Those wills that were centrally recorded is what appears on scotlandspeople, and therefore just a small percentage of the total wills actually written.     3. A will is only likely to end up on Scotland's people if it was registered. There are 2 ways a will gets registered. The testator (name for the person making the will) has to be dead before registration. The executor (or if not a lawyer, the family solicitor -attorney in the USA) arranged for the will to be registered either in the books of the local Sheriff Court, usually as part of the process of applying for Confirmation (the court procedure and document which authorises the executor to administer the estate) or in the Books of Council and Session in Edinburgh. If someone died but his/her estate was too small to require the executor(s) to apply for Confirmation, the will would not need to be registered and would just be used to carry out the wishes of the deceased. Such a will would probably just be thrown away once the estate was wound up. Dan I wonder what makes you think Ann Jenkins had a will? Most people then and still today die without making a will and their estates are dealt with under the rules of Intestacy, which in Scotland are I think about to be updated again to reflect the changes in the "nuclear family". Robert Christie Winter of Dundee and Elizabeth Winter, his mother ( hence he kept her name as his middle name) He was a grand man and became chairman of Liverpool grain storage docks. His son Edward Winter also took over the grain storage in the 1970's and 80'S as Managing Director. John Winter his other son, my father, became Air commodore Winter CBE in the RAF as a surgeon.     3. I have been researching the McWalter, McWattie, McWatty, McQuattie and McQualter family for more than 10 years. My branch left the Liff/Dundee area in 1852 and I have at least 1500 direct descendants from Robert & Elisabeth McWalter in Australia. After one generation all members are McQualters. I am interested in any information of McWalter's in Scotland.

All Scottish birth certificates give the date and place of the parents' marriage, which speeds you on, but English ones don't..... The surname McQuattie is a variant spelling of McWattie (QU=W, as in Quhite = White), and Wattie is a diminutive form of Walter, so when you get far enough back, all the various Walter/McWalter/McWalters/McWatt/ etc. names start from the same origins, as derivatives from Walter.
