Hi Ian, Sorry for the delay in getting back to you. At this stage I can't answer your question. I've looked at the appropriate October 1863 O & M Advertiser newspapers as she was meant to be tried at Beechworth in a Circuit Court sitting but there was nothing in the newspaper. Am about to get hold of a copy of the Criminal Trial Brief Register for that particular sitting - it should tell me if the trial went ahead and what the result was. THE LATE FATAL ACCIDENT AT YACKANDANDAH The body of Mr Smith, whose sudden death we noticed in our last, was recovered on Tuesday morning, after a considerable amount of labour in which many of the neighbouring miners assisted. From the position in which the body was found, it would appear, that two of the logs which form the roof of the tunnel, were forced down before him, thus cutting of the unfortunate man's escape. The immediate cause of death was suffocation, as there were no marks or bruises on the body, and one arm being thrown before the face as if in a last vain effort to keep of the accumulated sand. An inquest was held the same afternoon, by Mr Warden Lane, which resulted in a verdict, in accordance with the facts of the case. Note: >From the Vic Inquest Index I think Mr. Smith, was a William SMITH, aged 35, a miner from Yack. Cheers Anne Hanson No virus found in this outgoing message. Checked by AVG Free Edition. Evening All, Does anyone have a Christina BELL in their tree? I don't know much about her except that she was living in Jamieson some time in 1863 and was tried for attempted murder in the Beechworth Circuit Court in October 1863. Don't know yet any circumstances regarding the trial or who she attempted to murder - will look at the O & M newspapers at the Burke Museum on Monday. Hello Elizabeth Yes, Vic death certs ask how long in the colony. No transcription services - NSW is the only state that currently has them though I did hear another state is getting one. You get to download immediately on line these dys once you give your credit card details - or you can wait for snail mail - might cost more that way but you can get it stamped certified true copy... Certainly it looks likely the family was in the Albury Wodonga area but can't be definite about it. It might be the same situation all along the Murray. Can't help with anything else, sorry. Good luck! It appears he went to Victoria where he married and was listed as a house carpenter. He ended up buying a house block in Albury. He had a son Peter born 1850 who was baptized out of Albury. When he died in 1861 there is no record in the index of where the event occurred [age transcribed incorrectly as 34 instead of 54. But a Peter Clare married in 1874 and the index states Peter Clare married Mary Ann Edhouse 1874 Married NSW reg Victoria. My questions: i)For people experienced in researching in this area does this suggest the family stayed in Albury ? ii)are there any records of residents in the Albury/Wogonda area for the period 1850 -1862? iii) is anyone related to this family ? iv) do Victorian death certificates ask the length of time in Australia ? v) is there a transcription service for Victorian Certificates where I can request one or two fields only for a lesser fee ? As I am researching Arnold Clare for a article for the Great North Road journal the Pick I am trying to avoid spending money buying the death certificate if I can, I have read the marriage and baptism records in the NSW pre 1856 BDM microfilm of the transcribed church records. Hi Elizabeth, Re: "But a Peter Clare married in 1874 and the index states Peter Clare married Mary Ann Edhouse 1874 Married NSW reg Victoria." This is is a common mistake with Victorian marriages. The place recorded is "Birthplace". i.e. of Mary Ann Edhouse . If you search for the reverse, that is, Peter Clare married Mary Ann Edhouse, you find the place is listed as Alburry (sic). No Victorian marriage indexes give the actual place of marriage. All you can tell is it did occur somewhere in Victoria! Testing - I may have been automatically unsubbed due to being sent one large email from someone unconnected to any mailing lists - it came through about 20 times! I deleted it from the mail box on line, but then it came through another umpteen times. Four of them was over the limit on my mail inbox so all else would bounce - I should have about 100 emails right now and only have a couple other than this repeated ad infinitum large email! If this does not appear then I will have to re-sub. Dawn
