rob and deanna i am not trying to be a pain, but Elizabeth wasn't born in 1836, she was born April 22, 1835 as stated by her on her pension application. She died in 1914. Not sure where she died as though there is no death certificate on her. The opinion of the court was delivered by Mr. Justice Holmes: This is an action for personal injuries, brought by an employee against a railroad company. It was tried in the circuit court, where the plaintiff had a verdict. It then was taken to the circuit court of appeals on a writ of error and bill of excep- [189 U.S. 468, 469] tions by the company, and now is brought here on a further writ of error, the company being a United States corporation. A good deal of the argument for the railroad is devoted to disputing the testimony of the plaintiff below and arguing that the verdict was excessive, but of course we have nothing to do with that. New York, L. E. & W. R. Co. v. Winter, 143 U.S. 60, 75, 36 S. L. ed. 71, 80, 12 Sup. Ct. Rep. 356; Lincoln v. Power, 151 U.S. 436, 38 L. ed. 224, 14 Sup. Ct. Rep. 387. We must assume the most favorable statement of the plaintiff's case to be true, unless some particular request for instructions makes it necessary to deal with conflicting evidence. That statement may be made in a few words. Behymer had been in the employ of the company as a brakeman about three months. On February 7, 1899, at Big Sandy, in Texas, he was ordered by the conductor of a local freight train to get up on some cars standing on a siding and let off the brakes, so that the engine might move them to the main track and add them to the train. The tops of the cars were covered with ice, as all concerned knew. He obeyed orders; the engine picked up the cars, moved to the main track, and stopped suddenly. The cars ran forward to the extent of the slack and back again, as they were moving up hill. The jerk upset Behymer's balance, the bottom of his trousers caught in a projecting nail in the running board, and he was thrown between the cars. It is true that the jury might have drawn a different conclusion from his evidence, or have disbelieved it in essential points, but they also were at liberty to find, as they must be taken to have found, that the foregoing statement is true. The car belonged to another road, but was in the charge of the defendant company, and, according to the statement of the counsel for the plaintiff in error, had been inspected before the accident, although we should have doubted whether the testimony meant to go so far. Behymer based his claim upon negligence in stopping the cars so suddenly with knowledge of his position and the slippery condition of the roof of the car, and upon the projection of the nail, which increased the danger and contributed to his fall. It should be added that, by a statute of Texas, if there was negligence, the fact that it was the [189 U.S. 468, 470] negligence of a fellow servant was not a defense. Tex. Gen. Laws 1897, Special Session, chap. 6, 1; 2 Sayles's Tex. Civil Stat. 1897, art. 4560 f. The fundamental error alleged in the exceptions to the charge is that the court declined to rule that the chance of such an accident as happened was one of the risks that the plaintiff assumed, or that the question whether the defendant was liable for it depended on whether the freight train was handled in the usual and ordinary way. Instead of that, the court left it to the jury to say whether the train was handled with ordinary care; that is, the care that a person of ordinary prudence would use under the same circumstances. This exception needs no discussion. The charge embodied one of the commonplaces of the law. What usually is done may be evidence of what ought to be done, but what ought to be done is fixed by a standard of reasonable prudence, whether it usually is complied with or not. Wabash R. Co. v. McDaniels, 107 U.S. 454, 27 L. ed. 605, 2 Sup. Ct. Rep. 932. No doubt a certain amount of bumping and jerking is to be expected on freight trains, and, under ordinary circumstances, cannot be complained of. Yet, it can be avoided, if necessary, and when the particular and known condition of the train makes a sudden bump, obviously dangerous to those known to be on top of the cars, we are not prepared to say that a jury would not be warranted in finding that an easy stop is a duty. If it was negligent to stop as the train did stop, the risk of it was not assumed by the plaintiff. Texas & P. R. Co. v. Archibald, 170 U.S. 665, 672, 42 S. L. ed. 1188, 1191, 18 Sup. Ct. Rep. 777. However, the plaintiff did not rely on the management of the train alone. The projecting nail was another element in his case. The jury were instructed with regard to that, that the railroad company was not liable unless there was a nail there improperly projecting, and a reasonable inspection would have discovered and remedied the defect. The car was in the custody of the company. There is no suggestion that the company had not had an opportunity to inspect, and the contrary was assumed by a request for instructions on the part of the company. Indeed, as we have said, its counsel interprets the evidence as meaning that the car had been inspected before [189 U.S. 468, 471] the accident. It is not pressed that there was error on this point. See Mackin v. Boston & A. R. Co. 135 Mass. 201, 46 Am. Rep. 456; Glynn v. Central R. Co. 175 Mass. 510, 512, 56 N. E. 698. The jury were instructed properly on the subject of assumption of risks and contributory negligence, and we think it unnecessary to deal more specifically with this part of the case. It was argued that Behymer had aggravated the injury by refusing proper surgical treatment. With regard to this the jury were instructed in substance, but at more length, that it was his duty to submit to all treatment that a reasonably prudent person would have submitted to, in order to improve his condition, and that no damages could be allowed which might have been prevented by reasonable care. It is suggested that, as a prudent man, he might have postponed recovery from his injury to recovery of damages. The instructions plainly excluded such a view. The argument hardly is serious. We have examined all the minute criticisms on the rulings and refusals to rule, and discover no error. We deem it unnecessary to answer them in greater detail. Judgment affirmed.

