Augusta County Virginia Will Book 11 Page 11 Will of Jacob Bushong Written 14 January 1811 Proved 23 March 1812 In the name of God Amen. I, Jacob Bushong of the County of Augusta in the State of Virginia being in usual health of body and of a sound and disposing mind memory and understanding, considering the certainty of death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world this world when it shall please God to call me hence, I do therefore make and publish this my last will and Testament, in the manner and form following, That is to Say: FIRST AND PRINCIPALLY, I commit my Soul into the hands of the Almighty God, and my body to the earth to be decently buried at the discretion of my Executors herein after mentioned or named, and after my debts and funeral charges are paid. SECONDLY: It is my will and device that after my decease that my Executors make sale of all my real and personal Estate which I may die possessed of, and make Conveyance or Conveyances thereof to the purchaser or purchasers and to make conveyance or conveyances to any lands I may have sold or to any lands that have been sold by any person acting for me, on the purchaser or purchasers complying with their contract. THIRDLY: So soon as the moneys which may arise from the sale of my Estate real and personal as aforesaid and the debts which may be owing to me at my decease can be collected by my Executors, they are hereby directed to make an equal distribution thereof into Eleven shares, so that every child gets alike. AND LASTLY I do hereby constitute and appoint my son-in-laws Phillip Haines and Peter Nicholas to be my Sole Executors of this my last will and Testament, Revoking and annulling all former wills and Testaments by me heretofore made, Ratifying and confirming this and none other to be my last will and Testament. This last will and Testament of Jacob Bushong, deceased was presented in court and proved by the oaths of Daniel Fall and Jacob Smith, two of the witnesses thereto and Ordered to be recorded and on the motion of Philip Haines, one of the Executors named in said Will who made oath and together with James Cochran and Jacob Smith his securities entered into and acknowledged their bond in the penalty of $6000 conditioned as the law directs and Peter Nicholas the other Executor named in said Will appeared in court and refused to take upon himself the burden of the Execution thereof. Certificate is granted the said Philip Haines for obtaining a probate thereof in due form. Teste: Chesley Kinney, County Clerk ------------------------------ Jacob Bushong's Estate was appraised at $4655.11 with total costs for settling estate at $476.54 making final distribution amount of $4178.57 with each of the 11 heirs receiving $379.87. Six of the heir's husbands received their $379.87 on 22 September 1817. There is nothing more said about any of the other five heirs as specified in the Will although Philip Haines did have the $1899.35 cents to distribute. I am wondering if there was a lawsuit from the heirs to compel Philip Haines to distribute those funds to the remaining 5 heirs. Possibly by then some of them had died and that may have been the problem. Amount the legatees were son-in-laws: Jacob Harshberger Peter Link Peter Nicholas Philip Null Philip Miller Philip Haines After examining the receipts and papers we find the said Philip Haines Executor to the Estate of Jacob Bushong one thousand eight hundred and ninety nine dollars and thirty five cents this 22nd day of April 1819. At a court held for Augusta County the 24th May 1819. This account and settlement of the estate of Jacob Bushong deceased being returned to the Court is ordered to be recorded. Only 7 baptismal records are found in the church records of York, Pennsylvania. Son-in-laws named in Jacob Bushong's Will and in settlement as legatees of his Estate: 8. Philip Haines Marriage record for him names his bride as Eve Bushong 9. Jacob Harshburger/Harshbarger Marriage record show that he took out a bond for marriage on 10 May 1798 to marry Barbara Bushong 10. Peter Link Marriage record shows that he took out a bond for marriage on 9 November 1791 to marry Catharine Bushong 11. Philip Miller Marriage record shows that he took out a bond for marriage on 23 April 1798 to marry Chloe Bushong. ------------------------------- This, we believe, are the 11 children of Jacob Bushong and Juliana Weigel.
