Benjamin Franklin BENNETT: We seek information on Franklin BENNETT, who was reputed born July 20, 1840 in or near Noxubee Co., Mississippi, and died in either Calvert or Houston Texas in May, 1876. He was either the husband or companion of Annie Emma BINION, b. June 13, 1845 in Noxubee Co. , MS. Annie Emma bore two of his children, Mary Ann BENNETT, b. June 12, 1867 in Noxubee Co., and William Franklin BENNETT, b. July 26, 1876 in Calvert, Robertson Co. TX. To date, we have no record of Benjamin Franklin Bennett, any marriage, birth or death record. This was a common name, and a critical examination of the 1850 MS Census shows three or four possiblities. One was a man of that name (age 14 in 1850) listed in the Attala Co. Census. (Job Binion is recorded as owning land in Attala Co.) Three stories have been passed on through three branches of the family: 1. (from her dau.): "Franklin Bennett was a Confederate Army Officer who was abducted by two masked gunmen who stopped their carriage as they left the wedding for their honeymoon... ...Ten years later Franklin found her in Calvert." 2. "Franklin Bennett was elected a County or District Judge in Houston, he was shot to death by the man whom he beat." Nothing in newspaper; however, May 10-17, 1876 missing from library. Also, it was 1876 before the TX legislature voted to create Judicial Districts. 3. "No one new what Franklin Bennett did, he would dissappear for 3-4 years at a time." One piece of data from Annie Emma Binion's father ( Job's) estate papers. In 1869, her lawyer brother lists her as "Annie Binion of Texas." She lived with her sister, named as "Gertrude Binion Carr and husband Titus Carr of Texas." Her brother would have named Franklin, were she were married, as it otherwise would have created legal problems. A second piece of data (Texas Census, 1870) lists: "A. E. Binion, age 25, and Mary Bennett, age 3, born MS." We conclude that they were not married, and the stories were a cover-up. however, he may very well have been elected a judge in Houston or Calvert.
