Hi List, I am trying to confirm the route that the ship Indispensible took when she arrived in Sydney in 1809 with 62 female convicts aboard, she stopped at Rio, but there seems to be conflicting information on whether she came via Cape Horn or the Cape of Good Hope. The information suggests via the Horn, but that would be against the prevailing wind I would have thought.... is anyone able to perhaps offer thoughts on the route the early ships took to Sydney from England... My convict ancestor, Henry Canny, came via Cape of Good Hope, but that was in 1824 aboard the Prince Regent, but the Indispensible seems to be mentioned as Horn. I look forward to any thoughts on the route. Thank you in advance.... Regards David

Hello again list I've had a wonderful response to my request for help and information about my ancestor Daniel Nutter: what I've received has doubled the number of records I had previously found about his life as a convict. I've thanked individually all those who replied, but I'd like to say here how delighted I am to have found and used this way of contacting such helpful people. He must have been caught, because he survived to get his ticket-of-leave in 1844. I've asked an Australian friend to look for him in the 1828 Census of NSW (Nov 1828), where he should be - if he wasn't still on the run! Daniel left behind his wife and at least three children, of whom Alice b1818, the youngest, was my Gt-gt-grandmother. His wife Isabella died in Burnley, Lancashire in 1843, though he probably didn't hear that for a long time, if ever. I haven't yet found any evidence that he had children in Australia - but if he did, it would be great to make contact with his descendants. In any case, I should be most grateful for any advice or help on tracing Daniel's life in Australia. Andrew Bannister

Hello Leah, The convict Samuel POWELL - who was tried at Middlesex in 1819, received 7 years sentence, and arrived on the "Earl St Vincent" on 16 August 1820 - was aged 23 when sentenced, so would have only been 17 years old when he married Mary VAUGHAN in 1813 in Wales, a long way from London. Are you sure you have the right man? Do his convict records show if he was single or married? I could find nothing on the arrival of Mary VAUGHAN or Mary POWELL as a convict on the Earl St Vincent, which shows only 160 male convicts - if she had finished her sentence prior to coming to Australia in 1820 then she would have come 'free' accompanying her husband wouldn't she? Samuel POWELL was tried for stealing seven yards of cambric and tried at the Old Bailey. He received his Ticket of Leave (TL 489/1423) in 1820 (it must have been issued close to his time of arrival?), and was appointed a Constable at Parramatta in 1822. http://www.oldbaileyonline.org/browse.jsp?id=t18191201-96-punish556&div=t18191201-96#highlight If Mary was married in 1813 and convicted the same year, and she served 7 years before her arrival in NSW in 1820, was she tried as POWELL or VAUGHAN?     3. Sue, according to the record at St Bartholomew's Colne, Daniel was born 12.7.1794 and baptised 12.10.1794. Parents were Robert Nutter, weaver, of Haggate (Briercliffe) and Anne (I believe nee Taylor) ). In the IGI, Robert Nutter married Nanny Taylor at Burnley 12.8.1787. Nanny is a common diminutive for Ann, and Daniel's first two children are named Robert 1814 and Nanny 1816, both baptised at Haggate, as was Alice b1818. Does this fit with your Nutters? My GG Grandmother Mary Vaughan who married Samuel Powell in Wales in 1813 in Brecon ( Breconshire Wales), no parents on the IGI, Mary was a convict and was sentenced to 7 years, information from my cousin Bernie who has been researching for thirty years so my time to pick up a thread, Mary finished her sentenced before she came to Australia in 1820 on the Convict Ship Earl St Vincent with Samuel, I have scanned the Old Bailey Records and found nothing, could she have been sentenced in Wales or maybe Scotland.     3. Thank you for all the kind help I've received with this 3x great grand uncle. I'd like to post this potted biography for the benefit of my helpers. John Punyer was born 1806 in Hastingleigh Kent UK. He married a widow Abigail Jones Dec 1828 in Wye Kent and they had two children. The first, Mary Ann born 1830 died 1831. The second girl Abigail born 1832 died 1858. However John was arrested and tried for stealing poultry and was sentenced to 7 years transportation. He arrived in Australia in 1835 on board the Marquis of Huntley and was sent to the Hunter district. He was an assigned servant to the East Maitland police magistrate. This didn't keep him out of trouble and he didn't receive his certificate of freedom until June 1846. His wife described herself as a widow and remarried. John's "adventures" are related in the local papers on a couple of occaisions and then he settles down with Selina