PART 1 of 3 NOTE: This Deed was very difficult to transcribe and I can only hope that I transcribed it correctly. -------------------- Ross County Ohio Deed Book 17 Pages 185 - 188 Duncan McArthur & wife Nancy to John Beshong 2 March 1821 WHEREAS John Beshong and Duncan McArthur of the County of Ross and State of Ohio did in the year One thousand Eight hundred and four purchase of and obtain an assignment from General Charles Scott of the State of Kentucky for 833 1/3 acres of his Virginia military land Warrant No. 815 together with the entry No. 3011 in which the said 833 1/2 acres of Warrant No. 815 was appropriated and six hundred acres of said entry having been surveyed and 233 1/3 acres thereof having been withdrawn and entered and surveyed in No. 3578 AND in consequence of the said assignment from said Scott to Beshong and McArthur having been mislaid, Patents for said land were issued from the proper authority in the name of said Charles Scott and the said assignment having been found and a Bill in Chancery having been filed in the Court of Common Pleas of the said County of Ross, by the said Besong and McArthur against the heirs of said Scott. WHEREFORE a Court was conducted on the first of September last against the said heirs of said Scott in favor of the said Beshong and McArthur for the legal title of the said Survey No. 3041 for 600 acres and the said survey No. 3578 for 233 1/3 acres AND WHEREAS an amicable division of said Land has here been made by and between the said Beshong and McArthur, NOW THEREFORE THIS INDENTURE, made this second day of March in the year 1821 between the said Duncan McArthur and Nancy McArthur his wife of the said County of Ross and State of Ohio of the one part and the said John Beshong of the County and State aforesaid of the other part. WITNESSETH That the said Duncan McArthur and Nancy his wife for and in consideration of the aforesaid Decree and Division and the sum of one dollar current money of the United States to them in hand paid the receipt whereof they do hereby acknowledge and forever acquit and discharge the said John Beshong his heirs Executors and Administrators hath sold aliened confirmed enforced and forever quit claimed unto the said John Beshong his heirs and assigns forever all the right vested in them to the said John Beshong to the following described tracts of land to wit: BEGINNING at two sugar trees in the west bank of the Scioto River upper corner to the river to Charles Scott's said survey No. 3041, thence down the river bending, thence South 43 East 312 crossing the mouth of Patton's Run to four sycamores, thence South 46 poles to two elms, thence South 13 North 200 poles to a white oak corner to Scott's survey, thence with the lines thereof South 25 West 38 poles to a white oak, thence South 58 West 30 poles to a white oak, thence South 19 1/2 West 36 poles to a white oak, thence South 59 West 58 poles to a large white oak, Easterly corner to a tract of 427 acres of land this day conveyed by said Beshong and Jennet his wife to said McArthur, thence with the course line thereof North 135 West 117 poles crossing Patton's Run to a white oak and two small black oaks in the original line of Scott's said survey, thence North 458 11 poles to a white oak one of the original courses of said survey, thence with the lines thereof North 597 West 64 poles to a white oak, thence Northwest 884 poles crossing a branch at 11 poles to a hickory, thence North 65 East 108 poles crossing a branch at 54 poles to a hickory, thence North 513 38 poles to a dogwood (down), thence North 70 East 42 poles to a white oak, thence North 35 East 61 poles to a sugar tree near the road, thence North 67 East 41 poles to the BEGINNING Containing Three Hundred and fifty acres being a part of Scott's said survey No. 3041. --------------------- TO BE CONTINUED: Part 1 of 3 Researched by Mareetta Brewer and Transcribed and Submitted by Gloria Neiger Bushong
