Part 2 of 3 -------------- Continuation Augusta County Chancery Suit 5 June 1840 Bushong Heirs VS Sellers It being suggested to the Court that the Defendant Sellers has departed this life, the same is ordered to be entered of record and by consent of the parties, it is ordered that this cause stand and be recorded in the names of Samuel Gibbons, the administrator of said Isaac Sellers and of Margaret Jane Sellers and Mary Ann Sellers, the only children and Heirs who are infants at law of the said Isaac Sellers and that Samuel Gibbons is appointed their Guardian ad litem. AND then by consent of the parties Plaintiff and Defendants this cause came on to be hear on the Bill answer and exhibits and the depositions of witnesses and was argued by counsel. WHEREUPON the Court being of opinion that the Plaintiff not entitled to the specific execution of the vocal contract stated in their Bill but denied by the Answer of the Defendant Isaac Sellers in his lifetime.
