WITNESSETH that the said William Bushong for and in consideration of the sum of one hundred and fifty dollars to him in hand paid by the said Jacob Bushong the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain sell convey and confirm unto him the said Jacob Bushong all his right title interest and claim in and to his share or proportion of his father Jacob Bushongs estate late of Stark County now Carroll. Vane, Recorder HCO. --------------- Probate Record Book A Carroll County, Ohio Pages 153 - 155 Family History Center, Salt Lake City, Utah Film #333952 Verbal Will of Eve Bushong ESTATE OF EVE BUSHONG DECEASED Be it remembered that heretofore to wit at the April Term of the Court of Common Pleas Anno Domini one thousand eight hundred and thirty seven, began and held in the Court Room in Carrollton within and for the County of Carroll, before the honorable George W. Beldin, President, George Davis, George Reynolds and Robert George Esquire associate Judges of said Court in said County A paper purporting to contain the verbal Will of Eve Bushong deceased, was brought in to Court, and it appearing to the satisfaction of the Court hearing from the testimony of Andrew Clark and Thomas Swearenger credible and disinterested witnesses that the said verbal Will was made in the last sickness of said deceased, that at the time of making the same the said Eve Bushong was of some mind and memory of full age and not under any restraint, that she did at the same then call on the said Andrew Clark and Thomas Swearenger to bear testimony that such was her Will, that said Will was committed to writing within ten days after making the same, and that six months had not elapsed since the speaking of the said Testamentary words, there upon the same is approved and ordered to be recorded with the proof taken. Which will is in the words and figures following to wit: June the 27 A. D. 1836 A Memorandum of the words spoken by Catharina Eve Bushong as her last Will. FIRST to my son Jacob, I give him my two horses til spring 1837 and then Jacob to have the choice of the horses, and my son Peter to have the other: I also give my son Jacob all my beds and bedding and household and kitchen furniture, and all the grain in the ground and grass and flax in the ground, and one half of the flax in my house. Also all my wool, and to have all my money, and all my linen with the all of tin, of one shirt patron, and Jacob to pay all my funeral expenses, and now I give my son William one half of the flax in my house, five yards of flannel and one shirt patron of linen and my sheep, and Williams wife Caty my side saddle and four dozen of thread. I give my Daughter Caty Hively my black dress and my black silk shawl and all the rest of my wearing apparel to be equally divided between my sons wives namely Jacobs wife, Williams wife and Peters wife. D. 1877 the Last Will and Testament of William Bushong, late of the County deceased was produced in the Court and offered for Probate which Will is in the words and signers following to wit: In the Name of the Benevolent Father of All, I, William Bushong of Malvern, Carroll County Ohio do publish and declare this to be my last will and testament. FIRST I, desire all my Just debts be paid SECOND, I devise and bequeath to Sherman Cook fifty dollars (50$) THIRD, I, devise and bequeath to Franklin M. Bushong, my son, the Sum of One hundred (100$) dollars. FOURTH, I devise and bequeath to my daughter Mary C. McCarter the Sum of One hundred (100$) dollars. FIFTH, I, desire that my Executor sell all my property to the best advantage, both real and personal at private or public Sale or he may deem best, and that I hereby revise appraisement of Said property, and after all my Just and legal debts are paid, I direct that the balance be divided equally between my three Children: Angeline Zents, Franklin M. Bushong and Mary C. McCarter, Share and Share alike. SIXTH, I hereby nominate and appoint A. R. Haines the Executor of this my last will and testament. IN TESTIMONY whereof the same way this 9th day of June 1875 duly signed by me William Bushong in the presence of T. J. McCobb and J. G. Murdoch the Subscribing witnesses to the last will and testament of William Murdoch {should be Bushong} deceased, who being duly Sworn according to law to Speak the truth the whole truth and nothing but the truth, in relation to the execution of said will depose and say that the paper before them purporting to be the last Will and Testament of William Bushong now deceased, the Will of said deceased, that they were present at the execution of said will at the request of the testator and subscribed their names to the same as witnesses in his presence and that they saw the said William Bushong deceased Sign and Seal Said Will and heard him acknowledge the same to be his last Will and testament; that the said William Bushong at the time of making, signing and sealing said will was of legal age and of sound and disposing mind and memory and under no undue or unlawful restraint whatsoever. Adams, Probate Judge Wherefore the following Action was had with respect to said will: In the matter of the Estate of William Bushong deceased Probate of Will: On this 4th day of December the last will and testament of William Bushong, late of this county deceased was produced in this Court and offered for Probate and thereupon came Thomas J. McCobb and J. G. Murdoch the Subscribing witnesses to said will and testified in open Court to the due Execution of the Same, which testimony which testimony was reduced to writing and Subscribed by said witnesses; And the Court being fully advised in the premises, find that Said will is the last will and testament of said decedent, and it is ordered that Said will together with the testimony in relation to the Execution of the Same be recorded as and for the last will and testament of the said William Bushong deceased.
