Page 84 The tak the session sers to Nicoll Robeson anent the citie house to be builded followis Att kilmernock the second day of December the yeir of god Jayvit fyftie two years the qlk day anent the petition from in to the session of the kirk of kilmernock be Nicoll Robeson merchand yr Most smully desiring that the ministers wt consent of the heritors of the sd parish and permanent elders and deacons of the said session was grant him libertie of ane piece ground extending to ten foots of length and breadth or therby, albeit it be wtin the church yaird yet no wayes beseming ane parte for burial nor useful yrto qlk is right fore against the sd Nicoll Robesone ewad of his house gomsnor by Robert Patones Backstair as at length was consented in the said petition: qlk petition being well considered by the ministers heritors, elders & deacons of the said parochin they under subscribing wt on minde and consent by the tenour herof hob set in tak ane affedation to the said Nicoll Robesone his airs & executors the said piece of ground extending in bread and length to the ten foots everie way ovirlly anist the said Nicoll his house sydnad as find is due yt for as the dayes space and years of the said Nicoll his altyme and after his decese for all the years and space of two nyntein years successively after others fra his entrie therto qlk fix begn at whitsonday in etocome with power to build upon the said ground keeping Robert Patone his backstair free for his entrie to the back booth and loft And fra then foorth the edifice and building to be made be the sd Nicoll upon the sd verie ground shall be peace all bruiked by the said Nicoll and his foresaid during the whole space above written wtout contradiction to be holdin by him and his foresaid of the said kirk session & these successours for payment yearly to yr thesaurers present & to come therttein schillings Four pennies scots for the use of the poore wtin the sd parish at two termis Whitsonday and Mertimes by equall proportions beginning the first at Mertimes nixto come In witness whereof mefall present Ministers of the sd kirk Noblemen Barons gentrie and permanent elders and deacons of the said church session of kilmernock
