(Spelling as is) Crittenden Co Ark Nov 8th 1874 I received your letter on the 7th of this month. was very glad to hear from you, and to learn of the health of all. very sorry to hear of sister Julia bad health. I promised to come but cannot come at the appointed time on account of gathering my crop. I will make more then I expected to. I have eight or nine bales in the field, and have picked out eleven. My expenses this year was $200. and I have settled all, and don't want to make any more, and just as soon as I can get through I will come. My wife have never seen you, but she was very proud when I received the letter, and sends howdy to you. You wrote to me that you, Bob Bell, and Sam Barker were coming out west. I want you to come right away, as I may not come at the time I appointed. the land which you wrote for me to get, I have already got, and it is splendid land. I will make you a present of 30 acres when you come. I have bought some that I have never seen, but from all accounts it is good. there [sic] only five acres cleared but you can clear as much more as you want. land here is not like land there, it will bring 3/4 of a bag the first year of attendence, and if well tended will bring 4/4 or the whole to the acre. You wrote me word that you had seen all the Bell family, and that they wanted to see me, and just as soon as I can make it convenient I will come, for I would be glad to see them also, but cannot come at this time present. tell Gaston Bell, Largus and the Dr. howdy for me, as I cannot see them my self and wish to very much. tell Miss Dialtha howdy, and tell her that I have not forgotten her and never will. I remember how she nursed me when I was sick, and I always will remember her as long as I live. sell your land for what you can get and come out here. You stated in your letter to [me] That you want me to go to Birmingham and see after your land in that place, and pay $40. fourty dollars that you thought you owed one Mr. McGloplon. I went to Birmingham last June, And I inquired concirning of that matter. And I could not learn any thing about the man of Whome you spoke they say he is dead. I did not find any one that knew him, But they say that Mr. King is living there, but I did not find him I Will go down again soon. Aug. 11th 188(ripped, looks like piece of a 6) Mr. Stephen Bell Mound City Ark My Dear Brother I take pleasure this after noon to write you a few lines that you know that we are all well and are doing very well I received a letter from you some time since, glad to hear from you. I have been to Birmingham time and again I can not do any thing with the land. I con- sulted an attorney and he looked into the matter And he said that you will have to come out here yourself and get it up. Said that I can not do any thing. You come as soon as you can. every thing is all right you come to my house. I will go down with you. And I think it will be hard to get up. land is worth a great deal in Birmingham A man will give his life almost for a house place. Come soon Very Respectfully, Richard Bell Additional Comments: Gist of the case: Bell's claim: bought land in 1871, paid substantial part of cost of land, lived on and cultivated the land. 1872, Owner wanted rest of money, Bell didn't have it, made agreement with McLaughlin to pay the owner, hold a mortgage on the land for him, and he would pay it off in cord wood. Bell said McLaughlin agreed to this. However, Bell was shot at from ambush and wounded near his home a few months later, so he 'hastily left the State' and went to Arkansas. Bell said before he left, he asked McLaughlin to take care of the land while he was gone, and McLaughlin agreed. Bell said he wrote McLaughlin several times from Arkansas, with no answer. He got his brother in Alabama to look for McLaughlin about the land, but brother couldn't find him. In 1888 Bell went back to see about the land, but found the mortgage he signed was, in reality, a deed giving McLaughlin title to the land. He tried to get the land back but was unsuccessful. McLaughlin, in his Answer, said Bell asked him to buy the land for him, which he refused to do. Then Bell suggested McLaughlin buy the land, allow Bell to cut the timber off the land and sell it to get money. With that money, Bell would buy the land back from McLaughlin in a year. When the books of the original owner were checked, it turned out Bell had paid very little of the price, leaving McLaughlin to pay pretty much the full price for it. A Justice of the Peace, Mr. Moore, drew up the deed in the presence of all parties, read it to all, and witnessed the payment and signing of the deed. McLaughlin found the land deserted a year later, nothing left in the house, etc. He said he assumed Bell had decided to leave and forgo the arrangement. He heard nothing about or from Bell from 1872 to 1888. He sold the house to a black man, John Johnson who lived there a year or two then left. Several white women lived in the house