Lancaster County Pennsylvania Will Book H Pages 211-214 Will of Henry Wenger Will dated 27 July 1799 Probated 27 July 1802 Executors: Adam Wenger and David Eby In the name of God Amen. I, Henry Wenger of the Township of Leacock in the county of Lancaster and state of Pennsylvania, Yeoman, being far advanced in years, but in Health and of sound and disposing Mind and Memory and understanding, Do make and declare this my last Will and Testament. I commend my Soul to God, my Body to the Earth to be decently interred as my Executors shall direct, in humble Hope of a glorious Resurrection and an happy admision into the Regions of immortal bliss and Glory in and through the merits of my Mediator and Redeemer Jesus Christ. And as to such worldly Estate wherewith God hath blessed me. I do give, devise and bequeath the same in manner following to wit: Imprimis, it is my will and I do order and direct that my just Debts and Funeral Expenses be paid and satisfied as soon as conveniently may be done after my decease. ITEM: I do give devise and bequeath unto Peter Eby, Joseph Heller and Benjamin Owen all of the Township of Leacock in the County of Lancaster aforesaid, their Heirs and Assigns, all that certain piece or parcel of Land situate in the Township of Leacock in the County of Lancaster aforesaid adjoining the lands of my son Adam Wenger, David Line and Martin Keller, containing Twelve acres and twelve perches, be the same more or less, it being the Residue or Remainder of a certain Tract of land containing one hundred and eighty three acres and an half of an acre and the usual allowance of six acres of land for Roads and Highways which was granted to me by the Honorable, the late Proprietories of Pennsylvania aforesaid, in and by their Patent bearing date the fifth day of February in the year of our Lord one thousand and seven hundred and sixty two recorded in the office for Recording of Deeds for the City and County of Philadelphia in Patent Book AA Volume Three Page 70 et al; Together with the Buildings, Improvements and Appurtenances thereon and, thereto belonging. In Trust to and for the several uses Intents and Purposes, herein after expressed, that is to say, To and for the use of my son Christian Wenger during his natural life he making no waste or Destruction thereon, and from and immediately after the Determination of that Estate, then to and for the use of the said Peter Eby, Joseph Heller and Benjamin Owen and their Heirs for and during the natural Life of said son Christian, in Trust to preserve and support the Contingent Remainder hereinafter limitted from being defeated or destroyed and from and after the Decease of the said Christian Wenger, Then to the use and Behoof of all and every the children (whether sons or daughters) of the said Christian born or to be born, and to the Heirs and Assigns of such child or children forever, to be equally divided between them (if more than one) and not as joint Tenants. But if my said son Christian Wenger should have no child or children living at the time of his Death or if the children which he may leave shall all die before they or any of them obtain the age of twenty one years, Then to and for the use and Behoof of my Right Heirs forever. ITEM: I do give and bequeath unto my daughter Mary the sum of Ten shillings which together with the several Sums by me heretofore paid and advanced to her shall be in full of and for her Part or Share and all Claims and Demands of in to and out of my Estate. ITEM: I do give and bequeath unto my daughter BARBARA, the wife of PETER BUSHUNG, the sum of Sixty Pounds current money of Pennsylvania in Gold or Silver Coin to be paid her in one year after my decease, which said Sum together with the several Sums by me heretofore paid and advanced to her and her said Husband, shall be in full of and for the Part or Share and all Claims and Demands of my said daughter Barbara and her said Husband of in to and out of my Estate. ITEM: I do give and bequeath unto my daughter Eve the wife of Joseph Miller the sum of Sixty Pounds Current money of Pennsylvania in Gold or Silver Coin to be paid her in two years after my decease, which said Sum together with the several Sums by me heretofore paid and advanced to her or her said Husband, shall be in full of and for the Part or Share and all Claims and Demands of my said daughter Eve and her said Husband of in to and out of my Estate. ITEM: I do give and bequeath unto my daughter Salome the wife of Peter Reidebach the sum of Sixty Pounds current money of Pennsylvania in Gold or Silver Coin, to be paid her in three years after my decease, which said Sum, together with the several sums by me heretofore paid and advanced to my said Daughter or her said Husband, shall be in full of and for the Part or Share and all Claims and Demands of my said daughter Salome and her said Husband, of in to and out of my Estate. ITEM: I do give and bequeath unto my Son Henry Wenger the sum of Sixty Pounds current money of Pennsylvania in Gold or Silver Coin, to be paid him in four years, after my decease, which said Sum together with the Lands by me heretofore granted and conveyed to my said Son Henry, shall be full of and for the Part or Share, and all the Claims and Demands of my said Son Henry, of in to and out of my Estate. ITEM: I do give and bequeath unto my son Abraham Wenger the sum of Forty Po9unds current money of Pennsylvania in Gold or Silver Coin, to be paid him in five years after my decease, which said Sum together with the Lands and Tenements by me heretofore granted and conveyed to my said son Abraham, shall be in full of and for the Part or Share and all the Claims and Demands of my said Son Abraham, of in to and out of my Estate. ITEM: All the Rest Residue and Remainder of my Estate Real and Personal not hereinbefore particularly bequeathed, I do give and devise and bequeath unto my son Adam Wenger his Heirs, Executors, Administrators and Assigns forever. AND LASTLY I do hereby nominate constitute and appoint my said son Adam Wenger and my trusty Friend David Eby of the Township of Leacock aforesaid, and the Survivor of them, Executors and Executor of this my last Will and Testament hereby declaring Null and Void all former and other wills or wills by me made and declaring this and no other to be and contain my last Will and Testament. IN WITNESS Whereof, I have hereunto set my Hand and Seal the Twenty seventh day of July int he year of our Lord One Thousand seven hundred and ninety nine. H. JOHN MESSENSKOP MELCHER RUDISIL PHILIP GLONINGER Lancaster County SS On the Twenty seventh Day of July Anno Domini 1802 Before me the subscriber personally appeared John Messenskop, Melchoir Rudisell and Philip Gloninger the three subscribing witnesses to the within and foregoing Will. The said John Messenskop and Melchoir Rudisill upon their Corporal Oath and the said Philip Gloninger upon his solemn affirmation to Law did depose declare and say that they were present and saw and heard Henry Wenger the Testator therein named sign seal publish pronounce and declare the within and foregoing Instrument in writing, as and for his last Will and Testament and that at the time of the doing thereof, he was of sound and well disposing Mind Memory and Understanding according to the best of their Knowledge, Observation and Belief. BE IT REMEMBERED: That on the twenty seventh day of July Anno Domini 1802, the Last Will and Testament of Henry Wenger late of Leacock Township in the County of Lancaster, Yeoman, deceased, was proved in due form of Law and Letters of Testamentary thereon were granted to Adam Wenger and David Eby the Executors therein named. They having first been fully qualified will and truly to administer the Estate of the said deceased, especially to exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster within one month and to render a true and just Account of their Executorship on the said Estate in one year from this Date or when thereunto lawfully required.
