Hi Gayle... Hate to correct you, but the first reference to Ralph Blankship appears April 1, 1690, Henrico Order Book 1678-1693, page 326. I have copies of the original, and of the handwritten copy made during the Revolutionary period. The entry reads: Upon the peticon of Rich'd Kennon these may certify that there is due unto him eight thousand acres of land for ye inportacon of ninety servts. into this colony whose names are under written & for seventy persons more being negroes, the same being legally prov'd by his oath in open court. The name Richard Blankship appears as the 68th name on a list of 90 persons. But, you are also correct in that the name is listed as Richard Blankship in the June 16, 1714 patent of land for: "Capt. Henry Harrison of Surry Co. and Philip Ludwell Esqr., 6365 acres in Surry and Isle of Wight Counties, on S side of Nottoway Riv., beg. at mouth of hte 3rd br. on S. side of Hunting Quarter Sw, dividing this & land of Mr. Benja. Harrison; by the Raccoon Sw; to cor. of Hinshea Guillam; 16 June 1714, p.165. 40 Shill. & Imp. of 120 pers.: The name Richard Blankship appears as entry 114 on this list. This entry is found on page 150 of Vol. Three of Cavaliers and Pioneers. I don't know why Richard Blankship would be listed twice in land patent records. Do you have any idea? His name was Ralph Blankinship. (Henrico OB 1678-1793 p. 362) A later Ralph Blankship was named as headright in 1714 (Pat. 10 p. 165). Another spelling problem that is seen frequently is "John B." Blankenship...son of Ralph and Martha. I, personally, have never seen John "B" in any original record. If someone has seen this, please let me know. Gayle K. Hi all Blankenship researchers, I am writing to the post today, fill with sadness and a heavy heart. I received a phone call today from my mother, Stella G. Rigney Blankenship, informing me that my uncle had passed away this morning in the Bedford Memorial Hospital. The cause of death was heart problems. One doctor we talked to said he heart just stopped beating. I am number 47 on the list below and my uncle is number 29 on this list. One good thing out of all of this is the other 4 family menders said it was OK now to post the complete Blankenship chart as I have it on my computer. They was to get help finding any lost cousins. I will be away from the computer for a few day, (only check my e-mail). Below I am sending to the post MY LINE of Blankenship's down from John Jago Blankenship, in hopes that someone will see a name and make the connection to the Blankenship family. This is all my own research and I think I have put in all the sources, if that is a question please let me know. So with this I wish you all happy hunting and I hope you all find your missing links. Hi My line of Blankenship's lived in Lauderdale County. Everything I have found on them show's their name spelled with the 'in' version but my line of their descendants all spell it with the 'en' version. My line was Josiah and Matilda Blankenship(Blankinship). They have a son John W. who is married to Ann. (I have not researched this line) My line is from Richard G. and Martha(Mattie)Stokes Blankenship. Josiah and his son Richard both died in Lauderdale County but I don't know where. Josiah b. 1796 d.abt 1875; Richard G b.1826 d.abt 1881. A letter of administration, or appointment as executor (rix) gives the representative of the estate the power to act in place of the deceased, at least as far as gathering the property of the decedant, paying debts and making a distribution to the heirs at law. I have handled cases where the corpus of the estate (The property) was minimal. However since the chance of fraud exists, a bond is required to be posted in the amount of the property, unless there is a will that specifically exempts the executor. The only other exemption was where the om;y heir was the executrix. That was Ga law when I retired. Each state is different, but I have personally seen estates of less that $500 in Alabama in early 19th century which required surieties. Kay
Misty, Letters of Administration give the administrator or executor of an estate the "power" to handle the decdent's property - whether that be transferring title, selling it, etc. A bond is not always required in a probate matter - basically the person named in the Will as executor or administrator will appear in court at a time when an application for probate is filed, swear an oath that they will execute their duties faithfully, and the clerk then issues the letters of administration or letters testamentary ... I think the terms used sometimes vary from jurisdiction to jurisdiction as do the titles of court - for instance, in Texas, probate matters are always handled in the Probate Court which is one of our County Courts at Law designated to handle probate matters. I know in some areas, probate matters are handled ina "Superior" court ... Kay
Okay you guys ... Im just a peon paralegal, lol, but here are the latin term I think you're looking for: Cum testamento annexo - administration with will attached Kay
Calvin owned about 400 acres of land when he died if that helps clear anything up :) Enjoy your Sunday Everyone!!!!!!!! Earnie, All I meant was that the designation of "executor/rix" or "administratror/ix" wouldn't necessarily denote an intestate estate? At least not in Texas or Louisiana that I'm aware of and I do a considerable amount of probate work. It would depend on the dollar value of the estate more than anything as to whether an administration was filed. Kay
