Utah Bills Still May Linger Friday, November 8, 2002 And the outlook is not that clear in the new Congress for measures such as the sale of Martin's Cove to the LDS Church BY CHRISTOPHER SMITH THE SALT LAKE TRIBUNE WASHINGTON BUREAU WASHINGTON -- With incoming Republican Senate Majority Leader Trent Lott wanting to cut short next week's lame duck session of the Congress, passage of several Utah bills this year is unlikely. And the outlook is not that clear in the new Congress for measures such as the sale of Martin's Cove to the LDS Church, the San Rafael Swell state-federal land swap and the annexation of Wendover to Nevada. All of those bills were inked by retiring Utah 1st District Rep. Jim Hansen, chairman of the House Resources Committee, whose position and seniority drove the engine that got the measures through the House and to the Senate's doorstep, where they stalled. If the Senate does not act on the bills this year, it means new versions of the Utah measures will have to be introduced when the 108th Congress forms in January. But even a GOP monopoly on Congress may not help a proposal to convey the federal public land in Wyoming known as Martin's Cove to The Church of Jesus Christ of Latter-day Saints, which considers the site "sacred ground" for its connection to the 1856 blizzard deaths of Mormon handcart pioneers. "The Martin's Cove land giveaway is unlikely to be affected by the outcome of the midterm elections," said Barry Lynn, director of Americans United for the Separation of Church and State, which has opposed the Martin's Cove legislation. "The word in Washington is that Wyoming's Republican senators are opposed to this deal and it's likely they will have the necessary clout to block the proposed legislation." In recent letters sent to Wyoming constituents, both of the state's GOP senators underscored their opposition to the sale of Martin's Cove. They prefer LDS Church officials and the Bureau of Land Management (BLM) working out a new use agreement for managing the site. "I am deeply concerned about the rift emerging within Wyoming over this proposal," wrote Sen. Mike Enzi, R-Wyo. "It is very important, therefore, that we take the time this issue deserves to make sure it is handled correctly and that we not leave behind any irreparable damage within local communities." Another Utah measure stuck in the Senate with an uncertain future in the new Congress is a trade of 131,000 acres of federal land for 108,000 acres of state parcels in the San Rafael Swell. The deal was intended to consolidate federal holdings within a proposed new national monument, but Emery County voters Tuesday showed they didn't want the area turned into a national monument. The land swap legislation also has been tainted by a federal investigation prompted by a BLM whistle-blower complaint that the deal amounted to a $100 million giveaway of federal resources. And a House-approved measure to annex Wendover, Utah, to West Wendover, Nev., may now have smoother sailing but a long voyage in the Senate with GOP control. The enabling legislation had been opposed by Senate Majority Whip Democrat Harry Reid of Nevada out of concern that moving the state line eastward would hurt border casinos. Voters in both communities Tuesday approved a nonbinding referendum supporting the merger of the two towns. "The referendum shows that the majority on both the Nevada and Utah sides want the towns joined," said Marnie Funk, Hansen's Resources Committee spokeswoman. "If we have the Republican majority in the lame duck, Harry Reid is no longer the Whip and we could see some movement on that bill." Besides Reid, Nevada's other senator, Republican John Ensign, also is opposed to the Wendover annexation bill. In the 2000 election cycle, Ensign was the top Senate recipient of casino industry campaign contributions, collecting $373,749.     2. I have been researching SCHNABLES Company G during the Civil War. Through Various internet sights and other research I believe Most of the men from this company came from the Sugar Loaf area to Yellville Area. Corporal H. DeSHIELDS (HANDY) and WILLIAM D (also B) SHIELDS (WILLIAM DeSHIELDS) were members of Company G under Schnables Missouri State Guard. WILLIAM was captured 12/23/1864 in Marion County, Arkansas and died 4/20/1865 in Alton Prison, Alton, Illinois of Smallpox. GOSHEN JONES, private, was captured 10/28/1864 in Searcy, Arkansas and died 12/31/1864 in Alton Prison, Alton Illinois of Rubella. Other divisions of SCHNABLES troops also came from the Yellville/Lead Hill (now) area. The following men were members of Schnable's Company G CSA.     3. I am looking for information on Caleb Kirk, married to Ellender Kirk, Martha Kirk and John W. Kirk. John W. is the son of Caleb and Ellender. They both served in the Civil War, in the Union Army. If information I have is correct, Samuel died in the war. I believe him to be the older brother of John W. Martha, if my information is correct is the sister of Samuel and John and is the daughter of Caleb and Ellender. Caleb and Ellender were granted land in Boone County, I believe in section 18, township 20N, range 