Beatty, Company "I" 123rd Pennsylvania Infantry, Mother Maria Beatty (application # 266,686) In May of 1880, Maria Beatty aged 70 and a resident of McKeesport, Allegheny County Pennsylvania applied for a Mother's pension. She states that she is the mother of Robert E. Beatty who enlisted at Pittsburgh, Pennsylvania in August of 1862 in Company "I" 123rd Regiment of Pennsylvania Volunteers in the war of 1861 and who "contracted chronic diarrhea from which he never recovered & which was the cause of his death, he having died in Tyrone, Blair County Pennsylvania from the effects of said disease on August 17, 1865. Maria states that she married Robert's father at Tyrone, Blair County, Pennsylvania on Feb. 19, 1843 and that her husband died at Tyrone Blair county Pa. on October 31, 1850. The witnesses to her signature are Henry and John Smith. This is a very short file. Beatty; "E" 24th Iowa Infantry; mother Lydia Beatty (application # 243,757) In 1879 Lydia Beatty, aged 64 and a resident of Traer, Tama County, Iowa filed a Mother's Application for pension. She is the widow of Henry Beatty and the mother of William W. Beatty who enlisted at Buckingham Iowa in August of 1862 in Company "E" 24th Regiment of Iowa Volunteers in the war of rebellion, and who died of bilious intermittent fever in General Hospital at Keokuk, Iowa. Henry Beatty died at Traer Iowa March 27, 1874 at age 64. In 1865 at her son William's death she had one child under 16, Henry O. Beatty, born September 1856. Lydia states her son William was "the business manager of the family" due to her husband's feeble health. She states "I am now left in destitute circumstances having no single children to aid me in my support." Beatty; "K" 102 Pennsylvania Volunteers; mother Margaret (# 40,426) In 1863, Margaret Beatty, aged 50 years and a resident of Pittsburgh, Allegheny County, Pennsylvania filed a "Mother's Application for Army Pension." She states that she is the widow of Samuel Beatty and the mother of Samuel R. Beatty who was a Corporal in Company "K" of the 102 Regiment of Pennsylvania and was killed on May 3, 1863 at Fredericksburg, Virginia by the bursting of a shell. David Linderman of Pittsburgh, Pennsylvania states that he was acquainted with Margaret and her son Samuel and that "said son was her only child." He also states that "her husband Samuel Beatty died in Plum Township, Allegheny County, on or about 1840, in February." In 1864 Margaret states "her husband died in March 1834 when her son Samuel was only ten months of age---That after diligent enquiry & search she can find no friend or relative who was present at the death and burial of her said husband although he died and is buried in Allegheny County, Pa. That her son Samuel was born May 6, 1834 and he was 29 years and 3 months old when he enlisted." In 1865 David Hutchison of Pittsburgh states "said Samuel was the only child of his said mother. I have known them for a number of years. They resided together as tenants of mine for a number of years prior to his enlisting into the service of the U. S.     3. Thank you, Laurel. That is L-3. I have looked at that census so many times wondering if it was them and the William was the young man in 1830. so distinctive to have 4 dau under 10 in 1830. We did not have the marriage or have them on census before 1850.. She is 63 years old and a resident of Butler Township, Knox County, Ohio. She is the widow of William Beaty and the mother of George L. Beaty, deceased who was a Private in Company "G" 121st Ohio Volunteer Infantry and who died at Chattanooga, Tennessee on May 23, 1864 of small pox. Mary was married to William Beaty in January 1824 at Crawford County, Ohio and William died on September 20, 1861 at Butler Township, Knox County Ohio. She states "the marriage records of Crawford County were destroyed by fire in the month of June 1831." Peter Busemburg of Coshocton County Ohio states "the said George L. Beatty was the only son living at the time of his father William Beaty's death..Mary Beaty resides with an unmarried daughter who is in poor health, hardly capable of earning her support." Joseph A. Cullison and Amariah Frey state "after the said George L. She is the widow of Henry Beatty and mother of John M. Beatty who was a private in Company "K" in the 4th Regiment of Pennsylvania Cavalry in the war of 1861 who died at Fortress Monroe on or about the 28th day of September 1862 of consumption. Margaret married Henry Beatty on October 25, 1815 at Slippery Rock Township, Butler County, Pennsylvania. She had three children named Elizabeth McBride, Ebenezer Beatty and Henry C. Beatty. John Gill and G. K. Evans of Wolfcreek Township, Mercer County, Pennsylvania identify Margaret stating they had known her for 20 years. Henry C. Beatty and George Cavens state "John M. Beatty lived at home with his mother before he entered the military service or more rather his mother lived with him. This is "a true and correct copy of the record of the Birth of John Beaty as recorded in the family Bible now in possession of the Father of the above named John Beaty; said family Bible stereotyped by A. Chandler for the American Bible Society 1837." Beatty, aged 43 and a resident of Monroe, County Indiana applies for a Mother's Army Pension. She states that she is the widow of James M. Beatty who died on May 9, 1863 and the mother of Horace Beatty, who enlisted at Bloomington, Indiana in 1863 in Company "I" 10th Indiana Cavalry and died of sickness in a hospital in Jacksonville, Florida June 3, 1865. In 1867 John Walker and Jackson Misner state that they were acquainted with James M. Beatty the father of said Horace Beatty and know that he died previous to his said sons death viz on the 9th day May 1863. They also state that she is incapable of earning her subsistence by reason of "her age being forty four years old and having four girls from six to fourteen years old and an invalid son twenty seven years old who is entirely helpless and dependent on his mother, being idiotic." There is a letter in the file dated Jan. 19, 1934 from Esther H. Beatty, 921 E. 36th Street, Indianapolis, Indiana: Dear Sir, Will you kindly give me data concerning