty shall & do within twelve months from this time pay or cause to be paid unto the widow & other children of Thomas Beatty, Esq., dec'd their several respective shares of & in the valuation of that part of the real estate of said deceased adjudged to him then these ?? to be void, otherwise valid.