rent-free until about 1883 - some railroad workers a few months, then it was deserted. McLaughlin continued to pay taxes, but the land made no profits. Even so, the value of the land went up over the years. McLaughlin said an offer of $10,000 was made for it at one time, but whether it was a 'good-faith' offer or not, he didn't know. Attorney for Bell said Bell, '... being untutored in letters, and unlearned, together with being a former slave..." placed great trust in McLaughlin (a Major in the Federal Army) and felt he had been deceived. Bell said the rent and profits from the land had long ago paid the mortgage debt, and wanted McLaughlin to account for the overage. McLaughlin's side denied the allegations that he had agreed to a mortgage, or had known that Bell was leaving the state, or that he had agreed to watch the land for him. They pointed out discrepancies of facts stated in the Complaint, and that more than 15 years had passed before Bell returned wanting the land. The land made no rents or profits, and had cost McLaughlin in taxes. An interesting note regarding Bell. When he saw McLaughlin in 1888, he was missing a leg. McLaughlin asked what happened to it, and what Bell was doing now. Bell said the leg was cut off due to a 'sore heel.' He also said he owned over 1,000 acres of land outside Memphis, and said, 'I am rich now.' But the court found Bell didn't have enough proof to support his claim, and the case was dismissed. Gravitt Trumer Edison Gravitt, 58, 921 Greenville St., LaGrange, died July 19, 1986, at West Georgia Medical Center {LaGrange, Troup Co., GA} following an extended illness. Born in Cleburne County, Ala., on Dec. 28, 1927, Mr. Gravitt was the son of the late Rev. Garland and Harriett Nixon Gravitt. On Oct. 27, 1950, he was married to the former Betty Redden. Mr. Gravitt was employed by West Point-Pepperell. In addition to his wife, survivors include two sons, Steve J. Gravitt of LaGrange, and Diron K. Gravitt of Hogansville; four sisters, Alvaretta Williams of Bowdon, Lovetta Whitaker of Bunnell, Fla., Lavada S. Brown of Bowdon, Sybil Jackson of Ranburne, Ala.; four brothers, G. W. Gravitt of Anniston, Ala., Goodwyn Gravitt of Lanett, Ala., Elmo Gravitt and George Gravitt of Bowdon; four grandchildren and a number of nieces and nephews. Services were conducted July 21 from the Corinth Baptist Church with the Rev. Darnell Teal and the Rev. Robert Longshore Jr. officiating. Interment was in the church cemetery with the following pallbearers: Mickey Searels, Randy Hyatt, Chris Jackson, Larry Williams, Winfred Lawler and Lawrence Williams. Harris picked up a pair of shoes and placed them in his basket. He was accused of theft and showed fight. He struck Montgomery and then made an effort to draw a pistol when Montgomery drew his pistol and fired. The two negroes ran, but Harris overcome from his wound fell to the sidewalk. Benjamin Moore (Later Lieutant at Gates Defeat) in the Regiment (?) Col. William Moore and in the Battalion of Major Elijah Moore of the North Carolina Militia Commanded by Gen. Butler and at the time he was drafted, resided in Granville County North Carolina and March and Rendevoured at Hillborough in North Carolina and from Hillborough we were marched to Salisbury remained there four or five Days and marched from hence to the Catawba River and were stationed there about one Month at the Old Nation of order on the Big Catawba River Gen Morgain was there some eight or Ten Daays with his Brigade & Col William Washington with his light horse was also with us a few days and he recollects being Mustered and paraded (paroled ?) Col Davy and recollect a regular adjutant Alcorn a Strict Decplinarian Joseph Blackwell was my Lieutant ; part of this Tour & he returned home & the name of his success or not recollectable and from Catawba River were marched to Salsbury and there Discharged & left the Service the first of January 1781, being in active service fron the 15th of September until the first of January following & wus in No Battle in said Tour ; he recollects seeing Gen, Gran on this Tour at Hillborough and on the Catawba. And he was again drafted and Enroled as a Minute Man after the Militia Man of Carolina and was enrolled early nthe Month of June in the year 1781 in the Company of Capt John Peace & his brother Joseph Peace was our Lieutenant ensigned name forgotten and at the time of his enrollment resided in Granville County North Carolina and was marched from Granville Court House to Col. Burtows Spring and Stationed there in Granville County North Carlina Ten Miles from Roanoke River about three months and thence to Taylors Ferry on Roanoke River and were there stationed to guard the Ferry app & on about one month and then returned to the Station at Col. Burtons and remained there doing duty until we received intelligence of the Capture of Lord Cornwallis and we were immediately Dishard (discharged) and in the month of October and is certain it