Grimes late Hill. She came to Sydney with her parents and worked as a childrens nurse. They had three children I think, the earliest ones registered/baptised in the local church and not to much information has remained. Elizabeth's state registration in 1857 says that Selina and John were married in Newtown Sydney in 1848 but I haven't found any record of it. John appears to have served three terms in jail 3 years from 1867, 4 months in 1875 and 12 months hard labour in 1879. He did get his portrait taken in 1879. John died sadly in the Macquarie Street Asylum Parramatta, where he was an inmate. The verdict of the coroner's jury was that he died by his own hand and the cause of death was injuries to his throat. I have not found anything further on Selina, it is possible she 'married' again and was buried under that name. Once more thank you to you all, Leslie when I first started on the Australian connections and Rosemary recently with a great deal of help. Cheers Trish Nowra NSW The Daily News (London), 10 August 1852, issue 1940 - ASSIZE INTELLIGENCE - Northern Circuit, Appleby, August 6, Crown Court BURGLARY - Teddy Kenny, aged 17, George Guttry, aged 22, two desperate-looking characters; and Isabella Hunter, aged 26, all imperfectly instructed, were indicted for burgulariously entering the dwelling of Mr Christopher Anderson, of Brackenbury, a lonely farm-house, about two miles from Appleby, on the night of the 12th of June last. Mr Bell conducted the prosecution. The prisoners were not defended by counsel. The facts were briefly these:- The two male prisoners were seen in the neighbourhood of Brackenby, on the evening of the 11th of June. During the night the prosecutor's house was entered by a window, and several articles of wearing apparel were stolen. A girl named Ann Mason, who had been apprehended along with the prisoner, deposed that she had slept in a barn with the prisoner, Isabella Hunter, on the night in question, near to Anderson's; and that early in the morning the two male prisoners came into the barn, bringing with them some wearing apparel and eatables. They said they had broken into a house about two miles from Appleby, and that they had hid some of the things in a heap of stones. Subsequently the prisoners were apprehended with part of the property in their custody. The girl Mason stated she had never seen the prisoners before they came into the barn, nor had the female prisoner Isabella Hunter been in their company previously as far as she was aware of. The Lord Chief Justice, in summing up, told the jury that there being no evidence in his opinion to convict the female prisoner with the burglary, there must be a verdict of not guilty with respect to her. Against the other prisoners the case had been clearly made out. Andrew I had a look to see what Ancestry had on your convict GGG Grandfather (no more than you already have, I think) but I noticed another Nutter on the list - a John Nutter who was also tried at Lancaster, on 6 January 1836, and sentenced to 7 years transportation to VDL (Tasmania). He was transported on the Bengal Merchant. I wondered if he could be related to your Daniel.     3. Hi Leah Did Mary serve her sentence in Australia and then return to the UK? And was this before or after her marriage to Samuel? Not all trials in England were held at the Old Bailey. There were lots of local (circuit) courts where trials were held to deal with local offenders. If she committed her offence in Wales, Scotland or Ireland she would have been tried in the relevant country.     3. Hello I have come across this mailing list and was hoping someone might be able to advise me on the process to obtain a copy of a Ticket of Leave for WA if this is possible. My 3x Great Grandfather was George Guttrey he was sent to WA onboard the Stag which arrived in WA on the 23 may 1855. I have printed out records from the Fremantle Prison Database and also the DPS convict list/personal description which provide me with lots of details. I would now like to trace him and his family back to the UK and thought perhaps his TOL would help me locate him in the UK. I note that he was sentenced in Appleby UK, and IGI shows the birth of a George Guttery 16 Sept 1832 in Worcester UK not sure if this is one and the same as far as I can see the village of Appleby has 3 contenders Cumbria, Westmorland or Lincolnshire so would like to narrow this down.     3. Leanne The town of Appleby where your ancestor was tried would be Appleby, which was the county town of Westmorland but is now in Cumbria. Westmorland officially disappeared as an administrative centre in 1974 when it and the former Cumberland became part of the new county of Cumbria. People still refer to the old counties as they do to Middlesex (where I live) which officially disappeared in the 1960s. The Appleby in Lincolnshire is just a village.
