Hi Lesley, I have checked the newspapers and there are several William Andrews mentioned but I don't think any are him. There's nothing on the Certificate of Freedom which gives a clue and I'm pretty sure I checked the 1825 index early in my research but will go though it again to be sure. He was in Warwick with the Leslie's in the very early days of the settlement. Perhaps he was assigned to them but it seems those records no longer exist. Certificate No. 39/1003. 22nd July 1839 John Hughes came on the "GUILDFORD 1829 My query, he was to be sent to ?????? 17th day 1841. Does it read Merton Bench,? The next record I find for him is receiving his Certificate of Freedom July 1845 in the Darling Downs 9 1/2 years after he was sentenced. I haven't found a ticket of leave or any other documentation. The link he provided no longer works. Can anybody provide any information on this couple and their parents? We are related through their daughter Catherine who maried Abraham Newling, a free settler. I can find 7 birth records that I am confident belong to them - 1832 William, 1834 Jeremiah, 1836 John, 1840 catherine, 1846 Harriot, 1850 Joseph and 1856 Elizabeth. Apparently John Byrnes' father came out as John Burn on the "Hindostan", but no details were given on his mother. Elizabeth parents were given as William Barnes, on the "Barwick" in 1798, and Ann Hewlett, on the "Canada" in 1809. Any information would be appreciated Margaret
Hi Grahame Many thanks for your reply, that's interesting re Michael Burn, So this maybe him coming back to Port Jackson and then he was in trouble September 1805 apparently sent there (again?). So now I'm trying to find out when he came back after he was sent there in September 1805. He bought property in Sydney in 1805 as well so he was really on the go. Hi Dianna You could try looking up several books on the early history of Norfolk Island. "Forgotten Generation of Norfolk Island and Van Diemens Land" by Reg Wright, on page 102 under the heading Convicts to Port Jackson from Norfolk Island on HMS Investigator - 28 February 1805 - Harrington 23 February 1805, list includes a Michael Burn. No Michael Hayes or Sutton in the general index. Dianna It was usual for a convict in receipt of a CP not being allowed to return to the place where they were convicted. Both Matthew Sutton and Michale Hayes were Lifers whereas Michael Burn initally received a 7 year sentence and would have been free to return home if he wished on the expiration of his original sentence. You selected just a few words from the Colonial Sec. Report - so it is a bit difficult to comment on it. Removing to another dependance, in my opinion, just means that they could remove to say VDL. I don't know what their sentence for illicit distilling was although in a Proclamation dated 15 June 1806 it does state that people convicted would be fined Four Hundred Pounds Sterling and imprisoned for the term of six calendar months in the county gaol. The three men convicted were all sent to Norfolk Island - perhaps they could not stump up the cash???? These three men all returned here by 1808 and that was a time when we had two Administrator Governors and then another in January 1809 - records were not well kept during that time and also many pardons and land given to some were overturned by Governor Macquarie on his arrival in 1810. I believe that the Paracensus is made up of records from all sorts of places so it may not actually come from a church record. There are also a lot of assumptions made in the Paracansus. As the childrens names are not mentioned it may just be taken from the 1806 Muster as Susan Roberts is listed as having two children. Dianna, you write to so many lists with the same questions and in some cases give more information on some lists than on others - some of these questions have aleady been answered weeks ago - it may be worth going through all the replies you have been given to date and consolidating them. Dianna On the day that Michael Byrne (Burn) was convicted, so were Michael Hayes and Matthew Sutton - all for illicit distilling and all (according to the Sydney Gazette) were to be sent to another settlement. The following is from the State Records Colonial Sec. Index. HAYES, Michael. Per "Friendship", 1800; merchant Transported in 1800 per "Friendship"; he received a conditional pardon in June 1803 but was sent to Norfolk Island in September 1805 for illicit distilling; he returned to Sydney in 1808 and received a free pardon; he obtained a wine and spirit licence in 1810 and was granted land at Airds in 1812; he was involved in the movement to allow Roman Catholics the right to practise their religion; he was drowned in September 1825. By about October 1808 (from memory) most of the people living on Norfolk Island had left due to the difficulties of the governtment maintaining the Island. Only a small number remained until it was finally closed in 1813/14.... until it opened again as a convict settlement in 1825. I'm still trying to pint point when his son's were born in 1806. I looked at the microfilm reel yesterday in reference to his being sent away but it does not state how long for.