was about the last days of October in the year 1781 go no written discharge there was a General Joy in Cap and our Capt parraded (paroled) us and said to his Company of Boys you may all go home. On this tour there was only two or three Companies and Col. Burton was the Commander of the whole. There was no regular officers on this Tour & recollects no field officer & was a private on daid tour and was taken from the ranks and was my Captain Cookl & done no other duty and recollects but one other officer Capt. Merideth or Meredit and his desponest says that from the time he entered as his last Tours Belonged to the infantry and was in no Battles during his service as before related states he received a written discharge on his first Tour bur the same was accidently washed up in his waistcoat pocket shortly after being discharged and his has no Documentary evidence of his Serivce as that he know of not person living whose is testimony he can procure who call testify to his Services and knows of no living witness who has any personal knowledge of his Services and believes there is none he hereby Relinquishes ever claim whatever to a pension on annuity except the present and Declares that his anme is on the Pension Roll of the agency of any State. The following are the Several Answers of the said Charles Holt to the several interrogatories of the War Department Answer to 1st interrogatories, where and in what year were you born ? I was born as I was informed by my parents in Prince William County on the 30th day of March 1762 in the State of Virginia Answer to 2nd Interrogatories, I have no record fo my age and only know my age from what my parents told me Answer to the 3rd Interrogatories, When called unto the Services I lived in Granville County, North Carolina and since the revolutionary War I lived Ten years in North Carolina in Granville County and Franklin County and thence removed to South Carolina & lived there twelve years in Spartanburg County and then moved from there to Franklin County in Georgia and lived there about Seven years and then moved to State of Tennessee & there resided about Seven years in Descor (Decatur ?) Hickman and Rutherford Counties and from there thence removed to Blount County Alabama where I have resided ever since & courting resided at this time. I was drafted both times where called unto the Service. Answer, I knew a regular officer on our first town called Adjutant Alcorn Col. Wm Washington of the Light Horse Gen Morgan I recollect Col. Wm Moores Militia Regiment & Col Washington Light Horse & knew Col.or Gen. Davy. Leaving her a widow and she has not intermarried since but continues a widow. She was married to the said Charles Holt in Franklin County North Carolina on the fifteenth day of February in the year Seventeen hundred and Eighty five by one Britton Harris a Justice of the peace, who published the same there being no lisences granted in that day as the thinks For proof of her marriage she refers to the accompanying proof there being no publice as private record of her Marriage. She is now Eighty nine old agreeable to what her mother told her when she was a small girl, and recollects her marriage took place not long after the war was done, and liberty was gained. Her oldest child name William was born on Christmas Day in the same year and is now sixty eight years old. She makes this declaration in order to obtain a pension under the acts of Congress above refered to. That he is the oldest child of Charles and Martha Holt and that is father is the Identical Charles Holt who was a revolutionary Pensioner on the Alabama Pension roll and drew a pension at the rate of twenty eight dollars per annum at the Huntsville Agency up to this death and died in the Month of September in the year A.D. 1847, leaving his mother the above named Martha, a widow, who has not intermarried since but continues a widow and that his Motha (sic) had nine other children besides himself five of whom were his brothers, John the oldest and Kinderal the youngest of them is now living in Blount County & State above written that is his brother John above names is about five years younger than he is and his brother Kinderal who is next to the youngest of all his Brothers and sisters is about twenty years younger than he is. That he affiant was sixty eight years old the twenty fifth day of last December agreeable to what hs has always been told by his parents and his family Bible record- which recorded was torn out of his family bible by some of this children not long since, and destroyed but he knows he is not mistaken in its being his age, for his Father and Mother the above named Charles and Martha Holt lived together always up to his fathers death. Affiant says that he has often heard his Father and Mother say that he was borned on Christmas day in the same year that they were married in Affiant states that his disinterested in the result of his Mothers application for a pension. William