the Civil War pension claim of Horace L. Beatty, Monroe, County, Bloomington, Indiana. I believe he was supposed to have died of starvation at Andersonville, Fla. Prison. Does the information that you have tell where he is buried? Thanking you for anything you can tell me. Va.); died Jan. 13, 1871, Harlem Springs, Ohio; original Deed of property in Charlestown W. Va. made by soldier & wife in 1822, in brief. Widow: Rachel Cummings; married Feb. 15, 1816, Loudon Co., Va. issued Feb. 3 (marriage license); 1878, Carroll co. Witnesses are John Nixon, Anthony Cummings and William Beatty. In 1855 Thomas Beatty of Brooke County, Virginia applies for Bounty Land. In a letter about this warrant written in 1878 by Rachel's lawyer "she can not give the # of warrant - says her son William Beatty got the land warrant, and traded it to Wesley Grey or Gray of Steubenville, Ohio." In April 1878 Rachel Beatty aged 80 years and a resident of Carroll County, Ohio files a "War of 1812, Claim for Widow for Service Pension." She states that Thomas Beatty volunteered at Leesburgh, Virginia. At the time of enlistment he was 21 years old, his place of birth was Charlestown, Virginia, height 5 feet, 10 inches, eyes blue, hair light, complexion fair. She states she was married on Feb. 15, 1816 in Loudon, Va. and her maiden name was Cummings (there is a certified copy of the marriage in the file dated 1878, which states that a marriage license was issued on April 3, 1878). Thomas Beaty died at Harlem, Ohio on January 13, 1871. Since the time of her husband's enlistment they have resided at Virginia for two years, Ohio 18 years, West Virginia 28 years and Ohio 14 years. Thomas Telfer and Martha J. Telfer identify Rachel in this document. Martha J. T Telfer states "she is the legal custodian of the family Bible of said decedent, which family Bible bears date 1817 and was printed and published by M. Carey & son of 126 Chestnut Street Philadelphia, Pa as appears of record on the first page of said book and she says that the record of the marriages and births recorded in said book is in the hand writing of Thomas Beatty deceased and among other records therein contained is the following to wit "Thomas Beatty and Rachel Beatty his wife was married the 15th day of Feb. 181" and affiant further says that the record is mutilated in this that the right hand figure of the date of said marriage has been punched out, and she says that when small she and her sister mutilated said date whilst playing with said book." Mary E. Morehead, aged 51, states that she attended Thomas' funeral. In November of 1878 in Carroll County, Ohio, John W. Benedum, aged 55, states that he has known Thomas and Rachel Beaty for 35 years and that "Thomas Beatty died about the year 1871." Mary Benedum, also of Carroll County, aged 82 years states "she was present and an eye witness at the solemnization of the marriage contract between Thomas Beatty and Rachel Cummings and that said parties were married in Loudon Co., Va. about the year 1816.she lived neighbor to them in Virginia, and she and them moved to Carroll Co., Ohio near the same time, and her acquaintance has been intimate, having been intimate friends for more than 60 years.said parties Thomas Beatty and wife reared and raised a large family of children." I think this is the same Abraham; This Abraham might have remarried to a Mary Ellen Beaty in 1861? He is listed with her in the 1870 census there.     3. Well, my thought was that if this law applied in that particular U.S. jurisdiction in the 18th cen, that would make the two Williams unlikely to be the same person. However, if the law didn't exist, that reasoning would go out the window. The law went extinct in Britain in the 19th cen - legislated away I think- and undoubtedly would have vanished same way here in any states that applied it. I do not know the Law about marrying sisters you speak of in England, but I do know that brothers married sisters and one man could marry one lady and then after divorce or death marry her sister here in the USA. What I am trying to decifer here is wether or not the William Tate (I) (Father) and William Tate (II) (Son) were the same person... The record they sent me does not have William (I) connected to William (II). just the notes that William Tate who married Mary Beaty is the father of William Tate who married Jane Beaty. If, in fact, they are father and son.. Then WHO is William Tate (II)'s mother? Can I link The father and son in my file, under Mary Beaty as mother? That does not make since..William (II) would be way to young to marry Jane Beaty, Mary beaty's sister... I think that William (I) either married prior to Mary Beaty, and had William (II) or William (I) and William (II) are the same person. But I need the powers that be...(This list) to make a descion. Since I did not do this resaerch I don't want to just connect William Tate (I) to William Tate (II) under a first wife (unknown) if some one knows the answer... I found this file today--I asked to see all of the unindexed Bounty Land Claims for War of 1812 (I will make an index soon--there are quite a few of these) and was also given the War of 1812 Pension boxes. I picked up one envelope and this file was stuck to it: Beatty, Thomas, Pvt., Capt. George W. Ball's Co., Va. Mil., Aug. 23, 1814 - Sept. 8, 1814; 1822, Harrison Co., Ohio, 1835, Brooks Co., Va. (now W. Va.); died Jan. 13, 1871, Harlem Springs, Ohio; original Deed of property in Charlestown W. Va. made by soldier & wife in 1822, in brief. Widow: Rachel Cummings; married Feb. 15, 1816, Loudon Co., Va. issued Feb. 3 (marriage license); 1878, Carroll co. (PO Harlem Springs) Ohio, 1884, Harlem Springs, Carroll Co., Ohio; died May 6, 1886. Hi Nelda, Oddly enough, I know the following information about English law but not about American: In 18th cen England, a man couldn't legally marry his wife's sister - no, not even after his wife died. ;) You might want to check and see if that prohibition existed in the state in question (the southern states in particular frequently relied on English legal precedents during the colonial and early federalist period), might help shed some light on the issue.
