Cannon (widow of the late C. A. Cannon, Idella C. Cannon, Chloe J. Cannon, Carrie Cannon Phillips and John T. Phillips her husband, Harriett A. Cannon, Nettie C. Paxson and J. F. Paxson her husband, r. Elmer Cannon, Eva M. Cannon and Cyrus A. Cannon, all of Loudoun County, Virginia, of the first part and ABRAHAM BUSHONG, of Warren County, Virginia, of the second part Witnesseth: That in consideration of twelve thousand dollars the receipt of all which is hereby acknowledged said parties of the first part do hereby grant and convey unto said party of the second part his heirs and assigns forever, all that certain tract or parcel of land situated in Loudoun County Virginia about one half mile Northeast of Clark's Gap and between it and the town of Leesburg containing about two hundred ninety five acres, one rood and thirty two poles, to be the same more or less. The said tract of land hereby conveyed and intended to be conveyed adjoins and is bounded on the Northeast by the lands of John T. Sewell; on the east and southeast by the land known as the Hammerly tract and those of William B. Lynch; on the southwest and west by the lands formerly belonging to Brown's heirs, Shugars, the tract formerly owned by Walker and others; and on the North by the lands of E. B. White formerly B. L. Fox and others. The said tract of land hereby conveyed embraces the following tracts or parcels of land, less the portions thereof sold herein specified viz: (a) A tract of land stated to contain two hundred ninety six acres more or less known as the Greenlease farm, which by the terms of the last will and testament of the late Israel Warner recorded in the Clerks Office of Loudoun Circuit Court Will Book 3 H's folio 269, was devised and bequeathed to his son Isaac V. Warner and which by deed dated June 12th eighteen hundred eighty eight recorded in said Clerks Office Liber 7 a's folio 460, the said Isaac V. Warner and wife conveyed to the late C. A. Cannon and therein described as containing two hundred therein described by metes and bounds according to the survey of N. T. Brown dated April 20th eighteen hundred eighty nine, as containing fifty two acres two roods and nineteen and one half square poles deducting and excepting from the above tracts of land, however, certain portions thereof sold by said Cannon in his lifetime and conveyed by his and his wife, vix: (a) By deed dated May 15th eighteen hundred eighty nine recorded in said office Liber 7C's 43 & 7 A's folio 43 to William B. Lynch fifty acres and twelve square poles of land by metes and bounds therein stated and being a portion of said first named tract above described. (b) By deed dated August 22nd eighteen hundred ninety nine recorded in said office Liber 7 R's folio 275, to Amelia A. Campbell sever eighths of an acre and three and one half square poles more or less by metes and bounds therein set forth and being a portion of the said tract of land conveyed to said Cannon by deed from Lynch and wife above referred to, leaving in the residue of said two tracts of land first above described two hundred ninety five acres one rood and thirty two poles, which the said c. A. Cannon was seized and possessed of at the date of his death and he having died intestate about the year 1902, the said land descended and passed under Virginia statute of descents to his widow (the said Jane S. Cannon) and his eight children, viz: Idella C. Cannon, Chloe J. Cannon, Carrie Cannon, who married and is the wife of said John T. Phillips, Harriett A. Cannon, Nettie Cannon who married and is the wife of J. F. Paxson, r. Elmer Cannon, Eva M. Cannon and Cyrus A. Cannon, all of whom are more than twenty one years of age. The said tract of land was sold by said parties of the first part to said party of the second part by written contract bearing date June 17th nineteen hundred and eigh by the terms of which is agreed as therein provided that the sale of said land to said party of the second part was made and is subject to the existing tenancy thereof, and reserved certain rights and things therein specified to said parties of the first part. Said party of the second part is to pay the taxes on said land which shall accrue and become due in the fall of nineteen hundred and eight all of which provisions in respect to rights reserved to said parties of the first part as to crops, grazing & c and payment of taxes on said land are to remain in full force and effect unimpaired by the execution of this deed. There is of record in the said Clerks Office Liber 7 W's folio 358 an agreement dated March 10th nineteen hundred and two containing certain provisions in respect to the rental and management of said land during the infancy of two of the said children of said C. A. Cannon and providing that said land should not be sold ..until the death of said widow, unless by mutual agreement. And whereas all said parties of the first part fully understanding the terms and provisions of said agreement have elected and do hereby elect to revoke and annul the said agreement and make sale and convey the said land according to the terms and provisions of this deed, in the lifetime of the said widow, and not to wait to do so until her death. And the said Jane S. Cannon, Idella C. Cannon, Chloe J. Cannon, Carrie Cannon Phillips, Harriett A. Cannon, Nettie Cannon Paxson, R. Elmer Cannon, Eva M. Cannon and Cyrus A. Cannon covenant that they will warrant generally the said lands hereby conveyed; that they have the right to convey the same to said party of the second part; that said party of the second part shall enjoy quiet possession of said land, subject to the said tenancy thereof and reserved rights, free from all incumbrances except said taxes; and that they will execute such further assurances of the same as may be requisite.
