    1. [ALLOWNDE] Autauga Cemetery Book Project
    2. Caroline
    3. Subject: Autauga Cemetery Book Project We have set our first official "Committee" meeting on the Autauga Cemetery Book project for next Thursday, August 29th at 7:00 pm. at the "Little White House" next to the Heritage Center in Prattville. We plan to meet and start determining what cemeteries we have sufficiently surveyed, and which cemeteries we need to survey. We also plan to discuss possible formats for the book. We aks that all interested persons bring copies of any cemetery survey (s) they have done which we can possibly use for the book. We need all the hands and minds we can muster up to accomplish this goal. We need people who can get out in the woods and survey cemeteries and we need people who can type. We will have a limited amount of time to get the surveying done in the fall. There are some of the cemeteries located in remote locations which must be surveyed before deer season starts in November. After this we will only have about a month's break in January-February before turkey season begins. Please make plans to attend this meeting next week if at all possible. Share this information with others who may be interested in helping. We will try to plan a follow-up meeting in late September to kick off the "surveying". If you have any questions, please feel free to call myself (358-5351) or Jane Klinner (365-7176). Your "fellow digger", Larry

As to guardianship of a female for her children, that was done all the time. This is the first time I have heard of it for a father for his children. Now, don't get me wrong, I just hadn't heard it before, doesn't mean you are wrong, just my inexperience with it. It is an interesting thing and I think I shall look futher into this. Could be I have others with the same thing and I never knew a father had to petition for his children, only mothers for some dumb reason. Thanks for the additional information. Really is helpful

Classification: Query Message Board URL: http://boards.ancestry.com/mbexec/msg/an/JS.2ADE/713.1.1.2.2.1.1.1.1.1.1.1 Message Board Post: Carolyn, we have been told by lawyers and researchers alike that in several states a widower was required to gain legal custody of his own children (particularly if he were absent at the time of the death of the mother). Josiah served in the War of 1812. We think he may have still been away in service during the War of 1812 when Willoughby was born and Nancy died (1813). Besides, Josiah's will mentions the fact that he had children with his first wife (Nancy Asbell) although the will doesn't list them by name. These are the reasons we feel sure that Willoughby and the other children mentioned in the guardianship document were Josiah's children. About 40 years ago my brother-in-law died in TX. His wife was required by law to become the legal guardian of their three children. This happened about 1960 in Lubbock, TX. I don't think this is an unusual practice at all. We have done a lot of searching for siblings of Josiah in Lowndes Co. AL and have not found any. I don't say that he had none--but if he did, we haven't found them. I wish I could give you some black and white proof that Willoughby was the son of Josiah Todd and Nancy Asbell, but I can't. However, I am sure that my g-g grandfather, Willoughby Todd, was the son of Josiah and Nancy.

You have Willoughby as the son of Josiah. But, I have a question to ponder - why was Josiah named guardian of Lewis, Patsy, and Willoby on Dec. 1, 1815 in Edgefield Dist, SC if he was their father? Why weren't they named as children of him in his will dated in 1842? These three - Lewis, Patsy, and Willoughby, were still living at the time Josiah died. So, are they really his children or perhaps children of a deceased brother or cousin?

    3. In the book, "Lowndes Court House" by Mildred Brewer Russell, page 282 is the marriage of "Todd, Hardy and Mary T. Sawyer, Dec 29, 1865 by Rev. J.A. Fonville" . > Thanks, Rae, for your help. We have been under the impression, however,. that Hardy Todd's wife was Mary KING Sawyer (not Mary MCQUEEN Sawyer). Have you seen this entry in the marriage book? I would like to verify the wife's name--one way or the other. Thanks again. >
