This will shows that the estate of Nancy Beatty Buffle's father, Thomas Beatty, who died in 1840 in Fayette County, Pennsylvania, had not been completely settled by 1881. Mary Beatty, widow of Thomas Beatty, lived until 1856, according to the will of Nancy Buffle. There is an item indexed in the Orphans Court Dockets for a Mary Beatty, partition, Book 14, page 151, dated 1886. This could possibly be a partition land sale for the widow's share of Thomas Beatty's land. Book 14 of the Orphans Court Docket is not on microfilm at the PA State Archives. George Beatty, who is still residing on his father's land in 1881, did not leave a will in Fayette County. I believe he may have died before 1889, when Nancy Beatty of Nicholson Township sells land to Charles T. Swearengen [Sept. 3, 1889, Deed Book 89, page 175, this book is not available at the PA State Archives]. It is possible that other probate files exist in Fayette County that show a settlement of Thomas Beatty's estate as well as the estate of his widow, Mary Beatty. --Laurel Baty, L252 Fayette County Pennsylvania Will Book 5, page 301 Will of Nancy Buffle, dec. I Nancy Buffle of Nicholson township in the County of Fayette and State of Pennsylvania, being of sound mind, memory and understanding, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time here before made. First I direct that my body be decently interred in the Cemetery at the Old Frame Church according to rites and ceremonies of the Presbyterian Church and that my funeral be conducted in a manner corresponding with my estate and situation in life. As to such estate as it hath pleased God to entrust me with, I dispose of the same as follows, viz., I give, devise and bequeath to David Gans, in consideration of his many acts of kindness to me, my house and lot where I now reside, described as follows, viz: situate in Nicholson township, Fayette County, Pennsylvania at the junction of Mason town, New Geneva and Smithfield roads, bounded on the East and north by lands of David Gans, on the west by road leading from Masontown to Cerous Williams, on the South by road leading from New Geneva to Smithfield containing one fourth of an acre more or less, with the appurtenances to have and to hold the said messnage or parcel of land described to him, his heirs and assigns forever. I give and bequeath to my beloved Pastor, Rev. H. O. Rosburough one hundred dollars in money to be paid to him by my executors herein named, as soon after my demise as can be consistently with a proper settlement of all my debts. I give and bequeath to Lydia Cagey my sewing machine. I give and bequeath to Louisa Miller my corner cupboard. I give and bequeath to Melinda Gans my clock and bureau. I give and bequeath to Lucy Burwell [my] rocking chair. I give and bequeath to Jane Eberhart my dining table. I give and bequeath to Ann Lucetta Franks my large family Bible. I give and bequeath to Jesse B. Fast all my Windsor chairs. I give and bequeath to the Old Frame branch of the Presbyterian Church of which I am a member all the following items and sums, viz.: Seven hundred dollars of the money remaining in the farm, sold by the Administrator of my husband being on the waters of Jacobs Creek in Nicholson township, Fayette county, Pennsylvania, adjoining lands of Mary Nicholson, Henry Franks, Jacob Deffenbaugh and others, now owned by P. H. Franks and Jacob Fast, it being money received as part of my share of my father's estate, and paid on the purchase of said farm. The balance of four hundred and seventy seven dollars remaining in the above described farm or so much thereof as shall not be required to reimburse John G. Gans Committee of Agnes Buffle for money expended by him for use of his ward, the same being due me for the care and maintenance of my daughter Agnes Buffle. The sum of one hundred dollars due me and remaining in my father's farm now occupied by George Beatty in Nicholson township, Fayette County, Pennsylvania and bounded by lands of Jacob Crow, James Woolsey, James T. Dils and others, with interest on the said one hundred dollars from the date of the death of my mother which occurred in the year 1856. Also the sum of sixty dollars due me and remaining in the other portion of my fathers real estate, being in the farm now owned and occupied by James Woolsey in Nicholson township, Fayette County and State of Pennsylvania and bounded by lands of Jacob Crow, Oliver Eberhart, the farm occupied by George Beaty [sic] & others and whatever other property I may have at the time of my decease whether personal or mixed, including all money on hand or due me from any other source not herein named to be paid to the Trustees of said church by my Executors herein named, as soon after my demise as can be consistently with a proper settlement of all my debts and to have and to hold the same to them the officers of said church forever. I appoint William H. Deffenbaugh and David R. Gans to be my Executors of this my last will and testament.
