    3. I realized this Francis and James were in the War of 1812 Pensions too--at least I think this is L62; I haven't heard from these folks.....Perhaps the War of 1812 is the previous generation? The lineage 62 summary is very sparse. I copied this War of 1812 Pension file at the National Archives (19 pages): Beaty, James, Pvt., Capt. Tare’s Co., SC Mil, Dec. 10, 1813 – March 15, 1814; died Oct. 4, 1837, Chambers Co., AL. Widow: Margaret Milford, married Nov. 16, 1807, Pendleton, District, SC, 1850, 1855 Chambers Co Ala., 1871, Chambers Co., (PO Chambers C. H.) Ala.; died Aug. 8, 1876 or 1877. Excerpts: "Her husband was drafted in Abbeville district South Carolina on or about the 10th day of December AD 1813...She was married to the said James Beaty in Pendleton District, South Carolina on the 16th day of November AD 1807 by one James Crowder a Minister of the Gospel, of which no public or private record exists, and that her name before her marriage was Margaret Milford..." In further deposition by Philip P. Milford: "the deponent saw them [Margaret and James Beaty] married in Pendleton District South Carolina in the year 1808" Several other Beaty witnesses: Francis, Robert A., and John Beaty. Widow Martha, filed Jan 4, 1893 in AL COPIED (16 pages) 1892 -- Martha Beaty aged 68, residing near Alexander City, AL states that she is the widow of Francis Beaty who enlisted at LaFayette AL in May 1836. That her husband at the time of service was 23 years old, 5 feet 10 inches, blue eyes, light hair, fair complexion, a farmer, and born in Abeville, South Carolina. They resided near La Fayette for 20 years and at Alex City Ala until his death on Aug. 13, 1890. Her maiden name was Martha McCurley and they were married Dec. 17, 1857 in Chambers Co., AL. A certified copy of the marriage record is in this file. Martha was born Jan. 20, 1826.     3. I am somewhat confused.... This 90 year old Steward is the brother of Benjamin? Who is a brother of George of the north Jersey/Warren Susex County L127? Or don't we know that yet? Do we have any other info to fit the kids (ie: John Steward and Sarah)? I have a note that Benjamin's daughter Miss Kate Beatty lived in Mt. Holly, NJ at the time of her father's death in 1891. Kate (Catherine) Beatty b: Oct 15, 1823. I believe she may have been unmarried. He states he volunteered at Calhoun, Tennessee in 1838 and "while in service was engaged in Tennessee gathering up Cherokee Indians to be taken to the Reservation..." 1895-- Dr. J. Burton states "John H. Beaty died very suddenly, as a result of old age, at Mt Selman, Cherokee County, Texas, on the 7th day of February 1895. I was not present when he died but viewed his dead body and was present at his burial the next day after his death, at Mt Selman Grave Yard..." Mrs. Sallie Killough, age 85, states "I have known Mrs. Martha A. Beaty widow of John H. Baty intimately and continuously from the childhood to the present. I first knew her in Marshall County Mississippi about the year 1839. She was a child and her name was Martha Ann Clark. She came to Texas about the same time I did (in 1864) and I have lived almost in sight of her ever since..." G. A. Newton states: "I have known John H. Beaty from my earliest recollection to the day of his death...I lived a neighbor to John H. Beaty all my life. I first knew him in Marshall County, Tennessee when he was a boy and before he was ever married. His first wife was a Miss Susan Porter whom he married in Tennessee and who died in Texas..." Mrs. E J Williams age 62 states: "I first knew said Beaty in Marshall County, Tennessee when he was a young man--Said John H. Beaty was married twice; his first wife was a Miss Susan Porter whom he married in Lincoln County Tennessee, when I was a little child. I lived in Mr. Beaty's neighborhood and for a time in the family with Mr. Beaty and said wife, and Mr. Beaty & said wife and myself all came to Texas together and settled in Cherokee County." O. D. Beasley, age 21 years states: "I viewed his dead body (John H. Beaty) a short time after his death, and I sat up one night with his corpse. I was also present at the Grave Yard near Mt Selman Texas, the next day after his death and saw his dead body deposited in the Grave.." Mrs A. E. Wade, aged 49, states: "I was well acquainted with Susan Beaty, the first wife of John H. Beaty...I assisted others in dressing and preparing her body for the coffin. It being the first work of the kind I ever did, I remember it as distinctly as if it had occurred only yesterday." There is a torn out section of a Bible entry with the marriage of Joseph and Martha C. marked "To be returned." The