This same thing happened in my family a couple of years ago. I and some others looked feverishly to find proof of Indian heritage but could find none. The family lost the little Indian boy in the end. They had had him since a baby and he knew no other family. The boys mothers family ended up with him, they were Indian and had all the rights according to the laws of the Tribe. It is a very hard situation, the Indian Council does carry alot of power.
