A Register of Deaths in Sumter County, Alabama, for 1881 to 1893 (the only extant such record of deaths in the 1800s) has an entry that Eliza Binns, age 87, born in Virginia, died near Jones Bluff on December 3, 1881 of "old age". Having been given this record by a former Probate Judge of Sumter County, and having used the information from it in a book that I authored, I deposited it for safekeeping in the Alabama Room of the University of West Alabama in Livingston, Sumter County, Alabama. Jones Bluff was a village near the present town of Epes, and several black families of Binns lived there during my youth in the 1930s. A leading black of the area, Will Binn, owned and operated a store near Epes until the late 1980s or early 1990s. Joe Stegall
C.J. McMahon voted at Gainesville in 1850 and in 1861. Additionally, in 1850, A. W. McMahon voted at Gainesville. Please keep in mind that the voting returns from which this information is taken were the only ones that survived until today. Wendell, thanks for the info. You are the first connection to our line I have found. Robert was my husband's ggg grandfather. We have a journal that Robert's grandson wrote and in it he tells quite a bit about his grandfather. Bill my husband, is descended through daughter, Amelia Cubley and Henry Vincent Hurlock. Robert lived with them for a number of years and shared a room with young Sam. This journal is where we get the Tenn. connection. I would love to exchange info with you. Can I get in on this? Do either of you know how Robert M Cubley (also in Sumpter, Greene and Choctaw Co) is related to john Cubley? Robert was a Methodist Minister and ended up in Texas about 1858. He is found on many marriage records in the above mentioned counties. He also had a tie to Giles Co., TN. I believ his wife, Rebecca Beavers was from there but in looking in that County, I found a Cubley connection. Robert was born about 1812 in Ga and died in Trinity Co., TX in 1890. He lived in Palestine and later in Corsicana before moving and dying in Trinity, Trin. co.
This past Monday, I visited Livingston to see the house my dad grew up in. The present owner of the house was kind enough to give me the "grand tour." The house is located on West Main Street and was built in 1842. It was like taking a step back into the long ago past around the turn of the century! I could imagine my grandparents, my future dad, and aunts and uncles living their daily lives in that house. Later, my aunt gave it the name of "Pleasant Ridge." I then drove to Gainesville and had a wonderful tour guide there who took me to the old Presbyterian church and gave me a history run-down of the area. It was my great-uncle who ran the American Hotel in Gainesville until the late 1920s. Ah, such history! Gail McMahon
Wendell, one last thought. The Probate Office may be willing to make a copy of the will for you and, perhaps a copy of the Orphans Record Book 3, page 91. However, that Orphans Record citation is for only the first record of the settlement of the estate of John K. Cubley. There may be additional records in Book 3 or later books. Frequently, the heirs of the estate are identified in later records. Joe
Wendell, I do not have access to the Cubley will, except by going to the courthouse (30 miles away) and making a copy of it. You may be able to obtain a copy from the Probate Office if you write to it and give it the will book number and page number. Frequently, requests to the Probate Office for copies of records are passed along to me for it seems that I am the only genealogical researcher that the staff of the Probate Office can turn to. But, in this case, since you have the citation as to where the record is filed, you should be able to obtain a copy from the staff of the Probate Office. A comprehensive survey of all known cemeteries in Sumter County was accomplished in the 1960s and 1970s, and a book of the recorded tombstone inscriptions was published in 1997. No Cubleys are listed. My records show that a John K. Cubley died in Sumter County and that he left a will (Will Book 1, page 121) and some settlement of his estate is recorded in Orphans Court Record Book 3, page 91. You should keep in mind that relatively few early immigrants to Sumter County were buried with permanent grave markers. It seems that most, even those who could have well afforded inscribed tombstones, were placed in graves without them. Also, the ravages of man (e.g., land-clearing bulldozers, loggers) and of nature have destroyed many of the family cemeteries and, overgrowth is now consuming some of the early community and church cemeteries where there is no one left to care for them. Although the censustaker did not identify where the families on that page of the census lived, I know that two of the families (Dillards and Willinghams) lived near Emelle. As you can find from the 1850 census, the family was headed by Susan C. Scott, age 45, and born in VA. The following children were listed, all born in VA except the last, who was born in AL: Isabella M. age 16 Catherine J. age 14 William age 13 Walter age 11 Virginia age 9 I recognize that this Walter would have been too young to have fathered children as early as 1850, but he certainly would have been old enough to have fathered your twins Alexander and Regina in 1858.
