    1. Re: [AUS-NSW-PENRITH] A point of Law
    2. Kristine Wood
    3. Hi Listers, I did a little more research into the marriage with a deceased wife's sister law. On 3 Feb 1871 the South Australian Parliament voted to legalise the right for a man to marry his dead wife's sister, making it the first British Colony to do so. The report than went on to the argument that a woman could not legally marry her dead husband's brother and also a man could not marry his dead wife's sister's daughter even though there was no blood link. Seems the arguments were based on the Anglican Prayer Book. NSW passed the Marriage with a Deceased Wife's Sister Act on 30 April 1875. Qld had the Deceased Wife's Sister Marriage Act in 1877 and it was finally repealed in 1991. The Commonwealth Marriage Act [1961] standardised all the States. It is available to read online but with all the amendments to date it doesnt mention a clear veto to a marriage except that it protects those in an adoptive role when children. I have a clue to finding some answers to the step relationship marriage in a book by Nick Vine Hall called 'Tracing your family history in Australia - a national guide to sources' 3rd Edition 2002 Pages 342-3. Or I can check the Anglican Prayer Book. I will let the list know if I find anything. 1. Re: [AUS-NSW-PENRITH] Why am I getting everyone's reply to other people's emails
    2. I use Outlook Express for e-mail, and there are two options for reply provided, "Reply All" or "Reply" (to Sender). The first option distributes the reply through AUS-NSW-PENRITH-L@rootsweb.com, the other only sends the reply to the individual to whom I am responding, in the case, "John". However, as I have clicked 'Reply All' today - good morning everybody! (Poor John may get this twice!) I really enjoy reading all your responses and seeing how widespread is the interest in Penrith. I often pick up precious little nuggets of research directions from stray comments in reply to another message, so thank you all and please keep them coming. ----- Original Message ----- From: "John" <byrnesj@minerals.nsw.gov.au> To: <AUS-NSW-PENRITH-L@rootsweb.com> Sent: Friday, February 28, 2003 12:42 PM Subject: Re: [AUS-NSW-PENRITH] Why am I getting everyone's reply to other people's emails > NOTICE: This message is intended for the addressee named and may contain > confidential or privileged information. 3. In reply to the email that was sent to the list, the reason for you receiving replies meant for an individual is that the email is being sent to the the Rootsweb email address. In the emails that you are receiving you should be able to see who the email is from and the address it is sent to. The way a Rootsweb list works is that if you select to reply to a Rootsweb list email, the email address selected is: AUS-NSW-PENRITH-L@rootsweb.com. That way everyone on the list receives a copy of any replies to queries sent to the list. If your reply is a little more personal it is best to send it to the individual person. Just remember to remove the Rootsweb email address and enter the email address of that person. It's a very easy thing to do especially when you are pressed for time and want to send a quick email. If you should have any further questions about this please email the List Administrator at: AUS-NSW-PENRITH-admin@rootsweb.com Regards, Danielle Embleton List Administrator -----Original Message----- From: Lyn Forde [mailto:lynforde@yahoo.com.au] Sent: Friday, 28 February 2003 8:13 AM To: AUS-NSW-PENRITH-L@rootsweb.com Subject: Re: [AUS-NSW-PENRITH] Castlereagh Land Grants Why am I getting everyone's reply to other people's emails. 3. Thank you for your reply. I concede I can be wrong but I remember reading a newspaper article about the marriages. I will look it up again. It may have had something to do with the Property Act in the late 1800s. Have found only limited information on the net about Step marriages. UK only allows step marriages if the stepchild did not live in the step relationship prior to turning 18. I suppose that is to do with protecting the person from undue influence. And cousins may marry if they have a blood test. Some States in the US do not allow step marriages so persons cross the border to marry. I will take the advice of the earlier reply about contacting the church. I am not trying to belittle the ancestors but trying to find a logical explanation for the non-marriage. Thanks to all who showed interest.