John, As you know, I think you have done what we should have done years ago. Thanks to your investigation! I checked out York Co,, PA and there were Trouts there, but did not see anyone who fit in. Berks Co, PA would be another one to check. After I check out the Material I got on Martin Behymer, and read some film on Levi of Campbell Co, I will get back to you John. The girl doing research on Thomas Beagle Sr (Lucinda/Lucy father) has shown some other children of this marriage, which I need to check out. John, in spite of your observations, I, for one, still think that Jacob, Daniel and Joels parents are somewhat a mystery. In the case of Jacob, he is shown as being born in 1777-8 in the 1840, 1850, 1860 census records, with only the 1830 records contradicting this. If he didnt migrate to OH until June of 1810, then the 1810 census in VA also records his age properly. This being the case, he is virtually too old to be a son of Barbara, as she was born in 1764. This doesnt preclude John Jr. (b. 1754) from having an earlier wife, but we have no evidence of this so far. It is possible that John Jrs son Levi was born in the 1780s. This narrows the gap between the older and younger known children. It is quite possible that there are other children born who died young. There are also potential daughters that we have yet to identify. If John Sr. is typical of widowers in his time, I think it very likely that he would re-marry very soon after the death of a wife. For example, if Nathaniel is the youngest child of John Sr. and Anna born ca. 1772-3, then John Sr. would not wait until 1780 to re-marry, as he would want a "mother" to raise and care for young Nathaniel . The fact that we have confirmation of 3 wives for John Sr. makes it much easier to place so many sons as children of one man and not break them into a two generations. [We now have to add an additional son Abraham as well!]. The 1785 Botetourt Co. VA enumeration of family heads in Captain John Lewis District has the following entries: John Pickelsimon: 12 white persons in one dwelling. John Picklesimon, Jr. 5 white persons in 1 dwelling. Abraham Picklesimon, 10 white persons, 2 dwellings. Given this, John Sr. had 10 children (not incl. John Jr.- who makes 11) alive at the time. John Jr. must have had 3 children by this time ( John Jr.s known children were: John, b. 1781; Sophia b. 1783; and ???). I have gone back and forth on this mystery often. I am currently leaning towards John Sr. as the father, since both Aarons Diary and the Clermont Currier Article have Samuel linked with Jacob as a brother. Although there are inaccuracies in Aarons diary, he would have known Jacob personally and it seems somewhat unlikely that he would mistake this relationship, while being correct about his relationship to those who remained in Virginia that he never met. I am not entirely comfortable with either hypothesis until we have more compelling evidence. I will be very happy when (and if) this matter is resolved. I cant tell you how many times I have moved these gentlemen around in my database! My vote is to keep your Descendancy Narrative as is (for now). Rick

Another find I made at the LDS Library in Salt Lake was to discover an index to wills for Fulton County, IL. Listed are very early (circa 1850, I assume) wills for: John, Henry and Benjamin Beckelshymer. I have put a request in the mail to obtain copies of these wills. I am especially interested in the one for John (aka John III), as there is some confusion over who his children were. Keep your fingers crossed and stay tuned... A few additions: John, Sr and first wife, Sophia Slingluff likely had one other child in addition to Sophia, i.e., John III b. 1780 who later shows up in Lawrence County, IN and Fulton County, IL. One of the great Behymer mysteries is whether Jacob, Daniel and Joel were children of John Sr, or John, Jr. There has been a lot of discussion on this list in the past on this topic. I have been in favor of John, Sr, but I now think that it was more likely, John, Jr. Here are my reasons: (1) Eve France, who married Joel Behymer died in 1839. If she were Jonathan's sister-in-law, why wouldn't she have appeared in the Nauvoo baptisms for the dead?, (2) the first of John, Jr and Barbara's children, Sophia was born in 1783. The next child on record is Catherine born in 1791, followed by Levi, Martin, Benjamin, Christina, Lydia and Elizabeth all born after 1791. That leaves a large gap between 1783 and 1791 with no children. Daniel was born circa 1785. Joel was born in 1789. Jacob's birth date was between 1780 and 1790 per the 1830 and 1840 censuses and circa 1778 per the 1850 and 1860 censuses (I tend to believe the earlier censuses were closer to the truth). These birth dates nicely fill-in the gap between 1783 and 1791. (3) Jacob, Daniel and Joel all married daughters of John France, (4) David is listed as a cousin of Jonathan Behymer. This is likely the David who died in 1818, leaving an estate in Clermont. I believe he is also a likely son of John, Jr, yet another child potentially born in the 1783 to 1791 timeframe. Now looking at the birth dates of the children of John, Sr, once Jacob, Daniel and Joel are removed, we find the following: (1) only one child, John, Jr, was born to his first wife, Sophia, (2) 8 years or so passes before John, Sr marries his second wife, Anne. They have Samuel, Elizabeth, Joseph, Anne and Nathaniel all within a relatively close period of time. (3) Anne dies and more time passes whereupon John, Sr marries Elizabeth Rinker and has Solomon (maybe), Enoch and Jonathan, (4) the point is that being married 3 times, the large gaps between the childrens' birth dates makes since, but with John, Jr who only married once (to Barbara Weddle), you would expect the childrens' birth dates to be closely spaced.
