The courts have held that the use of property is the proper test of whether property is eligible for exemption from ad valorem taxation. Most Worshipful Grand Lodge of the Free and Accepted Masons of the State of Alabama v. Sara Norred, as Tax Collector of Montgomery County, et al., 603 So. 2d 996 at 1000 (Ala. 1992). In Norred, the Court held that "[g]enerally, who owns the property at issue is unimportant; how the property is used is determinative." Id. at 1000. Similarly, this Office has said that the entitlement to the "exemption rises from the use of the property and not the nature of the owner of the property." Opinion to Honorable JAMES E. WITHERINGTON, Tax Assessor of Monroe County, dated November 17, 1983, A. G. No. 84-00068 at 1. In order to qualify for exemption, property must be used exclusively for religious worship or for schools or for purposes purely charitable pursuant to section 40-9-1 of the Code of Alabama. "Crossroads: The Early Years of Monroe County" by Kathy McCoy Introduces the First Monroe Countians as Native Americans--gives background history of the early settlement of Monroe County. Second Chapter is on the Colonial Frontier--the MS Territory, the settlement of the Spanish, the five major tribes that settled this area of AL, the frontier and what was going on; the French along the Tombigbee; the Scots and the English; the Highlanders; the known settlements; and Charles & John Weatherford; and leads up to the background info on the Creek Nation and the Creek Indian War; the fourth chapter deals with life along the Federal Road and history surrounding it and the families who settled it and traveled it--mentions McDavid's Hotel; Stewart; Downey; People or Peebles; Hollinger; McMillan; Austill; Atkinson; Cornell; and others. It's got info on many different places and people that inhabited early Monroe County. A must read and must have for any historian's book shelf and presented in a format that would be wonderful for teachers and students of any age; especially our 4th to 6th grade level! From the Federal Road, she goes into info about the Great Migration to the WBTS; and then Winds of Change--Reconstruction, so you will find alot of useful historical information within the covers of one book! I bought three Heritage books covering Alabama counties. The Monroe County book is indeed a big disappointment. A distant cousin wrote about our Lett family, who moved from Virginia to the Burnt Corn, AL, area in about 1832. The entire story was omitted. What a shame! I can, however, recommend a new book I recently purchased, "Crossroads: The Early Years of Monroe County," by Kathy McCoy, 124 pages, from The Monroeville Journal, at 251-575-3282. Mary in Florida