muster rolls show Joseph P. Bata enrolled and also Joseph P. Baity. William E. Baty states "I am the son of Joseph P. and Martha C. Baty. I was ten years old when my father died. I can recollect him well...He died in the Spring of 1856." Va.; Dischg certf. in brief Widow Elizabeth Loyer; married 1817, near Winchester, Va. This is a confusing one because the name Beatley is spelled many ways in the documents, including Beatty and Beattey. The second "t" is frequently not crossed but then again, the first "t" is just as often not crossed --however the second "t" or "l" is frequently open in appearance so I really could not say for certain if this man is a Beatty or a Beatley. Highlights: William Beatty (?) is 61, in March next, in Feb. 1851 and a resident of Frederick County, VA. He enlisted at Newtown Stephensburg Frederick County VA in 1812 and marched from Winchester VA. There is an original discharge slip in the file. In 1855 he is a resident of "Buckley lately of Frederick" In 1871 William Beattey resides in Frederick Co., VA and is 81. Beaty Union Soldier Civil War Widow's Application for Army Pension State of Tennessee, County of Fentress, SS. On this 7th day of May, A.D. 1866, personally appeared before me Clerk of the County Court, a Court of Record, within and for the County and State aforesaid, Mrs Zilpha Beaty, a resident of the County of Fentress in the State of Tennessee, aged 28 years, who being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provision made by the act of Congress approved July 14, 1862: That she is the widow of John G. Beaty deceased, who was a private in company D commanded by Capt. Dotson in the 2nd regiment of East Tennessee infantry Vol commanded by Col. Carter in the war of 1861, and who died whilst in the service aforesaid, in Laurel County in the State of Kentucky on or about the 17th day of February A.D. 1862, from measles incurred in the service aforesaid and whilst in the line of his duty. She further declares that she was married to the said John G. Beaty on the 7th day of October in the 1855: that her husband the aforesaid John G. Beaty died on the day above mentioned, and that she is a widow of said John G. Beaty and has remained such ever since his death, as will more fully appear by reference to the proof herewith accompanying or to be hereafter filed. The first application was filed September 19, 1864 in Somerset, Pulaski County, Kentucky. The person taking the application consistently spelled the last name Baity, and on November 13th, 1865, the Adjutant General's Office, Washington D. C. informed the attorneys that the name John G. Baity was not found on the rolls of Company D, 2nd Tennessee Infantry Vols on file in their office. Subsequently, the above second application was made. This time Zilpha Beaty went to Jamestown in Fentress County. The second application also contained errors, which triggered several additional affidavits to correct the mistakes and inconsistencies, the most notable of which are footnoted and explained below. There was also a request for proof of marriage, and since no standard proof was available, a "Secondary Proof of Marriage" affidavit was taken. Affidavits follow. 1In the Secondary Proof of Marriage and another signed affidavit, Margaret's middle initial was corrected to "A". 2Several dates were given for Margaret's birth, each on a separate document or affidavit, and from this information there is no way to tell which is correct. Other dates were April 25, 1858, April 26, 1858, and August 26, 1858, but the Pension Office seems to have accepted August 26, 1858. 3In a later affidavit, Isaac S's year of birth was corrected to 1860. 4In a later affidavit, Malinda J's year of birth was corrected to 1862.     3. There was a Cobine family next to Stewart on the 1850 census. We have Stewart/Steward three times on census so he was born circa 1780-1790. Remember Mercer co., NJ was formed from Hunterdon, Somerset, Middlesex, Burlington cir 1838. So Trenton was in Hunterdon co., NJ in 1830. I wish we knew who Catharine was. She is on the 1830 census and Steward has a deed with her. There is an older Steward who George has a deed with. His wife was Hannah so that is probably his son. Which means the younger Steward is a grandson? It is difficult to know the ages of George's children. Circa 1783 he is signing deeds with no wife but for 10 years or so after that he is signing with wife Elizabeth David who was evidently a widow when he married her. Circa 1790's there is a deed where wife was supposed to sign and did not sign and after that she must have died. I need to type all the early deeds and put them in order.
