Darby Complaintant vs. Mary (Porter) Darby Defendant This cause coming to be heard on this April 23, 1912 was submitted for decree upon Bill of Complaint, Decree Pro Confesso on personal service and on cross- bill and testimony as noted by the Register; and, on consideration thereof, the Court is of the opinion that the Complaintant is entitled to the relief prayed for in his said Bill, so far as the question of divorce is concerned - and that the respondent is entitled to the relief prayed for in her answer and cross-bill relative to the care, custody, control and maintenance of the child - the son of the complaintant and respondent. It is therefore ordered, adjudged and decreed by the Court that the bonds of matrimony heretofore existing between the complaintant and defendant be and the same are hereby dissolved and the said P. F. Darby is forever divorced from the said Mary Darby for and on account of voluntary abandonment; and it is further ordered and decreed that the respondent Mary Darby have the care, custody, control and maintenance of the child herein above named. Foster Answers Final Call (Thomas Hickman Foster) The remains of T.H. Foster were laid to rest in Providence Cemetery Monday beside his wife. He was next to the oldest in Clay Co. having reached a milestone by 412 months. Up until a few years ago, he owned a small home in the Fox Creek precinct, where he lived more than 40 years, but for the last ten years he had lived at the home of C.T. McKay where he died. He was a member of the C.M. Church and a Confederate Soldier No near relatives live hear now but a brother somewhere in Georgia survives. He has a host of friends who regret to see the live of the good old man come to the sudden close, as he was stricken Wed. evening and died Sunday Morning.
