The children married into the Lantry, Meredith and Fry families. FROM THE COLONIAL SECRETARY'S PAPERS THIS WAS LISTED BLINMAN, Charles. Hi Lesley, All I can tell you is Marcellas did not die while incarcerated at Moreton Bay, and according to the NSW BDM's he died in Bega NSW in 1880 as there was only one Marcellas Day that died in either NSW or QLD 5541/1880 DAY MARCELLAS Father:MARCELLAS Mother: UNKNOWN Distrct: BEGA There is no record of Marcellas Day remarrying in NSW or QLD I have checked the listing for a death in Moreton bay for "Day" and "Marcellas" and neither appear. there were only 223 Listed Convicts that died in Moreton Bay including those that drowned or were executed.     3. Hi. John Punyer had three children as shown in NSW BDM's Sarah 1850 subsequent died. Selena 1854 and Elizabeth 1857 all with Mother's given name of Selina/Selena. Death records appear a bit confused, fathers name as Infant etc. Is this fairly common or might the error be on the index but clear on the certificate. I haven't been able to find a marriage record (perhaps in those days not an uncommon oversight) Is there any way that Mother Selina's surname might be found. Ted

    3. Hi Lesley, Moreton Bay was still part of New South Wales in 1828 so I doubt the 7 year law would have applied. When and where did Marcellas Day die? Maybe Margaret was a widow by the time of the second marriage or maybe she married bigamously. Many convicts did. The intent of the 7 year law was that the parties be separated "across the seas" but, as I understand the situation, even though the Government had made this law many Churches would not accept it. The Churches refused to marry people if they knew there was a living spouse in England, Scotland etc. unless the married party could furnish written proof that the spouse was deceased. This lead to some great forgeries in letter writing! Carol

    3. I think I have found Henry's family back in UK. Henry b 1826 Lympne Kent son of Henry and Ann Punyer. This agrees with the possible death of Henry in Australia 1901 Bathurst. He doesn't appear in the 1851 UK census or rather I haven't found him but his brother is listed as "mariner". Lympne near Folkestone Kent is a coastal village likely to produce seamen so Henry could have come to Australia as a seaman and decided to stay. Are their any records that might identify when he arrived. + Ted

I have tried searching with the surname Ca* as there are not many Cage names listed and I wonder if it has been misspelt, but to no avail. I don't know what to do next.     3. Thanks to all responders There maybe a connection between John and Henry and John certainly pushes his luck with the law. John was in a relationship with Selina (no surname found) in the Mudgee/Maitland area around that time. I don't think John married Selina although there were children. John was married back in UK and I'm sure that fact would have been on his record. Would the authorities allow him to marry again over here? The Punyer male line in Kent around this time consisted of Henrys, Williams, Richards and Davids and Johns almost exclusively. There is certainly no shortage of Mary Kellys in the convict register but I've not been successful in identyfying one that married a Henry Kelly, she may not have been convict. There is a death registred in Bathurst 1869 for Mary Punyer father Thomas mother Ann. If this had been a married person would the parents names be included or the spouse? If the dead persons family were still in England would the names be put in the register?
