Bushon and Estora Bushon by Robert Elders VS Hannah Thomas et al JANUARY TERM, A. D. 1869 Court met pursuant to adjournment, Tuesday Morning at 8 1/2 o' clock 26th January 1869. Present the same Judge and other Officers as on yesterday. {Not named} IN PARTITION Mary A. Bushon a Minor by Robert Elder her guardian VS Hannah Thomas and et al And now comes the demandant by C. W. O' Neal her attorney and it appearing to the Court, that the said Robert Elder is the duly appointed Guardian of the said Mary A. Bushon and Estora Bushon and on motion and on producing the report of the Sheriff of his sale made under the former order of this Court and the Court being satisfied on examination that said sale has been made according to law; It is ordered that said proceedings and sale be and the same is hereby approved and confirmed, and it appearing that the term of Office of Abram Yerger late acting Sheriff of said County who made the sale of the premises in this case, has expired before the present term of this Court and that Samuel Myers is the Sheriff of said County duly elected and qualified, is now the acting Sheriff of said County. It is Ordered that Samuel Myers Sheriff as aforesaid by deed duly executed to convey said premises to the purchaser in fee simple, free of Dower, on his complying with the terms of the former order in this case. And it further appearing to the Court that Hannah Thomas who was lately widow of Peter Bushon deceased has filed her answer in this suit, waiving the assignment of dower by metes and bounds in said permises, and asked the court in lieu thereof to allow her such reasonable Sum in money out of the proceeds of the sale of said premises, as will be equal to her said Dower interest. It is therefore ordered by the court that the said Hannah Thomas be, and she hereby is allowed out of said Sale the sum of $190.00 as and for her full Dower interest therein. And it is further ordered that the said Sheriff out of the money in his hands pay first, the costs of this case including a Counsel fee of $30.00 to C. W. O' Neal, aforesaid to p. 2nd That he pay Hannah Thomas the said sum of $190.00 so allowed as aforesaid 3rd The balance he pay one equal third part to Margaret Preston wife of Alva Preston. That he pay one equal third part of the balance to Mary A. Bushon or her Guardian. And one equal third part of said balance to Estora J.
