"Virginia January 25, 1928 Circuit court of the County of Scott, on Wednesday, the 25th day of January, in the year of our Lord, one thousand nine hundred and twenty eight. Present: Honorable E. T. Carter, Judge. Commonwealth, Plaintiff vs, Murder - No. 1 John Barnett, Defendant This day came again the attorney for the commonwealth and the defendant was led to the bar in the custody of the Jailor of this county, and the jurors who were tentatively selected yesterday appeared in court in charge of the Sheriff of the county, and those summoned pursuant to said venire facias and in attendance, being also sworn and examined by the court, a panel of twenty persons free from all exceptions and qualified to serve as jurors and the accused. Thereupon the Commonwealth by attorney struck forth of sais jurors and the accused likewise struck four of said jurors from said panel alternately in the manner prescribed by law and the remaining twelve to-witt: Sam H. McConnell, C. H. Bush, Jacob Leonard, P. L. Hart, C. P. Bond, W. P. Kilgore, H. F. Lawson, W. W. Francisco, C. E. Meade, M. I. Baker, F. M. Bays, and J. W. Fink who being sworn the truth of and upon the premises to speak and a true verdict render upon the issue joined according to the evidence, and having partly heard the evidence and the adjourning hour having arrived, they were given in charge of the Sheriff of this County to whom was administered an oath that he would keep them together without communication with any person, that he would neither communicate nor converse with them himself nor suffer any other person to do so touching this trial and would cause them to appear in court tomorrow morning at nine thirty o'clock. And the prisoner was remanded to jail E. T. Carter ***** "Virginia January 26th, 1928 Same thing again, to appear again January 27th , 1928 for the trail of John Barnett." "Virginia January 27th, 1928 Same thing again to appear again January28th, 1928 for the trail of John Barnett." Also on the court calender: This day a paper writing purporting to be the last will and testament of J. W. Neal, deceased, was produced in open court and proved by oath of I. W. Baker, one of the subscribing witnesses thereto, and the same is admitted to probate and ordered to be recorded as for the true last will and testament of the said J. W. Neal. E. T. Carter, Judge" **** Virginia January 28th, 1928 Circuit Court of the County of Scott on Saturday the 28th day of January, in this year of our Lord, one thousand nine hundred and twenty eight. Present: Honorable E. T. Carter, Judge. Commonwealth, Plaintiff vs Murder - No 1 John Barnett Defendant This day came again the attorney for the commonwealth and the defendant was led to the bar in custody of the Jailor of this county and the jury as sworn in this case on a former day of this term appeared in court in charge of the Sheriff of this County and having fully heard the evidence, instructions of the court and argument of counsel, were sent to their room to consider of their verdict, and after some time returned into court and upon their oaths did say, We the jury find John Barnett the defendant guilty of murder in first degree as charged within indictment and fix his punishment in the penitentiary for his natural life. Signed P. L. Hart, Forman." And the defendant by counsel signifying his intention to move the court to set aside the verdict of the jury rendered in this case, further action is deferred until a future day of this term. And the prisoner was remanded in jail. Cascal Enix acknowledged himself to be indebted to the Commonwealth of Virginia in the sum of $250.00 and A. L. Compton, F. K. Elliott and John Enix his sureties, each acknowledged themselves to be indebted to the Commonwealth of Virginia in the like sum of $250.00 to be made and levied of their respective goods and chattels, lends and tenements for the use of the said Commonwealth, each waiving his right to benefit of the homestead exemption as to this recognizance, but to be void if the said Cascal Enix shall personally surrender himself into the custody of the Jailor of this County on the 30th day of January, 1928, to finish serving his term of confinement imposed upon him by a Justice of the Peace of this County, otherwise to remain in full force and effect.