Holt Sworn and subscribed before me the date above written and I would certify that William Holt who maker of the above affidavit is a very respectable old gentlemen and that the statement that he makes are true and that his oath would be taken in any Court of Justice when he is know. State of Alabama Blount County Be it remembered that on this 21st day of April A.D. 1854 personally appeared before me a Justice of the Peace in and for the County and State above written John Holt aged sixty three years past a resident of the County and State above written who after being duly sworn according to law, doth on his oath make the following affidavit that his is the son of Charles and Martha Holt, that his father is the Identical Charles Holt who was a Revolutionary Pensioner at the rate of twenty eight dollars per annum on the Alabama Roll and drew his pension at the Huntsville Agency and died on the nineteen day of September in the year A.D. 1847 leaving his mother the above named Martha a widow who is yet a widow having not been married since the death of his father and is now very old and Much afflicted Affiant states that he is the second son but third child of his parents, having a sister between him and his brother William who is the oldest of them all. And that he afiant is now sixty three years old passed and will be sixty four years old the 11th day of next December agreeable that he has always been informed by his Father and Mother that he as kept his age ever since he can recollect and is confident that he is now sixty three years old passed, That is father and mother lived together as husband and wife until the death of his Father and he never heard the same disputed in his life and had and raided nine other children besides himself the youngest, a sister being dead if she was now a living would be about forty six years of aged. Gillispie Judge of the Probate Court of said county do hereby certify that satisfaction evidence has been produced before me to show that Charles Holt was a revolutionary pensioner on the Alabama Roll at the rate of Twenty eight Dollars per annum and that he died in the county & state aforesaid on the 19th day of September 1847 leaving Martha Holt who makes the foregoing declaration his widow & who is still his widow and that the said Charles Holt and Martha Holt was married in the year Seventeen Hundren and eighty five I would further certify that I am personally acquainted with the above named Martha Holt and was with her and her husband Charles Holt in his life time as well as with William and John Holt all of whom are witnesses of undoubted varsity I further certify that Elijah McAnnally and A.. State of Alabama Jefferson County On this 19th day of July in the year A.D. 1854 personally appeared before me a Justice of the Peace within and for the county and state above written William Spradling ages eighty four years past a resident of Jefferson County in the State of Alabama, who after being duly sworn according to law doth on his oath make the following affidavit that he has been acquainted with Charles Holt, who has always been called a Revolutionary Soldier and his wife Martha Holt for seventy years and upwards ; that he was at their marriage and saw them married ; that they were married in Franklin County North Carolina in the year Seventeen hundred and eighty five or six. He knows it was not after the last mentioned year for it was before he was sixteen years old, he lived a neighbor to them in North Carolina from there they all moved to Franklin County Georgia where they all lived together for several years ; that his also acquainted with their family of Children and has been acquainted with most of them since. William is the oldest who was a young man grown and married before they left Georgia ; that they all moved from Georgia to Lincoln County Tennessee and from Tennessee to this Country, when they lived neighbors for and near each other for several years, the above names Charles moved from this Jefferson County to Blount the adjoining county, in which he lived up to the time that he died. That the above named Charles and Martha lived together as man and wife up to the death of the said Charles and that he never heard of any dificuties (sic) with them or such they were both good neighbors, good citizen and much respected by all their acquaintances William Spradling Sworn to and subscribed before me this date above written and I would certify that William Spradling who makes this above affidavit is a man ot strict varracity and whose oath would be given full credit before any Court of Justice where he is known ; that is a verry old man and much respected by all who know him. That she has been acquainted with Charles and his wife Martha Holt for upwards of fifty years that she first got acquainted with them in the State of Georgia in Franklin County about the time the youngest son named Kinderal L. was borned. She lived at a neighbor to them for