I know commercial posts are forbidden on the boards, and I also don't allow them on the list, but would you allow this post since the donations being accepted are for a DNA study? Or is this crossing the line? Joanne is a subscriber to the list as well as a posting member on the board, and a member of the dna specific list hosted elsewhere, so I do know her and know her intentions aren't dishonorable, but I don't want to allow this if it means that she's breaking the AUP nor do I want to seem like any other commercial posts will be tolerated... I have luck up to about 625 posts but you can try higher - or lower.     3. I tried to go to the boards help desk and submit a request to have one of my boards gatewayed to the same surname list. I admin both. I keep getting an error message when I hit the submit button. Is there another way to ask them to gateway the board? This is the error message I keep getting. Maybe I am doing something wrong. Personal attacks on lists and message boards are not up for a vote. They are violations of TOS. The admin should delete these posts and LET THE DATA stay on the boards. Post a link to COPYRIGHT websites and the COPYRIGHT list privately and NOT on the message board. Your job is not to referee these people but to make sure the rules are followed and in worst case scenario contact the HELP DESK.     3. Facts themselves -- birthdates, marriages, deaths, etc. -- are not copyrightable. "Author" can complain all she likes, but that doesn't change the law. Without seeing the posts in question, my feeling is to (of course) delete any "nasty" posts, from "Author" or anyone else; and leave posts with genuine genealogical information. I'd send one, and only one, email to "Author" pointing out that facts aren't copyrightable, and telling her that any nasty, off-topic, or threatening posts will be deleted. And state that any/all posts will be deleted without notice or further discussion. You shouldn't have to be put in the middle between posters. On the subject of copyright... names and dates are NOT under copyright regardless of who found the date first or who figured out first that the name was in some record spelled some other way. I would include this fact in your one-time post. Include a link to a good genealogy copyright discussion page-- or to the List that discusses copyright issues. And again say that any replies that personally attacks over who owns dates or facts will be deleted except if the post is in the spirit of genealogical discussion. IF the author still clicks report abuse, deal with those without comment to "author". That is how I would handle it. Put your post on both boards (re-worded so it isn't duplicate). Judy

As for a book--you can copyright a book as a collective work--but you cannot copyright the facts or family relationships included in that book. If there is some unique formatting or organization or original notes included in the book that the author created this MAY be copyrighted--but not the facts themselves. Perhaps the above guidelines will give you a better understanding as to whether or not there has been any copyright infringement. If you would like to learn more on the subject, you can subscribe and post a query to: COPYRIGHT@rootsweb.com . If you would prefer to be left out of the argument, suggest your author making the claims subscribe to the COPYRIGHT list and get the facts straight. I would NOT allow arguing to continue on any of my lists or boards--just state flat out that you won't remove the genealogical info (other than private notes and original text from the book if any of that was posted on the lists or boards by others). Small selections from the book may also be copied to lists/boards giving attribution to the author under "Fair Use" even if the content being copied is copyrightable. And ALL factual info can be copied by anyone. People don't own their ancestors and cannot copyright them. Joan
