    3. the following is a trust deed of 1874 to secure a $500 note.... QUESTION??................How can I get more info on this note..was it paid off in time,? did they lose the land that secured the note? etc. phil Mississippi County Deed book page 556 27 June 1874 From } To Secure Sylvanus Cable } To Smith & Thornton For Trust deed } $500. James B. Best atty } Know all men by these presents, that I Sylvanus Cable of the county of Mississippi and state of Arkansas for the consideration herein after mentioned has this day given granted bargained sold and conveyed and by these presents does give grant bargained sell convey and deliver unto James B. Best trustee his heirs and assigns the following property to wit, The south east quarter of section Twenty Eight (28) of Township Fifteen (15) North of the base line in Range Eleven (11) East of the fifth (5) principle meredian containing one hundred and sixty (160) acres of land more or less. To have and to hold the same unto the said trustee his heirs and assigns forever, withwhom the said Sylvanus Cable does hereby covenant and agree that he is lawfully Sized in fee of the said property and that he will warrant and defend the title to the same unto the said trustee his heirs and assigns forever against the lawful claims of all persons whatsoever. But this deed is made in Trust for the purposes of securing unto Smith & Thornton the following indebtedness to wit, One note for $125.00 due January 1st 1875. One note for $125.00 due January 1st 1876. One note for $125.00 due January 1st 1877. One note for $125.00 due January 1st 1878, payable to the said James B. Best as attorney in fact for H. S. Smith & N.M. Thornton and Hannah Thornton, without intrest until past due. Now if the said indebtedness secured hereby be paid on or before maturety of the same then this deed is hereby satisfied and void, and the trustee shall reconvey by quick claim the property hereby conveyed unto the grantor at the expence of the grantor afoesaid, but if the said Sylvanus Cable fail to pay or cause to be paid the said indebtedness at maturety or part of the same, then the said trustee shall advertize for 30 days in a news paper published in the town of Osceola Mississippi County Arkansas or by 3 written notices posted in 3 public places in Mississippi County one or more of which notices to be at or near the location of the property to be sold giving time place and terms of sale. And sell same for cash to the highest bidder and from proceds pay firstly the cost of executing this trust, Secondly the debt and intrest hereby secured deducting legal discount from any note not due nor bearing intrest paying whatever balance may remain to the said Sylvanus Cable his ! representatives or assigns, and in case of a sale under this trust, all right of equity of redemption is -------- and the trustee shall convey title absolute in fee simple.