18W. Martha was also granted land but I am not sure the reason. I have no information on John W. who is my great grandfather. I know he was around 17 at the time of the Civil War and have heard rumors about him but have no information other than that. I do know both survived the war and Caleb was granted the land as part of his compensation for his time served in the Army. Caleb was also accused of murder, incarcerated in Van Buren, Crawford County and the trial was moved to Sebastian County. I have not been able to get to the records in Sebastian County to find the outcome of that trial but am assuming he was acquitted. John W. was supposedly wanted by the law, for what reason I don't know but I have heard he was found, laying beside two hunting dogs, in a cabin, dead, in the mountains somewhere and was buried, by the law, at the cabin site. This is the rumors I have heard. I have information that Caleb is buried in the Enon (old) cemetery but I have not verified that. If anyone has any information about the Kirk's of Boone County, I would appreciate you sharing that information. Thank you very much, Michael R. (Kirk) Wood

I would love to hear from anyone who can give me a little info on any of the descendants. One lady left a message in 2001 and when I tried to reach her, it no longer was an address.     3. Memoirs of Otie Jane Hughey 1897-1990 from oral interview Jan 1986 by Dolores Raines Sutton I was born Feb 7 1897 in Boone co Ark on the Newt Milum place near Lead Hill. I was the 3rd oldest child of James Langston{Lank] and Melissa Hannah Richardson. About 1903 we moved to the Bell ranch owne by Ben Reed. we stayed there until about 1906 then moved to the Jess Chaney place. My Daddy,Lank, delivered mail on horseback from Lowry to Omaha from 1902 to 1939.. he started the route riding a blind mule then bought "old Barlow' a brown horse that he rode for 30 years. In 1909 he filed on the old homestead on Bear Creek.They stayed there until my folks seperated in 1924.but didnt file for divorce until almost 20 yrs later in 1841. There is a stoy behind this.My mother and the kids still at home moved in with my Brother,Alvie,and when my Dad sent the Divorce papers Alvie tore the up and Mama never knew she was divorced. He married again in 1944 to Martha Joy Pate but divorced her 1 yr later .all of us kids thought they were just living together until the marraige and divorce records were found in 1979 at the Harrison court house. I have a little brother,Ora Alfred that was the 5th person buried in the Chaney Cem. He died sept23 1907. he took diptheria and died in 7 days..his funeral was helt in the Chaney School House. i started to school when i was 5 in 1902. we only went from july1 to Oct 1. My 1st school was the Hinkle hpuse School. this was a 2 room house with a fireplace in the middle..It was on a knoll by Bear Creek.It was only used until the new Chaney school was built. my Teacher was Bascom Patterson. We had a brush harbor meeting and lunch on the grounds on Sunday before before Chaney school opened. all the neighbors came.Gus Crumplers Dad, Newt, said"who would have thought we would have ever got this new school ' an d for years people joked about the "Whoda thought it" s chool. We lived across bear creek from the school and daddy would break the ice and carry us across the creek in his canoe in the winter. after we moved to the homestead in 1909 i attended the Derryberry school until i finished the 8th grade. . some of my classmates were; bill,linda,Tom and Norb Riggs Gearld Derryberry,cecil Arnold,Katie,Haute and Ethel Arnold.Dovie Richardson, Ginny Dan[Nat Cheeks step-dau] Steve and Teddy Cheek [Nats sons] Sally Golden and several of her brothers but i cant recall their names. We went back to lead hill in July 1918 and lived on the Jess Chaney place our 1st child,Ruby Hazel, was born there Sept 7 1918 We stayed there until aug 1919 then moved to Keokuk fal ls Okla with Bobs Fathers and Brothers and sisters.There our next 2 children were born Daizy Odessa Jn 7 1920 an d Robert Fay aug 21 1921. we moved back to Lead Hill for the last time in the fall of 1922 and lived on the old Osborne place owned by jess parrish. we stayed there 7 years. our next 4 children were born there Delson Clay.Mar 9 1924,Mable Marie April8 1926,Bessie Maxine june 11 1927,Stella Mae June 24 1929. We moved back to Keokuk Okla in 1929, Andrew Curry moved us in his truck. our 7th child Della Ray was born there aug 15 1931. in Sepr 1931 we moved to Paoli Okla[Garvin Co] and our last 3 children were born there. Berta jean jan 24 1934 Alfred Charles[Buddy] may 29 1936 and Willie Dolores sept 4 1938. We moved to story Okla [Garvinnn co] in 1943 then back to Paoli in 1944. we moved to Ft Gibson Okla in 1948 but only stayed 3 months then moved back to Paoli. we lived in okla City from 1955 to 1957 and Bob got hurt on his job and we moved back to Paoli. we moved to Lexington ,Okla[Cleveland co] in 1959 and Bob died April 15 1977 there when he was watering our Garden. i am 89 yrs old and i am in good health for my age. Note: Mom died May 3 1990 and is buried beside Papa in the Paoli Cem. at Paoli,Okla
