Rockingham County Virginia Chancery Settled 1855 -002 Original Case #15 Israel May Guardians VS Isaac May et al This case involved the Heirs of Isaac May, deceased before 1850 and his wife Mary deceased to decide whether it was in the best interest of their infant children to sell their interest in their mother's Dower rights or keep the land. Those involved were: BUSHONG CAMPBELL CRIST KIPPS MAY WHITE ------------------ DEPOSITION OF PETER BUSHONG 10 September 1850 New Market, Shenandoah County, Virginia By consent of all parties being present and the Guardian ad litem of Isaac May and Leana May, infant children and heirs of Isaac May, deceased, being present also the following depositions were taken on the 10th day of September 1850 at the office of Louis G. Rice, in the Town of New Market, Shenandoah County, Virginia, to be used as evidence in a cause in Chancery now pending in the Circuit Court of Rockingham County to which Israel May, Guardian of Isaac May and Leana May, infant children of Isaac May deceased, is Plaintiff and Strother May, adult, Isaac May and Leana May infant children aforesaid are Defendants. PETER BUSHONG, A witness of lawful age and first duly sworn deposeth and saith: QUESTION BY PLAINTIFF: Are you acquainted with the thirty acres of Dower lands of which Mary May died possessed as of Dower? ANSWER BY PETER BUSHONG: Yes Sir. QUESTION BY PLAINTIFF: Do you believe it would be to the interest of Isaac May and Leana May infant children of Isaac May deceased, to have their interest in said Dower land sold? ANSWER BY PETER BUSHONG: Yes Sir. I believe it would. QUESTION BY PLAINTIFF: Would it sell better separately or in conjunction with the other Heirs interest in said Dower? ANSWER BY PETER BUSHONG: I think it would sell best altogether. QUESTION BY PLAINTIFF: Do you think if it was not sold but divided that the several rent of each of the infant's interest would be equal to the interest upon the money if sold? ANSWER BY PETER BUSHONG: No Sir. It would not. QUESTION BY PLAINTIFF: Taking everything into consideration the price of land, the anticipated railroad, do you or do you not think that their interest would be any greatly promoted by a sale of their interests in their mother's Dower and would the Dower land now command a good price in market? ANSWER BY PETER BUSHONG: I think their interest would be greatly promoted by a sale of their interest in the Dower and I think the Land would now command a good price at market as Land is now selling very well.