several years in Georgia that they all moved to Lincoln County, Tennessee and lived in the same neighborhood there for several years and from there they moved to Alabama to this Jefferson County where they lived in the same neighborhood for some years until the above names Holts moved to Blount County to this and where the old man Holt died; that from her first acquaintance with them up to the death of the old man. They lived together as husband and wife was so reputed an that she never heard the same disputed by any person. She further states that William is their oldest child who was about grown when she first go acquainted with them in Georgia. Affiant states that the said Martha is about ninety years olf and if any person is entitled to a pension that she is. Affiant further states that he is well acquainted with the children of the said Charles and Martha Holt ; that William their oldest who now lives in the adjoining county (Blount) to this is an old man and about seventy years old ; that he was a man grown when he, affiant, was old enough to recollect anything. Affiant state that he never heard the Marriage of the said Charles and Martha disputed by any person in his life but they were always recognized as Husband and Wife by all who knew them. Gillispie, Judge of Probate The State of Alabama Blount County Probate Court Special Term, 2nd day of February 1856 Be it remembered that a Special Term of the Probate Court in and for said County was begun and held at the Court house in the Town of Blountsville on the 2nd day of February 1856 when and where the following business was had to wit: It appearing to the satisfaction of this court upon the testimony of John Ratliff and Gilbert Barton residents of the County of Blount in the State of Alabama will be known to me as creditable witnesses; that Martha Holt widow of Charles Holt (deceased) died on the 11th day of May 1854 at the residence of her son John Holt in Blount County in the State of Alabama and it further appearing to the satisfaction of the court here upon the testament of the aforesaid Witnesses that the said Martha Holt deceased at the time of her death left the following named persons as heirs and distributies of the estate viz William Holt, Rebecca intermarried with Asa Walker, John Holt, James Holt, Caty intermarried with Jesse Taylor, Martha intermarried with one Overton Goodwin, Kinderal L. Holt and Elizabeth Holt intermarried with one Abraham Grimmett all the age of twenty one yeares and upward and no others know to said Witnessess. It is therefore ordered that the aforesaid heirs be certified as the body of heirs of the said Martha Holt who is as the widow of Charles Holt, deceased. Comes John Holt heir and distributies of the estate of Martha late of Blount County in the State of Alabama deceased and makes application to the court here to grant unto him the said John Holt Letters of Administration on said deceased state as next of kin and it appearing to the satisfaction of the Court here proof duly made in such case; that said deceased according to the Statute in such case made and provided. It is therefore ordered and decreed by the Court here that Letters of Administration on the estate of the said Martha Holt deceased issue to him the said John Holt and that the same be filed and Rendered. It is further ordered that the said John Holt enter into bond in the penal sum of Three Hundred Dollars conditioned as the law directs I nthe cases of Administration of estate of deceased persons; There for the said John Holt entered into bond in the sum of Three Hundred dollars conditioned as aforesaid with Elias Miller and Thomas Ratliff as securities who are deemed severally good which bond is approved, and ordered to be recorded and filed. Said pension certificate is payable and which pension certificate I cetify in following is a true copy. Department of the Interior, Claim for Military Service Ceritfy that in conformity with the law of the United States of the 17th June 1844 and 2d February 1848, Martha Holt deceased widow of Charles Holt, who was a private in the Revolutionary War was written to a pension at the rate of twenty eight 33/100 dollars annum commencing 19th September 1847 and terminating 11th May when she died. And that the amount due as foresaid is payable to John Holt, Administrator of the (cant read) of himself, William Holt, Rebecca Walker, James Holt, Caty Taylor, Martha Goodwin, Kenderal L. Holt, Elizabeth Grinnell and any other surving children. This certificate is issued in lieu of then dated December 29th 1855, which am payable to the widow and which now been cancelled. Given at (?) Sworn and Subscribed this 29th day of December 1856 before me Martin Hudson, J.P John (X) Holt Know by all mean by these presents that I John Holt Administrator of Martha HJOlt deceased of Blount County State of Alabama to whom the certificate of pension was issued by the United States do hereby constitute and appoint Kinderal L.
